"Ji Xiang San Bao" singers and film "Le Papillon", photo: sina.com.cn Some media outlets yesterday have reported the film's director Philippe Muyl has learned of the suspected plagiarism and has now filed suit against the Mongolian song's composer in a local French court. The composer and singer of the song in dispute, Bu Ren Ba Ya Er has expressed doubt about the report's authenticity and told the Star Daily yesterday that he finished his song in 1994, but the film "Le Papillon" first screened in 2002. He also says he feels the two songs are a far cry from identical. To answer the plagiarism change, the Mongolian singer has further revealed that the song was originally written for his 3-year-old daughter's birthday back in 1994. Their family had also recorded a dance version when the daughter was five, with the song finally coming out in an album released in 1998. Bu Ren says he attended a folk festival in France in 1998 where he sold some cassettes and gave some out to his friends. He thinks that there is possibility that French musicians heard his song first. Celebrated Chinese music critic Jin Zhaojun has compared the two songs in dispute. Jin says except for the one-to-one singing style, the two songs are totally different. He further explains that in order to determine whether two songs are identical or not, more aspects such as the melody, structure and harmony should be considered. A lawyer from Music Copyright Society of China, Yu Xin, says, "Having compared the two songs from lyrics, melody, tempo and structure, the two songs are only similar in structure, which is not considered plagiarism. It may be regarded as a use for reference which is quite common and acceptable." The lawyer also explains that it’s commonly thought if a song is similar in eight or more segments it is regarded as a copy. "Ji Xiang San Bao" is a Mongolian song sung by a couple and their little girl.
