Abstract of an Initiative on “Two States' Union - ADAM”
A group of Sudanese thinkers, artists, writers, Civil Society leaders, and community workers thought of the repercussions of the forthcoming referenda both in the South and Abeyie, and thought of putting forward an initiative of creating a two-state union in the country. Following is the abstract of this initiative: As the differences between the two Ruling Partners widen and the skirmishes and infighting reach unappreciated levels; And as internationalization of our internal affairs reaches an unprecedented and unacceptable dimensions; And as military confrontation intensifies in Darfour and other area; And as few days are left before the Referenda in the South and Abeyie expected to be conducted on 9 January, 2011; And as the outcome of the Referenda threatens the entire political and social live in our country, least to say the flare up of the civil war more sever than before irrespective of the outcome of the Referenda whether they favored unity, secession, or simply deferred, postponed or abolished; To save the country of the possibility of the horrors of such repercussions, we, the undersigned, put forward the following initiative as we believe it can help close all doors of excuses to lead The Sudan to square one: (1) That the two Ruling Partners agree voluntarily to do away with the idea of conducting the Referendum in the South. We believe this idea is conceivable as the entire Comprehensive Peace Agreement (CPA) itself was a result of their consent and mutual agreement. (2) That the two Partners agree on establishing two fully independent states both in the South and in the North with the administrative borders of 1956 as their common borders. (3) That the Two Partners approve the establishment of UNIION between the two independent States with a common market, unified currency, complete or partial dual nationality with the application of the four freedoms of movement, residence, work and property ownership. (4) That the two Partners, in case the complete dual nationality is adopted, agree that the Predecessor State continue to allow the citizens who acquire its nationality by birth or naturalization continue to have the privilege of its nationality, in addition to the guarantee of the Successor State to allow them acquire its nationality as well. (5) That the two Partners, in case the partial dual nationality is adopted, agree that the Predecessor State refrain from depriving them its nationality acquired by birth or naturalization before they consent to acquire the nationality of the Successor State. Such agreement between the two States will avoid them creating any cases of statelessness (BIDOON). (6) That the two Partners, in case they opt to adopt partial dual nationality, agree to give priority to the following groups: a. The Northerners whose lives and interests for many generations are linked to the South, and the Southerners whose lives and interests are linked to the North. Any fear harbored by the two groups that their interests are compromised may lead to disturbances and violence, or even war. b. The tribes living in the border areas whose number reach 9 million Northerners and 4 million Southerners, or around one third of the entire population of the present Sudan. If we take into account that the Misairiyya Tribe, for instance, own about 10 million cattle we can imagine that their lives and wellbeing would depend on roaming southward with their cattle for water and grazing during the dry season that can extend for 6 months. They reach in their journey areas across Bahr Alarab River up to Bantiue. This would indicate the magnitude of the problems that can ensue in the future the wandering tribes confront the fact that they could no longer go southward for the simple reason that there was a new state came into being!! It is true that, according to the accepted norms of International Law, border tribes should not be affected negatively as a result of any arrangement between any two states. But such a norm that can be expressed in a short statement may need years to implement, or decades of interpretation and legal battles, prolonged diplomatic efforts and consultations with regional and international organizations. The roaming tribes cannot wait such long periods while witnessing their cattle face catastrophic repercussions. (7) That the two Partners agree that the NEW UNION will have common institutions to tackle specific issues mutually agreed upon. And that they agree to have a commission to oversee the work of these institutions with a common presidency and secretary general on rotational basis. (8) That the two Partners agree that Abyei, which is expected to enjoy a form of self rule after consulting its people, irrespective whether it is annexed to the South or to the North, to be declared an area of integration (Tamazuj), and administrative capital of the UNION. In case the two Ruling Partners fail to agree on Para 1 above, and the Southerners opt for secession, a national popular campaign should be waged to encourage them to agree on the post-referendum arrangements as stipulated from Para 2 to 8. ***
