    May 25, 2004
    Advocate Ghazi Suleiman
Chairman of the Sudanese Human Rights Group

Subject: Report of a case of human rights violation

    .Dear Sir,
I’m willing to bring before your attention the following painful experience I went
through in the last few days. It goes like this:

On Friday 21/05/2004, I went to see my niece Fatima Eljaili A. Elsheikh who is a university student in her final year living in a furnished apartment which she was
renting with 3 other girls. She knew one of them ( Najlaa) because they were class
    mates.
She was recovering from an attack of pneumonia & after seeing her, I went to the near-
by pharmacy and brought her some medicines. I wanted her to accompany me home but
she preferred to wait for her mother there because she was already on her way from our village in the Gezira Province and my niece wanted the mother to be assured of her recovery and at the same time visit the place where her daughter was living in. It was one week since she had moved in the apartment.
Next day, 22/05/2004 at about 630 pm I received a call from the mother who told me I had to go to the Crimes Against the State Attorney where her daughter was detained since 11 o’clock in the morning. I hurriedly went to the police station in question, about a 200 meters east of Gurashi park. It was looking like an ordinary house in the area with not as much as a small sign board to differentiate it from the rest of them.
I met the mother who told me that at 10 o’clock am the apartment was raided by plain cloths policemen who walked in and started pulling away the sheets from the bodies of those girls still dressed in their sleeping gowns asking them their names. Finally, when they left they had in their custody two of the girls and the mobile telephones of my niece and that of her class mate. They were told they could go to the police station if they wanted their telephones back & described the whereabouts of the place to them. When they voluntarily went there, however, both of them were detained & an interrogation process started which went on till my arrival just after sunset. I met the investigating officer (Omer Mahjoub), told him I was Fatima’s uncle & that I had come to officiate her release under my responsibility in accordance with their conditioned promise to her mother. His answer was that I should go back & return to them around 11 o’clock next morning. I tried to reason with him telling him I was ready to sign an undertaking to bring her back but he wouldn’t agree. I reluctantly phoned a friend who was a high ranking police officer asking for his help though, due to the sensitivity & possible social implications of the case, my hope was to avoid any further involvements.

Anyway, one hour later my friend was with us. He went in & stayed there for sometime before coming out to tell me that they had more investigations to make after which my niece would accompany me home. At about 10 o’clock she & the other girl (Najlaa) were brought out & taken in a small truck to undergo what we were told, was a “medical examination”. Though the driver and all the guards in the truck were males, the mother was not allowed to accompany her daughter.
At 1145 that night the truck returned with the two girls and I was summoned in. A plain cloths policeman said he was happy to assure me of my niece’s innocence of any ill doings & of her “virginity” & intact hymen and told me it was her bad luck which made her keep company with that group of girls then he said that the whole issue was that one of the apartment residents (Nuha), who had claimed to me earlier that she was a pharmacist working at Maknimer pharmacy in Riyadh area, was reported missing by her family.
I signed and stamped with my thump a statement that included information about my residence address, working place and telephone numbers. By the time my niece was released it was already past midnight. She was told her cellular telephone was locked in a cupboard & the keys were taken by someone who had left earlier but that she could retrieve it next morning. Up to that time neither the mother nor her daughter could bring herself to eat anything.
The story didn’t finish there unfortunately. Next day 23/05/2004 at 1050 am the mother called me to tell me that her daughter was again taken into custody at the police station when she went there to get back her telephone. I called my police friend and drove directly to the station where one of the men in charge – you couldn’t tell the rank – said my niece would wait to be interrogated by the attorney Mohammed Farid Hassan. As this one wasn’t expected to arrive before 3 o’clock in the afternoon, I tried to convince them to allow me take her back home and bring her to them at the specified time. They wouldn’t listen and I had to go for some work leaving the mother waiting under the station’s neem tree in the hot summer weather for the second day running. There wasn’t even a shaded reception for the detainees’ families.
Shortly before I left the station, my niece was once again taken away in the small truck with the others. We were told that there were no medical forms when they had taken them the night before & the results of the medical tests conducted then were written in plain paper. To rewrite them in the proper forms, the officials in the Police Hospital might insist on the girls’ presence.
At 430 that afternoon, my niece was released. She had successfully passed the virginity assurance test & nothing whatsoever was found against her. Her mobile telephone was later on brought to us by my police friend. But an order for her father to present before the attorney on 25/05/2004 was issued & it indicated that his failure to show up on time would hold him responsible under article no. 94 of the Criminal Procedure.
I went there in his place in an attempt to save him the embarrassment & humiliation her mother and I were subjected to. They insisted the father must personally come and added that they would otherwise turn my niece to the Public Order court. I was given another arrange for Thursday 27/05/2004.
