 بيان إدانة وإستنكار : المجلس العسكري يتلكأ في إتخاذ قرار إطلاق سراح الأسرى وإلغاء أحكام الإعدام

*في بادرة غريبة علي السودانيين طلب المجلس العسكري من الاستاذ ياسر عرمان مغادرة بلاده* .
نحن في أمانة الشؤون القانونية وحقوق الإنسان بنداء السودان نستنكر وندين هذا الطلب الغريب ونحذر المجلس العسكرى من إتخاذ اى إجراءات تحد وتعيق من حركة الاستاذ عرمان فهذا التصرف سيكون مخالفاً لنص المادة ١٣ الفقرة ٢ من الإعلان العالمي لحقوق الإنسان ( يحق لكل فرد ان يغادر أية بلد بما في ذلك بلده كما يحق له العودة إليه) وكذلك مخالف لنص الحقوق الوارد في العهد الدولي الخاص بالحقوق المدنية والسياسية ولقد قمنا بمخاطبة الخبير المستقل المعني بحالة حقوق الانسان بالسودان وطلبنا منه إدانة هذا الطلب والتدخل العاجل لوقف اى إجراءات من شأنها تنتهك حق الاستاذ عرمان في العيش بحريه و بسلام في بلاده .
كان حرياً بالمجلس العسكرى ان يحتفي بعودة الاستاذ عرمان وان يشجع زملائه الآخرين للعودة الي ربوع الوطن لان ذلك من شأنه الدفع بعملية وقف الحرب وتحقيق السلام لكن يبدو ان تحقيق السلام ليس من أولويات المجلس العسكرى الإنتقالي بدليل انه لم يلغى الأحكام الصادرة بحق بعض من قادة المعارضة وهي أحكام سياسية لم تصدر من محكمة تتوفر فيها ادنى شروط المحاكمة العادلة .
وكذلك لم يقم بإطلاق سراح الأسرى والمحكومين الذين يتناقص عددهم يوميا بسبب الإهمال والمرض والإحتجاز في أماكن لا تتوفر فيها ادني متطلبات الكرامة الإنسانية .
علية نوجه رسالة واضحة للمجلس العسكرى الإنتقالي ونطلب منه ان يصدر قرارا فوريا بإطلاق سراح الأسرى والمحكومين وإلغاء أحكام الإعدام بحق رئيس ونائب رئيس الحركة الشعبية لان هذا القرار يشكل مدخلاً ضرورياً لبدء عملية سلام ذات مصداقية تنهي الحرب وتحقق الإستقرار

LETTER FROM MR OSAMA SAID, SUDAN CALL ALLIANCE, TO MR ARISTIDE NONONSI, THE INDEPENDENT EXPERT ON THE SITUATION OF HUMAN RGHTS IN SUDAN, 29 MAY 2019
SUBJECT: TRANSITIONAL MILITARY COUNCIL THREATENS YASIR ARMAN
Dear Mr Nononsi
I would like to draw your attention to a worrying development in Sudan concerning Mr Yasir Arman, the Deputy Chairman of the SPLM/N led by Malik Agar and the External Affairs Secretary of the Sudan Call Alliance. Yasir and a delegation from the Sudan Call Alliance had the honour to meet you in Geneva last September.
As you may know, Yasir returned to Khartoum in the early hours of Sunday 26 May at the head of a delegation from the SPLM/N-Agar. He was given a very warm reception by the protestors in the sit-in area and has been having meetings with a range of political parties and the diplomatic corps, emphasising the need for peace to be high on the agenda of the transitional government if democratic transformation is to be sustainable.
However, in the last twenty-four hours, Yasir has received a series of messages from Lt Generals Burhan and Himiti, the top leadership of the Transitional Military Council, threatening to detain him if he does not leave the country immediately. In a statement issued today, Yasir said he has refused to leave, stressing that he has the right to stay in Sudan and to advocate for a comprehensive peace settlement, democracy and equal citizenship. He has also emphasised that he has the right to be part of the political process as SPLM/N-Agar and the Sudan Call Alliance are members of the Freedom and Change Alliance. If the Transitional Military Council try to deny those rights, it suggests that they want to establish a new dictatorship in Sudan.
Before his return to Khartoum, the Transitional Military Council are reported to have declined to cancel the death sentences issued against Yasir and Malik Agar by a Sudanese court in 2014 for taking part in a rebellion in the Two Areas. But Yasir made clear that he was determined to return to Sudan after the fall of Bashir. In his statement today, Yasir pointed out that “the Transitional Military Council has indicated that they are not authorised to turn Bashir over to the Hague and, if that is the case, they are also not authorised to implement political arrest warrants issued by Bashir for the SPLM/N”.
In the light of the above, the Sudan Call Alliance would be grateful if you could issue a statement in your capacity as the UN Independent Expert calling on the Transitional Military Council to respect Yasir Arman’s right to remain in Sudan for the reasons set out above.
