تقدمنا بهذه المذكرة للمجتمع الدولي عبر مؤسساته المختلفة ذات الصلة بالتوجه الأوروبي العام نحو إعادة اللاجئين السودانيين من الشتات الأوروبي إلى السودان. متمنيين أن يوفقنا الله في وقف هذه الجريمة الأوروبية التي تتم تحت رعاية وبصر نظام الكيزان الحُمر الجدد(الشيوعيين).

تنويه بوضع حقوق الإنسان في السودان وقرارات إعادة اللاجئين السودانيين من أوروبا
منذ الثورة الشعبية التي أطاحت بالرئيس السابق البشير، قامت مجموعة مدنية بالإتفاق مع مجموعة من ضباط القوات المسلحة ، وشكلت حكومة مزدوجة، ثم قام الطرفان بكتابة اتفاقية أعتبرت دستوراً مفروضاً على كافة الشعب السوداني، بدون مفاوضات جامعة لتكوين لجنة دستورية تمثل جميع الشعب.
بعد ذلك:
أولا: تمت عمليات إعتقال غير قانوني لآلاف من الأشخاص ، تحت مزاعم وجود علاقات بينهم وبين النظام السابق. مع ملاحظة أن هناك العديد من المنتمين للنظام السابق ومن لهم علاقات مع النظام السابق خاصة من رجال الأعمال الكبار هم شركاء أو مؤثرين في نظام الحكم الحالي وتتم حمايتهم.
ثانياً: هناك الآن آلاف في المعتقلات بدون تحقيقات ، وبدون اتهامات، وبدون محاكمات عادلة.
ثالثاً: تمت مصادرات لآلاف الملكيات الخاصة بدون حكم قضائي.
رابعاً: تم فصل عشرات الآلاف من وظائفهم فصلاً تعسفياً ، بدون تحقيقات وبدون حكم قضائي.
خامساً: تم إغلاق العديد من الصحف بدون تحقيق وبدون حكم قضائي.
سادساً: يتم رفض قبول تعيين أي شخص لا ينتمي للنظام الحالي في أي وظيفة حكومية.
سابعاً: تتم عمليات تمكين للحزب الشيوعي واسعة النطاق ، بحيث يتم تقليد الفرد الواحد وظيفتين أو أكثر، مع عدم القدرة على الطعن في تلك التعيينات قانوناً.
ثامناً: هناك عمليات فساد واسعة النطاق يتم التغطية عليها، ولا يمكن لأي شخص اللجوء للقانون للطعن فيها وذلك للأسباب التي سنوردها في البند (حادي عشر).
تاسعاً: تتم التعيينات في الوظائف في الغالب على أساس أُسري أو قبلي أو جهوي أو حزبي. ولا تتم عبر إجراءات قانونية تتسم بالشفافية والمساواة أمام القانون.
عاشراً: هناك تعطيل شامل لدور النيابة العامة والقضاء في الرقابة على أعمال الحكومة.
حادي عشر: تم منح حصانات مطلقة للمسؤولين الحاليين في النظام، وتعزيز ذلك بالآتي:
1- تعطيل المحكمة الدستورية عن مراقبة قرارات الحكومة. وتقوم المحكمة الدستورية بتجاهل الفصل في الطعون المقدمة ضد أي قرار غير قانوني أو غير دستوري ضد الحكومة.
2- تسييس النيابة العامة ، حيث ترفض النيابة إتخاذ الإجراءات القانونية ضد أي مسؤول أو شخصية نافذة وذات صلة بالحكومة.
3- رفض رفع الحصانة عن أي مسؤول من قبل الحكومة ، وبالتالي تمتنع كل المؤسسات العدلية الرقابية عن النظر في أي قرار يصدره ذلك المسؤول في تلك الحكومة.
ثاني عشر: يتم رفع دعاوى كيدية مستمرة ضد كل من يعبر عن رأيه الرافض لكل هذه الإنتهاكات الواسعة والشنيعة ضد حقوق وحريات الإنسان.
ثالث عشر: هناك تردي صحي وانهيار اقتصادي شامل، وصعوبات في توفير الغذاء والماء النظيف والدواء، مع ارتفاع فاحش للأسعار، وانهيار للقطاع الصحي والتعليمي والعدلي بشكل عام.
من هنا فإنني أتقدم لكم بمذكرتي هذه لوقف إجراءات إعادة اللاجئين السودانيين في الدول الأوروبية إلى السودان لعدم استقرار الوضع الراهن؛ لا من ناحية حقوقية ولا إنسانية.

A note on the human rights situation in Sudan and decisions to repatriate Sudanese refugees from Europe
Since the popular revolution that overthrew former President al-Bashir, a civilian group has agreed with a group of officers of the armed forces, formed a dual government, and then the parties have written an agreement that is considered a constitution imposed on all Sudanese people, without inclusive negotiations to form a constitutional committee representing all the people.
After that:
First: There have been unlawful arrests of thousands of people, under allegations of ties between them and the previous regime. Although there are many who belong to the previous regime and who have relations with the previous regime, especially the big businessmen, they are partners or influential in the current system of government and they are protected.
Second: There are now thousands of detainees without investigations, without charges, and without fair trials.
Third: Thousands of private properties were confiscated without a court ruling.
Fourth: Tens of thousands of employees were dismissed from their jobs arbitrarily, without investigations and without a court ruling.
Fifth: Many newspapers were closed without investigation and without a court ruling.
Sixth: Refusal to accept the legal challenge of any person who does not belong to the current system in any government position.
Seventh: Large-scale "Communist Party" empowerment operations take place, whereby one individual is imitated by two or more jobs, with the inability to challenge these appointments legally.
Eighth: There are widespread corruption operations that are covered up, and no person can resort to the law to challenge them for the reasons that we will mention in Clause (Eleven).
Ninth: Job appointments are mostly made on a family, tribal, regional, or party basis. It does not take place through transparent and equal legal procedures before the law.
Tenth: There is a total disruption of the role of the public prosecution and the judiciary in controlling government actions.
Eleventh: Absolute immunities were granted to the current officials of the system, and this was reinforced by the following:
1-The constitutional court is suspended from monitoring government decisions. The Constitutional Court ignores the adjudication of appeals against any unlawful or unconstitutional governmental decision.
2-The politicization of the Public Prosecution, whereby the Public Prosecution refuses to take legal measures against any official or influential person who is related to the government.
3- Refusal to lift the immunity of any government officer, and therefore all legal oversight institutions refrain from considering any decision issued by that public employee.
Twelfth: Continuing malicious lawsuits are filed against everyone who expresses his opinion rejecting all these widespread and heinous violations against human rights and freedoms.
Thirteenth: There is a deterioration of health and a complete economic collapse, difficulties in providing food, clean water and medicine, with an obscene rise in prices, and a collapse of the health, education and justice sector in general.
From here, I present to you my memorandum to stop the procedures for returning Sudanese refugees in European countries to Sudan because of the instability of the status quo, neither in terms of human rights nor humanitarian terms.
