March 15, 2007 (KHARTOUM) — Two women, Amunah Abdallah (23) and Sa’diah Fadul (22) have been sentenced to death by stoning by the criminal court of Al-Azazi, Manajil province, Al-Jazirah Satte in east-central Sudan for committing adultery.
This confirms Faisal Al-Bagir human rights activist to the Juba Post yesterday, who just returned from the area.
The two women are both from the Tama tribe in Darfur. Al-Bagir said that human rights lawyers will submit an appeal against the judgment of the two ladies to the court of appeal in a few days time.
He stated that the women are now in Wad Medani prison and one of them has a two-year old girl with her in he prison, which is tragic.
He said that the two women are in bad conditions and are suffering psychologically due to the harsh judgment passed on them.

15 مارس 2007 (الخرطوم) امرأتان امونة عبدالله (23) وسعدية فضل (22) قد حكم عليهن بالرجم حتى الموت من قبل محكمة الجنايات جريدة ازازي ، مناقل - ولاية الجزيرة فى شرق ووسط السودان لارتكاب الزنا. هذا يؤكد السيد فيصل الباقر الناشط فى حقوق الانسان الى جوبابوست امس بعد عاد لتوه من المنطقة. المرأتين كلاهما من قبيلة تاما في دارفور. وقال الباقر ان المحامين المدافعين عن حقوق الانسان سوف يقدمون الاستئناف ضد الحكم الصادر عن سيدتان امام محكمة الاستئناف في غضون ايام. وذكر ان المراتان الآن في سجن واد مدنى واحدة منهن عندها طفلة عمرهاسنتين معها في السجن ، الذي هو أمر مأساوي. وقال ان امرأتين في ظروف سيئة وتعاني نفسيا بسبب قسوه الحكم الصادر عليهم. لا لقتل النساء والامهات فى الجرائم الجنسية.
امرأتان شابتان، غالب الظن انهما نازحتان وفقيرتان من دارفور..
على القضاء المختص الغاء هذا الحكم المعيب.
واذا كان لا بد من عقوبة بعد ثبوت التهمة، وتوفير الدفاع المقتدر، ان تكون عقوبة فى اتجاه الاصلاح لا القتل.

هذا حكم جائر
بربرى ومتعسف
القصد منه إزلال الضعفاء والمقهورين فى هذه البلاد
لا أحد يستحق عقوبة الرجم
فهذا عقوبة مارسهاالانسان قبل قرون لأنه لم يكن لديه وسائل عقابية مناسبة حينها
وبإختصار الاسلام أخذ هذه العقوبة من اليهود الذين كانوا يرجمون الزانى فى مجتمعاتهم
وحتى ممارسة الجنس برضا خارج أطر العلاقة الزوجية
فهو ليس جريمة أولا
ولا تستحق أى نوع من العقاب دعك من عقوبة مثل الرجم أو توبيخ
أو خلافه دول.
والسودان دولةالمتنقاضات حيث تغتصب النساء فى دارفور بشكل يومى تحت حماية ورعاية نفس الدولة السودانية التى تحاكم أيضامتهمات بالرجم فى ولاية الجزيرة لأنهم من نساء الهامش ومن دارفور بالتحديد
القانون يا سادتى فى السودان حتى لوطبق يطبق على الفقراء والمعدمين والمقهورين ولا
يطبق على من يسمى أنفسهم(بأولادالناس) او (بنات الناس).
هذا ظلم لا يوجد بعده ظلم يجب أن نقف فى وجهه جميعا كما فعل الناس ضد محاولة رجم أمراة فى نيجرياقبل سنوات يجب أن تتحرك كل المنظمات والناشطين فى كل المواقع لفضح قهر هذا النظام وتخلف قوانينه القمعيه

According to reports, the women had no lawyer during their trial, and were not able to defend themselves, as their first languages are those of their ethnic groups in Darfur. The court proceedings were conducted in Arabic, and the women were reportedly not provided with a translator. They have yet to lodge an appeal against their sentence.
Both women are married with children. They are currently in detention in Wad Madani women’s prison in Wad Madani, Gazira State. One of the women, Sadia Idriss Fadul, has one of her children with her in prison.
BACKGROUND INFORMATION
The Sudanese Penal Code, which is partly based on interpretation of Islamic Law, allows for penalties such as flogging, amputations and deaths by hanging or stoning. While Amnesty International does not take a position on Islamic or any other religious law, it considers such penalties to be cruel, inhuman and degrading punishments which are inconsistent with Sudan’s obligations under the International Covenant on Civil and Political Rights (ICCPR). Amnesty International opposes the death penalty unconditionally and under any circumstances.
The two women were charged under Article 146 (a) of Sudan’s 1991 Penal Code. Article 146 states that anyone having sex outside marriage shall be punished with execution by stoning when the offender is married (Muhsan); or one hundred lashes when the offender is not married (non-muhsan).
RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Arabic, English or your own language:
- expressing deep concern that Sadia Idriss Fadul and Amouna Abdallah Daldoum are at risk of being stoned to death;
- expressing concern at reports that this sentence was imposed after a trial at which the women had no legal representation and no translation of the legal proceedings into their languages;
- expressing concern that one of Sadia Idriss Fadul has one of her children with her in prison;
- noting that Amnesty International opposes the death penalty unconditionally in any circumstances;
- calling on the authorities not to carry out the death sentence imposed on Sadia Idriss Fadul and Amouna Abdallah Daldoum.

