Title: ETHICS COMMITTEE REGULATIONS Policy No: OP 4110
1.0 POLICY STATEMENT:
1.1 This policy is formulated for all Hamad Medical Corporation (HMC) staff to define the
process of ethics committee regulations for addressing and resolving a patient care
issue that poses an ethical problem or dilemma for patients, patients’ families or health
care providers.
2.0 DEFINITION:
2.1 Ethics – Well based standards of right and wrong that govern the conduct of a
particular profession or group and prescribe what humans ought to do, usually in terms
of rights, obligations, benefits to society, fairness or specific virtues. It also refers to
the study and development of one’s ethical standards and includes the continuous
effort of studying own moral beliefs and moral conduct.
2.1.1 Ethics Committee - A consultative committee in a hospital or other institution
whose role is to analyze ethical dilemmas and to advise and educate health
care providers, patients, and families regarding difficult treatment decisions.
2.1.2 Ethical Dilemma – The ethical values, principles that are in conflict or
demand opposite results in the same situation. It is an ethical problem in
which the ethical choice involves ignoring a powerful non–ethical
consideration. There are important ethical problems which require ethical
decisions. More particularly such problems may arise in relation to such
recurrent issues in healthcare as:
2.1.2.1 Informed consent
2.1.2.2 Access to health care
2.1.2.3 Genetic screening and engineering
2.1.2.4 Foregoing or withdrawal of life sustaining treatment, advanced
directive
2.1.2.5 Participation in investigational studies or clinical trials
2.1.2.6 Physician–assisted suicide Equity in distribution of healthcare
resources.
2.1.2.7 Non adherence to code of conduct by HMC Medical Staff.
2.1.3 Case Review - The process where ethical conflicts and dilemmas are identified,
raised by the concerned party reviewed and analyzed.
3.0 RESPONSIBILITIES:
3.1 MANAGING DIRECTOR, ASSISTANT MANAGING DIRECTOR FOR OPERATIONS,
MEDICAL DIRECTOR AND EXECUTIVE DIRECTOR OF NURSING: Responsible for
approval and dissemination of this policy.
3.2 CHIEF OF STAFF, EXECUTIVE HOSPITAL DIRECTOR, CHAIRMEN, DIRECTORS
AND ######### OF DEPARTMENTS AND ASSISTANT EXECUTIVE DIRECTORS OF
NURSING: Responsible for dissemination and implementation of this policy and for
monitoring staff compliance.
3.3 ALL HMC STAFF: Responsible to comply with this policy.
4.0 POLICY:
4.1 The Ethics Committee regulations shall be followed by all HMC health care providers,
patients, and family who require consultation, resolution, and decision on ethical
issues and/or ethical dilemmas occurring within Hamad Medical Corporation facilities.
4.2 The Committee shall, in deciding on Ethico-legal issues, seek reference and be bound
by applicable rules of Qatari Medical Law, and the relevant rules of Islamic law and
ethics governing the specific situation or activity under consideration. If no rules of
Qatari Law shall be available or applicable to govern the situation, then the
internationally accepted principles of medical ethics and law shall be followed.
4.2 FUNCTIONS AND DUTIES:
The Ethics Committee shall be responsible to ensure the protection of the rights of
patients, families, patient care givers and others concerned persons. It shall function
as an independent body which provides public assurance of that protection. The
Ethics Committee shall be responsible for the following functions and duties:
4.2.1 Act as an independent decision-making body and source of recommendation
in resolving ethical issues and conflicts within Hamad Medical Corporation.
4.2.2 Act as a regulatory committee in HMC whose role shall be to analyze ethical
dilemmas and to guide and educate and advice health care providers,
patients, and others concerned regarding treatment decisions and ethical
issues and dilemmas.
4.2.3 Review and delineate hospital policies and guidelines concerning the
withholding of medical treatment and other ethical issues in the provision of
medical care.
4.2.4 Review, investigate and issue directions and guidelines on ethical issues
emerging in the course of providing medical care for individual patients.
4.2.5 Maintain written records with respect to the activities of the Committee,
including advice on options for medical care and treatment for an individual
patient.
4.2.6 To be involved in implementation of HMC code of conduct by the staff.
4.3 COMMITTEE FORMATION:
The Committee shall be formed by the Medical Director, which shall include but be
limited to:
4.3.1 The Chairman: The Medical Director shall be the Chairman of the Committee
ex officio. The Chairman shall be responsible for preparing the agenda,
inviting to meetings, chairing the meetings, and communicating the Committee
decisions and correspondence.
4.2.7 The Co-Chairman: The Co-chairman shall assist the Chairman and chair the
meetings in his/her absence and shall keep the Committee’s records and
references.
4.2.8 The Membership of the Committee shall include representation from the
Medical Staff, Legal Affairs, Nursing Staff and Quality Management. A
religious advisor and a social worker shall be invited to participate on Ad Hoc
basis. The Chairman of the Permanent Medical Licensing Committee,
National Health Authority, shall be invited for attending debate on issues of a
general nature, pertaining to their domains of responsibility.
5.0 PROCEDURE:
5.1 All health care providers, patients, and family upon admission should be informed of
the existence and purpose of the Ethics Committee. They should address ethical
issues and/or ethical dilemmas directly or through any of the members of the Ethics
Committee for consultation at any time. Existence and purposes of the Ethics
Committee and the availability to make decision on emerging ethical issues should be
in the form of Health care providers requesting consultation and direction from the
chairman of the Committee through the normal Chain of command, wherever such
issues emerge in the course of healthcare operations.
