An academic opinion. I am making a presumption here that this person is an adult now
I am away from office at this time BUT I remember vividly that the Sudanese Nationality Act (the old and new one) gives child of an unknown father born in the Sudan the Sudanese nationality. Nationality in that law follows the father (despite the new constitution that allows a mother to give her nationality to her child). Since he is of an unknown father he gets it automatically once birth in the Sudan is proven. It may have been difficult for him to prove that he was born in the Sudan, or it is just how things in the Sudan are done.
Furthermore the international law protects stateless people. If Germany is a member of the Convention relating to the Status of Stateless Persons (Entry into force: 6 June 1960). He should benefit form Article 28 which states that". -
Travel documents
The Contracting States shall issue to stateless persons lawfully staying in their territory travel documents for the purpose of travel outside their territory, unless compelling reasons of national security or public order otherwise require, and the provisions of the schedule to this Convention shall apply with respect to such documents. The Contracting States may issue such a travel document to any other stateless person in their territory; they shall in particular give sympathetic consideration to the issue of such a travel document to stateless persons in their territory who are unable to obtain a travel document from the country of their lawful residence.
In the end it is that lawyer who knows the merits of that case and chooses which law to follow.stateless people who are from the Sudan deserve the "sympathetic consideration refered to above.