شكرا مصطفى شوقار
وتتواصل الجهود وتسليط الاضواء على قضيتهن.
المشكله ليس في مقاضتهن في جريمه ليست مثبته وفق قوانيهم الرجعية نفسها.
بل تجاوز كل حقوق الانسان فيها,فبينما يتجول الزنا في شوارع الخرطوم
ويزني رجال الجبهه الاسلاميه صباح ومساء,يفكرون في تنفيذ احكامهم الجائره على البسطاء
والغير قادرين على فهم حتى اجراءات المحكمه.
حيث تمت المحكمه بلغات لليست لغاتهم الام ولم يحرصوا على توفير مترجمين لهم!!!
انها عدالة اسلام الاسلامين الاقصائين, الانتقائين لمن ينفذ القانون عليهم ومن يحجب التنفيذ عنهم.

الزنا جريمة بشعة ولذلك عقابها بشع..
لا يوجد من هو ارحم على العباد من الله الرحمن الرحيم..
وهذه العقوبة لم تأتي اعتباطا..
فقط الغريب في الامر انه فقط هناك نساء اين الرجال الزناة
وكيف تم اثبات الجريمة..
مشكلة جمعيات حقوق الانسان تغفل جوانب مهمة جدا في القضية...
طبعا في النهاية هم من الغرب ولا يفهمون بشاعة هذه الجريمة في الاسلام..
الى ان نجد معلومات اوفى لا نستطيع ان نحكم على كيف تاتي ان يتهمن بالزنا..
وكيف ثبتت عليهم جريمة الزنا لان اثباتها في غاية الصعوبة..
ويجب للمسلم الا يتشفع في حدود الله..

Thank you Mustafa for alerting the board to this barbaric punishment that has nothing to do with contemporary religion.
It's regrettable to see some people still thinking that this sentence and other similar ones is religiously mandatory to follow. How sad that they miss the core of religion as a contemporary message? why they reject slavery and accept such barbaric punishment?
yes, i agree with you on the importance of mobilizing the whole Board to save the life of these prisoners.
I will be speaking with the coordinator of Amnesty Internation tomorrow. I will also bring the matter as part of the action plan suggested for the Granby High School students, which I will be speaking to in a Darfur event on Fri.
I suggest a coordinator to be voulnteer to this specific cxampaign and take care of the daily update.
We need to reach out to open minded islamists within the government and within the Turabi faction.
Saving the life of these women is a priority that goes beyond our political differences.

جريمة الزنا معروف حدها لمن يقرأ القرآن
الغاية في الإسلام العدالة وليس جلد الناس وتعزيبهم

كم زان محصن تم رجمه بامر الرسول
كم زانيه محصنه حامله بطفل سمح لها الرسول بوضع طفلها ثم رجمها ??

هل قراءت تفسيرات عقوبه الزنا لغير المحصن في سوره النوروانا اكرر مع العالم لا للدوله الدينيه والرجم في حد نفسه جريمه