5.1.1 In the event that consultation and guidance on an Ethico-legal issue should be
needed urgently for healthcare purposes during working hours, thereafter, or
during weekends or holidays, HMC’s Corporate Counsel (Director, Legal
Affairs) should be contacted for assistance at his/her office telephone
extension (3903) or his mobile (5550345).
5.1.2 The Co-Chairman of the Committee should respond to urgent requests by
himself if clear guidance is available under relevant legal provisions, HMC
Policies and Procedures or established ethical principles. If no clear guidance
is available, then the Chairman should discuss the issue with the
Co-Chairman and members of the Committee who should be available on the
phone, and then provide expedited consultation and guidance to the
requestor.
5.2 Goals of Ethical Consultation should include:
5.2.1 Promoting respect for patient’s self-sufficiency and self–determination in the
context of medical decision-making.
5.2.2 Identifying potential ethical issues, controlling and providing consistency in
decision-making on such issues, and building consistency among them where
it is possibly required and appropriate.
5.2.3 Promoting awareness of ethical issues among health care professionals.
5.2.4 Examining existing law on medical practice and suggesting amendments
thereto or new legislation to provide legal coverage for ethical requirements
and eliminate inconsistencies.
5.2.5 Protecting and respecting the integrity of health professionals and the
corporation in the delivery of care, against legal and ethical liability.
5.3 Ethical Consultation:
5.3.1 Each request for consultation and/or additional information should be
documented.
5.3.2 The patient and/or patient’s family should be informed of the consultation if
significant clinical decisions are under consideration and their involvement
should be required.
5.3.3 The Chairman of the Ethics Committee should determine the format for the
consultation after obtaining basic information about the clinical situation, i.e.
consultation by the Chairperson alone, by sub group of the committee
members, or the committee.
5.3.4 All involved individuals who should provide relevant information should be
included in the discussions.
5.3.5 The discussions should be open, non–adversarial and it should be conducted
in an informal way to promote an atmosphere of trust and soften power
asymmetries.
5.3.6 The discussions should be made initially among the committee members, and
subsequently with medical personnel, with the patients and others concerned
as deemed necessary by the Committee.
5.3.7 The patient and others concerned should be reassured that the committee
should be impartial and independent, and that it should review the case and a
report should be submitted.
5.3.8 Educational and guidance materials should be provided to the requestors as
needed.
5.3.9 In any ethical situation, the member of the Ethical committee should be
expected to:
5.3.9.1 Continue to include the patient and others involved in the patient’s
plan of care.
5.3.9.2 Obtain information from the patient’s record.
5.3.9.3 Maintain confidentiality of information
5.3.9.4 Follow and try to respond to patient’s wishes, provided the wishes
should be legal, not to be inconsistent with the health care provider’s
ethical or legal principles, and should be in agreement with the
corporation’s policies and procedural guidelines
5.3.9.5 Identify the ethical problem, and the persons at conflict, and should try
to settle their interests without breaching any ethical or legal
principles.
5.3.10 Case Review:
5.3.10.1 The review should be conducted by the Ethics Committee team and
should be presided by the Chairman of the Ethics Committee.
5.3.10.2 Health care providers should be requested to provide relevant
information to the Ethics Committee concerning ethical issues, which
caused the case to be referred to the committee.
5.3.11 Ethical Decision Making: The following steps should be valuable to set a
workable ethical decision making framework:
5.3.11.1 Collection of database: Gather all relevant information. Identify and
involve all the persons concerned in the ethical dilemma.
5.3.11.2 Identify the ethical values or principles in conflict.
5.3.11.3 Differentiate the facts from values and policy issues.
5.3.11.4 Choose alternative courses of action that are vital to the decision
making process and identify the best course of action to be taken.
5.3.11.5 Communicate with caregivers about the decision and Implement the
action.
5.3.11.6 Evaluate and proceed to policy development/revision as required.
5.3.11.7 Decisions which should affect current medical and other healthcare
practices should be circulated to the medical departments and
concerned other departments for implementation and compliance.
5.3.12 Resolution:
5.3.12.1 After a series of case reviews, the Ethics Committee should be able to
come up with a recommendation for resolution based on the findings
in the case review and analysis. The outcome of the consultation
should include:
5.3.12.1.1 Clear statement of the ethical issue (s) presented
5.3.12.1.2 Brief statement of the recommendations
5.3.12.1.3 Justification of the recommendations with reference to
prevailing rules and legal requirements
5.3.12.2 The result/findings on the patient care issue and the recommendation
for resolution should be communicated to the individual who has
requested for consultation, whether the health care provider, patient,
or the family. The assigned Ethics Committee member should
document as recommended.
5.4 Committee Meeting
5.4.1 The Ethics Committee should meet quarterly and on an as needed basis as
called for by the Chairman.
5.4.2 Two thirds of the Committee membership should be a quorum for a valid
meeting.
5.4.3 The Committee decisions should be made by simple majority of the members
present. In the event of an equality of votes, the Chairman, or the cochairman,
in his/her absence should have a casting vote. All members should
cast a vote.
