Urgent Call for Humanitarian Action
Sayed Mubarak ElMahdi, Chairman and Sayed Abdeljalil El Basha, Secretary General of the Umma Party Movement for Reform and Renewal were arrested by the National Intelligence and Security Service (NISS) on Saturday July 14th.
Along with the Umma Party Chairman and Secretary General, Ali Mahmoud Hassenein (73), the Vice President of the Democratic Unionist Party and 19 retired army officers were arrested by the National Security Service which alleged that the detained were implicit in an alleged sabotage/coup attempt.
The case against all of the above mentioned detainees was transferred on August 6th , 2007 to the Ministry of Justice which appointed a Legal Committee to conduct all investigations and interrogations.
On Sunday 26th August, all 23 detainees, with the exception of Sayed Abdeljalil El Basha, were transferred (to police custody) from NISS custody, which involved their incommunicado detention, solitary confinement and restriction from legal representation. Since then, those detained have been allowed legal and family visitation during which it became clear that the authorities, as represented by the NISS and the appointed Legal Committee, have committed grave violations against the human rights of the detainees.
(1) Sayed Mubarak ElMahdi:
- The authorities withheld from him medical attention for 43 days despite repeated attempts to inform them that Sayed Mubarak was severely ill. His illnesses, being left unattended, eventually led to him suffering breathing difficulties. A gastro-endoscopy which was only facilitated after 43 days of his arrest, indicated that he was suffering severe infections to both the stomach and duodenum. According to medical opinion, recovery from these infections is expected to take a period of six weeks but poor conditions and/or neglect of the prescribed medication could lead to hemorrhage and even stomach cancer.
- He was blind-folded by NISS officials upon his arrest for a continuous period of 24 hours. His blind-folding was repeated several times during NISS interrogations and he has been subjected to insults and torment.
- He was again blind-folded whilst being transported from Kober Prison to the headquarters of the Legal Committee upon being summoned for interrogation.
(2) Sayed Abdeljalil El Basha:
- He was beaten and tortured continuously by NISS officials during the first three days of his arrest with the sole purpose of forcing him to implicate Sayed Mubarak in the alleged sabotage/coup plot. He refused to do so and has suffered the physical consequences which have involved his beating and burning.
- He has been offered financial reward by NISS officials in return for implicating Sayed Mubarak but again declined their offers.
- He was tortured by NISS officials attempting to force a false confession of his involvement in the alleged sabotage/coup attempt. After 10 days of torture which included burning and beating, which has led to him suffering a broken hand, he submitted to the torture and NISS officials dictated a false written confession which he was forced to sign.
- He has been withheld medical attention for his broken hand which he is unable to move freely.
- Despite the decision by the Legal Committee to transfer custody of those detained in the alleged sabotage/coup attempt to police authorities, Sayed Abdeljalil remains in solitary confinement under NISS custody.
- Sayed Abdeljalil has been threatened by NISS officials that should he attempt to deny his forced confession, when presented to the Legal Committee for interrogation, that he would be subjected to further torture by NISS. NISS officials have been present at all interrogations of Sayed Abdeljalil conducted by the Legal Committee.
(3) Ahmed Salman (Secretary of Sayed Abdeljalil El Basha):
- The family visitation of Friday 31st August was the first that we have learned of Ahmed Salman's arrest and detention.
- Ahmed Salman was tortured by NISS officials attempting to force a false confession of his and Sayed Mubarak's involvement in the alleged sabotage/coup attempt. He refused to do so and was subsequently beaten, burned and received physical harm to his testicles.
- Ahmed Salman was summoned to meet Salah Gosh, the Director General of NISS, who offered him $50,000 in exchange for falsely implicating Sayed Mubarak ElMahdi in the alleged sabotage/coup attempt. Ahmed Salman refused and Salah Gosh directed NISS officers to proceed with their torture 'techniques'.
- His testicles are severely swollen; he has difficulty walking, and is in severe physical pain. He is in need of urgent medical attention which he has thus far been denied.
(3) Retired Army Officers (Many are sickly and over 70 years of age)
- They have all been beaten and tortured by NISS officials who extracted false confessions from them.
- They informed the Legal Committee that their confessions were forced through torture and that these confessions were dictated and untrue. The Legal Committee would not allow them to change these confessions or report their statements.
- Have been blind-folded, threatened and insulted during the Legal Committee interrogations.
(4) All 22 transferred detainees (including Sayed Mubarak ElMahdi, Ali Mahmoud Hassenein and Ahmed Salman):
- Have been blind-folded during transport from Kober Prison to the Legal Committee Headquarters.
- Have been forced to sleep on the floor, withheld food under the specific orders of the Legal Committee, since their transfer to Police custody. All 23 have been provided with mattresses and food by the family of Sayed Mubarak ElMahdi.
- Have been withheld necessary medical attention (with the exception of Sayed Mubarak ElMahdi).
We feel that is imperative that this information is disclosed to the Human Rights and diplomatic networks. The detainees have suffered severe torture with their health and well-being having been compromised. We, together with the families of all the detainees, feel that should intervention not be forthcoming, that this blatant disregard of basic human rights will continue and only intensify leading to grave consequences to the status of those detained. We, therefore, call upon all those which have respect for human rights, freedom of speech and peaceful co-existence to take fast and concrete action to end these atrocities
