Sudan 25 Dec. 2018 : Use of ammunition and Excessive Force on Peaceful Protesters by Sudanese government and Militias
To: UN Independent Expert on the situation of human rights in the Sudan Amnesty International Human Rights Action Center UN Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression UN Special Rapporteur on the rights to freedom of peaceful assembly and of association UN Special Rapporteur on the situation of human rights defenders UN Human Rights Committee UN Working Group on Arbitrary Detention ---
Honorable Commissioners,
We, the undersigned, would like to draw your kind attention to the continuous atrocities and excessive use of force by Sudan government regular forces and militias upon cracking down on peaceful protests that have erupted in major Sudanese cities as of Wednesday, December 19,2018.
We urge your excellencies to call on the Government of Sudan to respect the people’s rights to freedom of assembly, association and expression as guaranteed in international laws and UN treaties ratified by Sudan and demand that the Government of the Sudan refrain from using militias, ammunition and excessive force to disperse protests.
The totalitarian Sudanese regime, brought about by a military coup in June 1989. The Sudanese Government and its militias, have habitually silenced the Sudanese people by use of live ammunition and deadly force.
The Government of Sudan continued to deny its citizens their basic rights to express their opinions about an unbearable political and economic situation including shortage of food, fuel, basic medications and the like. Recently, the government of Sudan has not paid the wages and salaries of its civilian employees.
To add insult to injury, the Government of Sudan took an unprecedented step to deny its people their right to withdraw funds from their own current bank accounts.
The citizens of many cities in Sudan have been peacefully demonstrating against such policies. Peaceful demonstrators continued to rally in Atbara, Port Sudan ,Barbar, Gaddarif, Khartoum, Elnuhud and many other cities.
Reports confirmed the gun-down of at least ten peaceful protesters in Khartoum, today December 25, 2018.
The record of the Government of Sudan in crushing lawful peaceful protests is atrocious. Various chilling videos circulating in social media show government militia individuals attempting to intimidate and promise killing of peaceful demonstrators.
Indeed, the bloody record of the Government of Sudan in crushing peaceful protests is despicable. In September 2013 alone, government forces used live ammunition to disperse peaceful protests, killing more than 200 protesters and detaining at least 800 protesters without charge. Many of those detained were subjected to ill-treatment in detention. There has been no accountability for the deaths, injuries and various other abuses perpetrated by Sudanese authorities against peaceful protesters.
The National Security Act (NSA) of 2010 bestows a host of immunities for members of Sudan Armed Forces granting them immunity from prosecution in civil courts irrespective of the crimes those units may commit . To that end, article 42(2) of the Armed Forces Act of 2007, article 45(1) of the Police Act of 2008, and article 46 of NISS [National Intelligence and Security Service] all guarantee that immunity.
We, the undersigned Individuals, urge your excellencies to reiterate to the Government of Sudan that all Sudanese have the right to freedom of expression, association, assembly, and freedom of the press.
We further urge your excellencies to demand that the Government of Sudan refrain from the use of militias, ammunition and excessive use of force against peaceful protestors.
