AMSTERDAM (Reuters) - The International Criminal Court prosecutor has accused the Sudanese government of protecting suspects wanted for war crimes in Darfur instead of helping to bring them to face justice.
In a document seen by Reuters on Thursday, the prosecutor asked ICC judges to issue a finding of non-cooperation against the government in Khartoum for failing to execute arrest warrants for Ahmad Harun and Ali Kushayb, both of whom are wanted for war crimes and crimes against humanity.
It is the first time the ICC prosecutor has requested a finding of non-compliance and a pre-trila chamber will examine the request.
"The government of Sudan continues to commit crimes, promotes and protects the persons sought by the court and harasses all persons who are considered to be in favour of justice," the prosecution said in its filing.
"No measure to arrest Ahmad Harun or Ali Kushayb, against whom arrest warrants were issued in 2007, has been taken."
Harun, Minister of State for Humanitarian Affairs, is charged with 42 counts of crimes against humanity and war crimes. Kushayb faces 50 counts of crimes against humanity and war crimes. They have not yet been surrendered to the court.
The ICC investigation into the situation in Darfur was opened in June 2005, following referral to the court by the U.N. Security Council.
Sudan has a binding legal obligation to fully cooperate with the court, the prosecutor said.
An arrest warrant was also issued against Sudanese President Omar Hassan al-Bashir in March 2009 for war crimes in Darfur. In February, the court also opened up the possibility he could be charged with genocide.
Bashir has repeatedly denied the allegations, branding them as part of a Western conspiracy and his government has refused to co-operate with the court.
The ICC has no police force and depends on national authorities and states that have signed up to the court to make arrests.
