In Sayed Mubarak's prison daily log he says that he was asked by Retired Army General Mohamed Ali Hamid to provide funding for the forming of a POLITICAL PARTY and not an armed rebellion. This is what he refused funding and the reason he refused this funding is that his party's financial situation did not allow for such a donation. He also clearly mentions that at no time did Mohamed Ali Hamid mention the overthrow of the present regime through force or any other means. This account is supported by the statements of both General Mohamed Ali Hamid and Abdeljalil ELBasha (1) In their individual interogations by National Security (2) In their individual and combined interogations by the Prosecuter and (3) in their daily accounts.
Further it is true that Sayed Mubarak was released on the orders of the President but there was no deal involved in doing so. We all know that he and all the other detainees are innocent as do the authorities. The two individuals mentioned, in this post and indeed by Sayed Mubarak in his interview with alahdath daily, are Dr. Ghazi Salaheldin and Dr. Mustafa Ismail. It is true that they have been advocating within their own party for the release of Sayed Mubarak but also for the release of the other detainees. There was an internal report on the case submitted by the (In)Justice Minister to the President a few months ago and in this report the (In)Justice Minister outlines to his President that there is no evidence what so ever against the detainees including Sayed Mubarak. Mustafa and Ghazi tried to use this report to plea for the detainees release but this had previously been rejected by the President (because the arrest has always been a political one rather than legal). It appears that following certain political developments including the arrest of the British school teacher, the President had a change of heart. While the decision comes from the President it is by no means an 'agreement', they have known all along that the man is innocent but because of their many embarrasements they have decided to release him and try to gain political breathing space. Dr. Mustafa simply came to see Sayed Mubarak to inform him of this change of heart and Sayed Mubarak demanded the release of all the detainees but Dr. Mustafa informed him that the President has refused to this.
Sayed Mubarak informed the reamining detainees of this meeting in full and they were in agreement that he should leave his detention and fight for their release from the outside. This is a political case and the solution is not going to be legal, simply there is no legality to this entire case.
We are all concerned for the remaining detainees but it is actually in their best interests that Sayed Mubarak has been freed. The case has been labelled 'Mubarak ElFadil and others'. So now that the main suspect has been freed on the basis that their is no or weak evidence against him, how can any evidence hold against the others (if they are supposedly his subsidaries). What will the case be named now, 'the others'? .
Had Sayed Mubarak chosen to remain in his detention sure he would have been in physical solidarity with the other detainees but does this help any of their interests? How much longer would they have been detained? The release of the main suspect entails the collapse of this case and the release of all of the detainees.
The authorities were obviously too embarrased to release all of the detainees at once but they have embarrased themselves plenty by releasing the man they based their case around. Releasing the main suspect was the biggest hurdle and greatest source of embarrasement for them and now that they have done this the case will unravel.
As for an appeal, no such appeal has been issued by Sayed Mubarak or his lawyer to the Minister of (In)Justice. The man was on a hunger strike that he would not lift unless the case was brought to court or release was facilitated. An appeal by Sayed Mubarak or any of the other detainees would have given the authorities the perfect carrot to extend their detention on the grounds that the appeal was being 'assessed'. The (In)Justice Minister who is the ultimate opportunist and has done all in his power to follow and rather go the extra mile on his leaders orders to detain and degrade Sayed Mubarak and the other detainees was now ordered to release them- a huge source of embarrasement for him following his actions over the last 5 months. He therefore forged that an appeal had been lodged and that he was simply responding to this appeal. The alleged appeal is his scapegoat.
It is only a small matter of time before the other detainees are released and we are united in solidarity with them and in securing their release.
Our prayers are with Ali Mahmoud Hassanein, Abdeljalil ElBasha, Hassan Haj Musa, Mohamed Ali Hamid and all political detainees.
