Human rights commissions in Africa 'are often a sham'
Watchdog says UN helps states use tribunals to deflect criticism

An international human rights watchdog has denounced the proliferation of state-backed human rights and truth commissions in Africa as a sham.
Human Rights Watch believes that many are simply being used to cover up abuses by some of the world's most oppressive regimes.
In a 400-page report released yesterday, the group also criticised western governments and the UN for funding, and thereby lending unwarranted legitimacy to, such commissions which it claims have have little interest in curbing human rights abuses.

"By 2000, Africa was host to the largest number of government human rights commissions of any continent. Yet its human rights record, by and large, stands in stark contrast with this fact," said Human Rights Watch.
"For the most part [the commissions] have proved to be a disappointment. Many have indeed been formed by governments with dismal human rights records, weak state institutions, and no history of autonomous state bodies. Some appear largely designed to deflect international criticism of some serious human rights abuses."
A decade ago, there was just one state human rights commission in Africa - in Togo. Now there are 20, in almost half the countries on the continent. Four more commissions are on the way.
The watchdog accuses some African states of "jumping on the human rights bandwagon" without any real interest in genuinely respecting them.
Human rights are in vogue now in much the same way as elections were fashionable a decade ago, a time when, under pressure from western aid donors at the end of the cold war, African states staged elections with little real commitment to establishing genuinely democratic governments.
Similar plans to placate western donors are often behind the establishment of rights commissions, it said.
Some commissions - notably in South Africa, Ghana and Uganda - have genuinely exposed abuses and challenged government practices.
South Africa's commission criticised official inaction over rampant and sometimes violent xenophobia, and police torture. In Uganda, commissioners have used judicial powers to force the authorities to account for abuses.
But elsewhere - from Liberia to Kenya, Sudan to Malawi - commissions are being used to dress up the country's image overseas and deflect criticism of the government's inability to liberalise, the group said.
"Millions of Africans are being displaced, tortured or killed. Yet the sad truth is that human rights commissioners in Africa often turn a blind eye to these abuses," said the report's author, Binaifer Nowrojee. "Many commissioners fail to publicly denounce abuses, either from fear of retribution or out of hope of government favour."
The report says that Sudan's human rights body was set up seven years ago amid some of the worst political repression in the country and did nothing to curb such abuses.
Algeria and Tunisia formed commissions simply to ward off international criticism of the state crackdowns on Islamic political groups, the report said.
"In the late 1990s, the postwar governments of Liberia and Sierra Leone created human rights commissions after flawed peace accords granted an amnesty to the fighters responsible for the killings and torture of thousands of civilians," the report said.
"The question which remains is: can these institutions that are set up by governments with less than pure motives be transformed into independent and effective human rights bodies?"
Official human rights commissions sometimes work with truth commissions; one laying bare past abuses while the other examines present day human rights breaches. The truth commissions have sometimes proved more successful, in part because the present governments are not responsible for past abuses.
Nigerians were exasperated and amused to see army generals who once ruled the country with a rod of iron, and plundered much of its wealth, weeping before the country's truth commission. That, and revelations about the extent of the brutality that the military sank to during its last years in power, have probably done as much as any human rights commission to curb abuses in the future by the army.
