اخي جلال ناصر لقد كتب الكثير عن السرقات الصحفية واليكم هذا الرأي عن بعض الفقها الانجليز حول الموضوع : The owners of copyright enjoy exclusive rights to their works. No one is permitted to do any of the following without their permission, unless covered by an appropriate license. To copy the work To issue copies of the work to the public To perform, show or play the work in public To communicate the work to the public by electronic means To adapt the work To make the work available Anyone doing any of the above, whether intentionally or not, without the permission or license of the copyright owner is infringing copyright. Infringement can occur only if the whole or a substantial part is involved. Substantial is undefined, although case law suggests that content in many cases is as significant as extent.
"Copying" means producing the work in any material form, including storing the works in an electronic format. It also includes direct copying (e.g copying record to tape) and indirect copying (e.g copying an off-air recording). Back to top Copyright licenses The University has a number of special licenses which permit copying above the limits normally allowed under the CDPA 1988, or which licemse the copying of certain catalogues of material The Copyright Licensing Agency (CLA) License. The University has a CLA license which permits multiple photocopying by or on behalf of students and staff in addition to the copying permitted under the Act. The material copied must not be oon the CLA's listof excluded works and must be for registered staff or students. There are also limits on the amount that may be copied for one module.
Many categories of works are excluded from this license, including maps, music, newspapers and videos. Digitisation is also excluded from this license
The Design and Artists Copyright Society (DACS) License. the DACS license permits the copying of slides from artistic works held in the University libraries. It permits the production of up to 10 copies (in slide form) of any one artistic work. A slide is defined as a 35mm transparency or overhead projection slide. The Educational Recoring Agency (ERA) License. Under the ERA license, members of the University are permitted to record any broadcast television programme from it's list of members for non-commercial education purposes and also to make copies of those programmes for educational purposes. Recording does not have to be done on the premises - you may record aprogramme at home and then make arrangements with ICT Services to have a copy made for use on University premises.
Higher Education Digitisation Scheme. The University has signed the CLA digitisation agreement under which the institution can obtain permission, for a fee, to digitise and to make available to staff and students, copyright material. For the time being, until the copyright situation with illustrators groups is resolved, the license only applies to the literary material in publications and not to any artistic works (photographs, maps, diagrams, figures or graphs). Material digitised under this scheme must not be made available to people other than staff and students of the University. These people, as well as distance learners, can however, access these materials through a secure system e.g. Blackboard. Please refer to Copyright factsheet 2: Copyright, digitisation and blackboard for further information.
The Newspaper Licensing Association (NLA) License. The NLA license allows for the multiple copying of articles in some newspapers. There is no restriction on the number of articles within a single issue that may be copied, but the number of copies of each article is limited to 250.