Here is the punishment that is PRESCRIBED in the Quraan for ZINA(Adultery and Fornication):
"The woman and man guilty of Zina, flog each of them with a hundred stripes: Let not compassion move you in their case, in a matter PRESCRIBED by Allah, if you believe in Allah and the last day: and let a party of the Believers witness their punishment" (Quraan 24:2)
So let us now look at those hadeeth which say that the Prophet allegedly stoned adulterers. The questions need to be asked are as follows:
1. Was the Prophet COMMANDED to JUDGE by Allah’s Book?
The answer is YES.
2. Would the Prophet ever disobey Allah?
The answer is NO.
3. What is the punishment of Adultery in the Book of Allah?
The answer is 100 flogs.
4. Considering the ayaat 4:16, 4:25, and 33:30, could the punishment for ANY Fahish act be death?
The answer is NO.
5. Is stoning EVER implied in the Quraan?
The answer is NO.
What is the natural and logical conclusion from the above five. The answer is that the Prophet of Allah could NEVER disobey Allah and inflict a punishment, which could NOT be derived from the Quraan.
Thus the hadeeth of stoning are fabrications. !!!!
There is also strong evidence that someone later tried to include stoning in Islam. If we consider the following narrations, it would become clear that there was effort made to try and justify stoning by ascribing things to Umar as well:
Narrated Abu Huraira and Zaid bin Khalid:
'Umar Ibn al Khataab said" Allah sent Muhammad with the Truth and revealed the Holy Book, Quraan, to him, and among what Allah revealed, was the Ayah of the Rajam (the stoning of married person (male & female) who commits illegal sexual intercourse, and we did recite this Ayah and understood and memorized it."( Bukhari: Volume 8, Book 82, Number 815)
This and other narration quoted by those who call themselves Muslims are also fabrications because they have some implications which cannot be true.
The main implication of this is that The Quraan we have today is NOT COMPLETE because the “Ayah” of Rajam as SUPPOSIDLY mentioned by Umar above is NOT IN THE QURAAN WE HAVE.
This cannot be true because Allah has PROMISED to PROTECT the QURAAN.
However, some people insist on having stoning in the Law of Allah. They would go to ANY lengths to corrupt the PURE message of Allah. Not satisfied with the stories of stoning of humans in the books of hadith, they included monkeys in it also to show that somehow stoning is a “Natural” law:
Bukhari: Volume 5, Book 58, Number 188:
Narrated 'Amr bin Maimun:
“During the pre-lslamic period of ignorance I saw a she-monkey surrounded by a number of monkeys. They were all stoning it, because it had committed illegal sexual intercourse. I too, stoned it along with them.”
The questions that arise from this are:
1. Do Monkeys have Nikah?
2. What does it mean for a Monkey to commit “Zina” after being “married”?
3. How did Amr bin Maimun know that the she-monkey had committed Zina?
Is this not a desperate attempt to give stoning a Divine “Yes”?
But wait, there is more.
After creating the stories of the Prophet stoning people, and after creating stories about monkeys getting stoned, the people realized that the Book of Allah DOES NOT mention stoning.
So they TURNED to the famous “Theory of Abrogation”, and INVENTED false Quraanic “ayaat” about stoning, and made up stories that these “ayaat” were “abrogated” and taken out of the Quraan during the TIME OF UMAR, but the RULING of stoning is valid – what a twisted mentality.
Anyway, the proponents of stoning created the following hadith to “strengthen” the “evidence” that Allah WANTS stoning:
Imam Malik's Muwatta
Book 41 No. 10
Malik related to me that Yahya ibn Said heard Said ibn al-Musayyab say, "When Umar ibn al-Khattab came from Mina, he made his camel kneel at al-Abtah, and then he gathered a pile of small stones and cast his cloak over them and dropped to the ground. Then he raised his hands to the sky and said, 'O Allah! I have become old and my strength has weakened. My flock is scattered. Take me to You with nothing missed out and without having neglected anything.' Then he went to Madina and addressed the people. He said, 'People! Sunan have been laid down for you. Obligations have been placed upon you. You have been left with a clear way unless you lead people astray right and left.' He struck one of his hands on the other and then said, 'Take care lest you destroy the ayat of stoning so that one will say, "We do not find two hadds in the Book of Allah." The Messenger of Allah, may Allah bless him and grant him peace, stoned, so we have stoned. By He in Whose Hand my self is, had it not been that people would say that Umar ibn al-Khattab has added to the Book of Allah ta-ala, we would have written it, -The full-grown man and the full-grown woman, stone them absolutely." We have certainly recited that.'" Malik said, "Yahya ibn Said said Said ibn al-Musayyab said, 'Dhu'l-Hijja had not passed before Umar was murdered, may Allah have mercy on him.' " Yahya said that he had heard Malik say, "As for his words 'The full-grown man and the full-grown woman' he meant, 'The man and the woman who have been married, stone them absolutely.' "
Very interesting hadith. Beside the obvious contradiction with Allah’s Promise to Protect the Quraan, this hadith as explained by Malik ALSO creates an interesting image of Umar, the companion of the Prophet.
He was the Khalifah and a man of such a strong character, but he is presented as someone who is AFRAID of PEOPLE. He does not seem to be afraid of Allah for leaving His Book “incomplete”, but he is afraid what people might say.
For centuries proponents of stoning shoved down this hadith down people’s throats, until someone did more research into it and found out that the chain of narrators was not sound. What a shame.
It takes someone to look at the “chain of narrators” to classify this hadith as “weak” (note: they still don’t call it a fabrication) after many years. Do these people really believe in the Quraan?
However, many Muslims of today would rather trust some narration, compiled many many years after the Prophet rather than the Quraan.
The Quraan keeps on saying that the PRESCRIBED punishment for ZINA is 100 flogs, and that death could never be a punishment for any Fahish act, but the Muslims keep on harping that we have narration (200 after the Prophet) and thus the punishment for adultery is stoning.
If someone invites them to the Quraan to settle this dispute, they call him “misguided”, “shaitaan”, “kaffir”, etc. What to be said of these people, but the following:
"Hast thou not turned thy vision to those who have been given a portion of the Book? They are invited to the Book of Allah, to settle their dispute, but a party of them Turn back and decline." (Quraan 3:23)
Such are the Ayaat of Allah, which We rehearse to you in truth: then in what HADEETH will they believe besides Allah and His Ayaat? (Quraan 45:6).
