Terms and conditions
SMSPays is fully committed to protecting the privacy of our members. Unlike other advertising services, we do not allow third parties access to any member personal details. SMSPays preserves the anonymity of its members at all times, and never discloses identifying details to any of its affiliates, business partners or advertisers. All of SMSPays's targeted marketing is based on an 'opt-in' basis where members have full control over the type of offers they choose to receive. Members can choose to 'opt-out' at any time.
You agree that SMSPays may use your personal information in order to enable the smooth operation of the network. SMSPays may access your account, including its contents, as stated above or to respond to service or technical issues. Non-identifying information of all of SMSPays's Members may be analysed, distributed, sold, or given to any entity at SMSPays's sole discretion. Identfying components of your personal information will not be sold, traded or licensed by SMSPays to third parties. For instance, we may let advertisers know that 60% of our users are between the ages of 16 and 40 without disclosing the personal information of any one individual. You agree to SMSPays storing and using any other information that it learns about you or that is supplied by you in your Member Account and Special Interest.
When we give information to the advertisers, agencies or other companies that participate in the Service, it is in the form of grouped statistics based on members' information while participating in the Service. The Service is designed to make it impossible for outside companies to extract personal information without your consent.
When you register voluntarily on our web site at www.smspays.com for our membership, we collect personal information from you including names, addresses, email addresses, demographic information and other personal information. This information is secured by using advanced technology in data security to prevent data loss or unauthorized access or use of personal data. We are committed to continually staying at the forefront of data security.
When you register , you will receive a user-specific account number and password. With this username and password, you can at any time review and modify your profile online. We store your password in an encrypted form.
The personal information you provide is used to customise the advertisments to your needs. For example, if you select audio/visual and health as interests, only advertisers with promotions relevant to these interests will be interested in sending you any information on their offering or events.
Advertising partners will be able to plan marketing campaigns using aggregate profile data. For example, they could choose to send a promotion to all users of the Service living in Singapore, interested in music and arts. However, they will not be able to access any individual profile data.
We may do research and provide reports on our users' demographics, interests and behaviour based on the information provided to us upon registration, during a promotion or from surveys. This research and reports only relates to groups in general and will never identify you individually. We may share these general statistics with advertisers or partners to enable them to better provide advertisements or offers to members in their areas of interest.
We do not sell or rent your information to anyone. Your personal information will not be released to any third party without your express permission except in special circumstances such as when the law requires it or under the circumstances described below.
Members opt-in to receive advertisements and promotions at registration. You may de-activate your account at any time by loggin in and clicking on the de-activate button/link in the members page.
Members can update their own personal account and profile information at any time by updating their personal profile in the Profile section on the members pages.
SPAM POLICY
You may not promote your referral links through unsolicited emailing (i.e. spamming), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with SMSPays and may result in legal prosecution. SMSPays strictly enforces anti-spamming laws. Any member caught spamming will not only have their account terminated immediately and lose any past, present and future earnings, but shall also be held liable for spamming as we shall cooperate with any authorities and investigations that may arise from the spamming.
TERMS OF USE
1. ACCEPTANCE OF TERMS
SMSPays is provided for persons over 16 years of age
BY COMPLETING THE REGISTRATION PROCESS AND CLICKING ON THE 'REGISTER' BUTTON ON THE REGISTRATION PAGE, YOU ARE INDICATING YOUR AGREEMENT TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF SMSPays.
2. MEMBER ACCOUNT SECURITY AND CONDUCT
You must ensure that your password and account details are kept confidential. You are entirely responsible for any use of the website or any other acts that occur under or in relation to your password or account as a result of your failure to keep your password and account details secret. You agree to immediately notify SMSPays of any disclosure or unauthorised use of your password or account or any other breach of security. You agree not to disclose to any other person, corporation, entity or organisation any identification or log-in information, whether in use or not, nor any other confidential information relating to the website or SMSPays.
You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your account or password. SMSPays reserves the right at all times to monitor, review, retain and/or disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.
3. MEMBER OBLIGATIONS
There is no obligation on you to accept any of the offers sent via SMS. In consideration of your use of the website, you agree : a) that all information provided is true, accurate, current and complete; b) all information provided in relation to questions asked relates to you; c)to maintain and promptly update this information to keep it true, accurate, current and complete. In particular : -to register you must provide your correct email address; -to be paid to receive SMS messages, a current mobile phone number must be provided. d) If SMSPays has reasonble grounds to suspect that your introduction is falsified, we will reserve the right to terminate your account and and all current or future use website (or any portion thereof) and commissions resulting from the introduction of members. If SMSPays has reasonable grounds to suspect or any of the information is untrue, inaccurate, not current or incomplete, SMSPays has the right to suspend or terminate your account and refuse any and all current or future use website (or any portion thereof) and commissions resulting from the introduction of members.
You agree to refrain from the bulk transmission of messages to unsuitable members or newsgroups. You also agree to refrain from the bulk transmission of unsolicited electronic mail.
4. MODIFICATIONS
SMSPays reserves the right to modify the program, the compensation plan and the services it provides with or without notice. SMSPays shall not be liable to you or any third party should SMSPays exercise its right to make modifications. You agree that you will be responsible for regularly reviewing these Terms of Use. You will be bound by the Terms of Use as they appear on the Site from time to time, including any amendments. It is not the intention of SMSPays to reduce the compensation plan under which members join the program.
5. TERMINATION
You agree that SMSPays, in its sole discretion, may terminate your password, account (or any part thereof) or use of the website, and remove and discard any content within the website, for any reason, including, without limitation, for lack of use or if SMSPays believes that you have violated or acted inconsistently with the letter or spirit of good internet ethics. You agree that any termination of your access to the program under any provision of this agreement may be effected without prior notice, and acknowledge and agree that SMSPays may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the website. SMSPays reserves the right to retain aggregated information should your account be terminated. Identifying information shall not be disclosed even after termination of this agreement. SMSPays may also in its sole discretion and at any time discontinue providing of the website, or any part thereof, without notice. Further, you agree that SMSPays shall not be liable to you or any third-party for any termination of your access to the website and program or for any discontinuance in providing the service.
Signing up on behalf of a friend to receive SMS's on the their mobile phone without consent constitutes fraud.
You may terminate your membership of the program at any time by sending an e-mail to [email protected] or by notifying SMSPays as provided on the SMSPays site.
A member who keeps their account in 'deactivated' mode for 30 days in a row will be cause for termination and will loose his organization and all claims to any commission outstanding from his and his organization. He will cease to be a member and his organization will be attached to his introducer.
6. INDEMNIFICATION
You indemnify SMSPays, its holding company, subsidiaries, affiliates, consultants, officers and employees, harmless from and against all actions, claims, suits, demands, damages, liabilities, costs or expenses, including reasonable legal fees, arising out of or in any way connected to the use or membership of the program by you or someone using your username and password.
