Convicted ####### offender has fled the country
A judge had denied a Montco prosecutor's request to revoke bail for Eltigani Mukhtar, who left for Sudan.

A ####### offender awaiting sentencing in Montgomery County has fled the country and has been located in one of the most unstable and dangerous nations in the world: his native country of Sudan.
Montgomery County officials said yesterday they hoped to force the return of Eltigani Mukhtar, 39, from the troubled African country to face prison time, but admitted it could be difficult. The United States has no extradition treaty with Sudan.
"Can we get him back? I don't know. Are we going to try? Yes," said Wendy Demchick-Alloy, the assistant district attorney who prosecuted Mukhtar.
Mukhtar, who Demchick-Alloy said had been living in the United States for about 10 years, was convicted by a Common Pleas Court judge in January, but failed to appear at his sentencing on April 14. He had been free on $25,000 bond, and his bondsman has since learned that he has returned to his Sudanese homeland.
He was found guilty of a Christmas Day, 2001, sexual assault on a retarded man living in a group home in Upper Moreland Township.
Mukhtar, trained as an obstetrician and gynecologist, was sent by a temp agency to the group home on the night of Christmas Eve. Detective Rick Kerrigan of the Upper Moreland police said Mukhtar was to remain on watch overnight while the home's staff slept.
About 6 a.m., Kerrigan said, the 40-year-old victim was in bed playing a video game when Mukhtar offered him a massage.
The victim said he did not want a massage, but Mukhtar climbed atop him and assaulted him. The victim told a staff member and police were called.
Judge Maurino Rossanese found Mukhtar guilty in January of institutional sexual assault, which carries a maximum term of 31/2 to seven years in prison. The evidence included Mukhtar's DNA.
Demchick-Alloy urged Rossanese to revoke Mukhtar's bail at that time and hold him for sentencing. But the judge noted that his passport had been seized, he had no prior record, and he had family ties in the Philadelphia area, and continued the $25,000 bond.
Demchick-Alloy said there were hints before the sentencing date that Mukhtar had fled. He missed several appointments with lawyers or court officials, she said.
Sudan, south of Egypt and bordering the Red Sea, is listed by the U.S. State Department as one of a handful of countries - including North Korea, Cuba and Iraq - that sponsor terrorism.
A civil war has been going on for at least 21 years, and last month U.N. Secretary General Kofi Annan warned that the situation was ripe for genocide.
An alleged coup against the country's military ruler and president, Omar Hassan Ahmed al-Bashir, led to arrests of opposition politicians a month ago.
Although the United States has diplomatic relations with Sudan, it has no mechanism to require the return of convicted criminals.
Mukhtar was in the United States on "refugee travel documents," Kerrigan said.
It was not clear how he was able to leave the country without his passport, but Demchick-Alloy said she had been afraid of that all along.
"I asked the judge to revoke bail because I was concerned that they guy was going to flee," she said. "The stakes were high."
