Sudanese Authorities and the NEC React to Peaceful Elections Campaigns through Arrest and Circumscribing Civic Rights

(4 March 2010) Yesterday, 4 March 2010, police and security services in Khartoum broke up a peaceful election campaign at a bus stop in central Khartoum held by Girifna, a group currently conducting a massive voter education campaign across Sudan and colloquial Arabic for “we have had enough”. Three members of Girifna were arrested and were taken to Khartoum Shimal Police Station in Khartoum. They were charged with causing “public noisiness” under Article 77 of the Criminal Act of 1991. They are still in prison and have yet to be released.
The three members of Girifna arrested are:

That same afternoon, Sudanese opposition groups and various members of civil society organised a peaceful protest in front of the National Election Commission’s (NEC) headquarters to protest a circular distributed recently by the NEC to restrict political parties and individuals’ civil and participatory rights to hold public campaigns. The circular restricted any public campaigning, including parties campaigning on their own premises and headquarters. The NEC is purely an administrative body, and these regulations assume power that can only be implemented by the National Assembly. Though no arrests occurred in this forum, the swiftness with which Sudanese authorities responded in the Girifna arrests indicate that the atmosphere for peaceful protests and free speech is anything but open and transparent.
The arrests of Mr. Alsir, Mr. Badawi, and Mr. Omer are in violation and contravention of the 2005 Interim National Constitution and Bill of Rights, which guarantees the right to freedom of expression, assembly, and association under Article 39. These same rights are also in alignment with international standards under Article 19 of the International Covenant on Civil and Political Rights. The regulations spelled out in the circular distributed by the NEC severely circumscribes individuals’ and opposition political groups’ capacity to engage with the electoral process, and viably campaign as candidates, respectively. Indeed, on 3 March, Sudanese state radio in Omdurman blocked the leader of the Umma party and candidate for President AlSadiq Almahadi from airing his speech over a number of items, including a reference to the ICC and President Bashir. For the 20 minutes allocated for his speech, Almahadi was told that 19 points would have to be censored, or else not aired at all.
Participatory, political, and civic rights are critical to the holding of free and fair elections in April that will decide the leadership of the country on the parliamentary and presidential level, but yesterday’s events (and other incidents monitored by the Centre) illustrate that these ongoing violations are a pattern to silence dissident voices and limit access to information. The nature of crackdowns and the suppression undertaken by Sudanese authorities on peaceful efforts by civil society to conduct voter education and engage the public undermines free and fair elections. The responses undertaken by police forces and the NEC exemplify the extent to which the authorities are unwilling to tolerate any other voices on the road to democratic transformation.
