UNITED NATIONS - After weeks of often bitter negotiations and, finally, major concessions to the United States, the UN Security Council approved a resolution to refer Sudanese war crimes suspects to the International Criminal Court.
The resolution marks the first time the Security Council has referred a case to the court, a move its supporters say will be a step toward legitimizing the body. But diplomats were also concerned that language worked into the resolution by the Bush administration would undermine the court.
As Secretary-General Kofi Annan looked on, the council voted 11-0 with four abstentions, from Algeria, Brazil, China, and the United States. The vote came at 10:30 p.m. EST Thursday night (0330 GMT Friday) after hours of delay.
The controversial concessions included ironclad guarantees that citizens of countries not party to the ICC working in Sudan would not be handed over to either the ICC or any other nation’s courts if they commit crimes in Sudan.
Even with the legal concessions, the US decision not to veto the resolution marked a major policy shift for Washington.Ever since he took office, President George W. Bush had actively opposed the court.
On Wednesday, Bush administration officials had said they would drop their objections to referring Sudanese suspects to the ICC if they secured legal exemptions for American citizens. While the United States didn’t get all that it wanted, the language went far enough.
Acting US Ambassador Anne Patterson said the United States was determined to get something done on Sudan but still objects to the ICC, and the so-called Rome Statute by which it was created.
“Although we abstained on this Security Council referral to the ICC, we have not dropped, and indeed continue to maintain, our long-standing and firm objections and concerns regarding the ICC,” Patterson said. “We believe the Rome Statute is flawed and does not have sufficient protections from the possibility of politicized prosecutions.”
France’s Ambassador Jean-Marc de la Sabliere acknowledged the Americans’ change in position, saying he understood “they had to make huge efforts to make this text pass.”
France, Britain and seven other Security Council members have ratified the ICC statute, while two more have signed and are expected to ratify. In total, 98 countries are parties to the treaty and 139 are signatories.
The resolution refers Darfur cases since July 1, 2002, to the ICC. That was the recommendation of a UN panel that had concluded in January that crimes against humanity _ but not genocide _ occurred in the vast western region of Sudan.
The document is the last of three Security Council resolutions aimed at putting pressure on Sudan to stop a crisis in Darfur, where the number of dead from a conflict between government-backed militias and rebels in Darfur is now estimated at 180,000.
One resolution strengthens the arms embargo and imposes an asset freeze and travel ban on those who defy peace efforts. The other will send 10,000 UN peacekeepers to monitor a peace deal between the government and southern rebels that ended a 21-year civil war. The council hopes the resolution will also help Darfur move toward peace.
A veto on the third resolution could have been politically damaging for the United States because it would have left the prosecution of war crimes suspects in limbo, something the United States could ill afford since it was Washington that had declared that genocide has occurred in Darfur.
The Bush administration had wanted an African court to try those accused of war crimes, but the US proposal had little support among the 14 other Security Council nations.
The US decision to allow the court to prosecute war crimes perpetrators could raise hackles among conservatives for whom the court is an unaccountable body that cannot be trusted.
They include John Bolton, the undersecretary of state for arms control and international security and President Bush’s nominee to become the next US ambassador to the United Nations.
“This resolution marks a turning point, for it is sending the message beyond Darfur to all of those criminals responsible for crimes against humanity and war crimes who all too often believed that they were beyond the pale of justice,” de la Sabliere said.
Human rights groups were jubilant
“It’s a historic step,” said Richard Dicker, director of the International Justice Program at New York-based Human Rigf foreign nationals suspected of committing a crime against their citizens. France, which had been out front in supporting the draft, had severe enough objections that it decided not to sponsor the document, leaving Britain to take it over.
Several diplomats said they objected because they feared paragraph six seriously weakened the criminal court.
“Operative paragraph six subsumes the independence of the ICC to the political and diplomatic vagaries of the Security Council,” Philippines UN Ambassador Laoro Baja said. “Nevertheless, this eventually may well be worth the sacrifice if impunity is ended in Darfur.”
Sudan’s Ambassador Elfatih Erwa noted his country’s deep opposition to the referral to the ICC.
“It is a tool to exercise the culture of superiority and impose the culture of superiority,” Erwa said, adding that the council “once again has ridden roughshod over the African position.”
