في 27 فبراير 2007 الدائرة التمهيدية تستلم وثائق تتضمن لائحة الأدلة المتعلقة بحالة دارفور الحالة: دارفور تسلّمت الدائرة التمهيدية، يوم 27 فبراير 2007 ، طلب مكتب المدعي العام المتضمن لائحة الأدلة التعلقة بالجرائم في دارفور، والذي يطلب فيه إصدار أمر بالحضور بحق السيد أحمد محمد هارون، وزير الدولة السابق بوزارة داخلية الحكومة السودانية، والسيد علي محمد علي عبدالرحمن، المعتبر بحسب الطلب المقدم أنه قائد ميليشيا والمعروف أيضاً باسم علي آوشيب. ستصدر الدائرة التمهيدية قرارها ضمن المهل المحددة.

لاهاي، في 26 فبراير 2007 ICC-20072702-Ar أسئلة وأجوبة تتعلق بأوامر الحضور آيف يمكن للمحكمة أن تضمن حضور شخص مدعو للحضور؟ بدلاً من طلب إصدار أمر قبض، يجوز للمدعي العام أن يقدم طلباً يلتمس فيه من الدائرة التمهيدية إصدار أمر بحضور الشخص أمام المحكمة. إذا اقتنعت الدائرة التمهيدية بأن هناك أسباباً معقولة للاعتقاد بأن الشخص قد ارتكب الجريمة المدعى بها وأن إصدار أمر بحضور الشخص يكفي لضمان مثوله أمام المحكمة، فإنها تصدر أمر الحضور هذا مع شروط الحد من حرية الشخص أو دون مثل هذه الشروط (بخلاف الاحتجاز) في حال ينص عليها القانون القومي، آي يمثل الشخص أمام المحكمة. ماذا يجب أن يتضمن طلب الحضور؟ يجب أن يتضمن طلب الحضور ما يلي: − اسم الشخص وأي معلومات تعريفية أخرى ذات صلة؛ − تاريخ الحضور أمام المحكمة؛ − وصف محدد للجرائم التي تندرج ضمن اختصاص المحكمة والتي يُعتقد بأن الشخص قد ارتكبها؛ - بيان الوقائع التي يُدّعى بأنها تشكل الجريمة. ما هي الشروط التي يجوز أن تفرضها الدائرة التمهيدية للحد من حرية الأفراد المطلوب حضورهم؟ يجوز للدائرة التمهيدية أن تضمّن قرارها شرطاً أو عدة شروط للحد من الحرية بطريقة تتماشى مع القوانين الوطنية للبلد المعني، ومن هذه الشروط ما يلي: (أ) لا يجوز للشخص أن يسافر إلى ما وراء الحدود الإقليمية التي تحددها الدائرة التمهيدية إلا بإذن صريح من هذه الدائرة؛ (ب) يجب ألا يذهب الشخص إلى بعض الأماآن التي تحددها الدائرة التمهيدية أو الاتصال ببعض الأشخاص الذين تحددهم هذه الدائرة؛ (ج) لا يجوز للشخص الاتصال بالمجني عليهم أو الشهود بطريقة مباشرة أو غير مباشرة؛ (د) لا يجوز للشخص ممارسة بعض الأنشطة المهنية المحددة؛ (ه) يجب على الشخص أن يسكن في عنوان معين وفقاً لما تحدده الدائرة التمهيدية؛ (و) يجب أن يلبي الشخص دعوة الحضور التي توجهها إليه سلطة أو شخص تعيّنه الدائرة التمهيدية؛ (ز) على الشخص أن يودع سند آفالة أو أن يقدم ضمانة عقارية أو شخصية تحدد الدائرة التمهيدية مبلغها والجدول الزمني لتسديدها ووسيلة دفعها؛ (ح) على الشخص أن يقدم إلى المسجل جميع وثائق إثبات الهوية، ولا سيما جواز سفره. هل يجوز للدائرة التمهيدية تعديل الشروط المفروضة؟ 2 / 2 بناء على طلب الشخص المعني أو بناء على مبادرة ذاتية من المدعي العام، يجوز للدائرة التمهيدية أن تقرر في أي وقت تعديل الشروط الموضوعة سابقاً. ولكن، قبل تعديل أي شروط رامية إلى تقييد الحرية، تلتمس الدائرة التمهيدية آراء المدعي العام والشخص المعني وأي دولة معنية أو أشخاص مجني عليهم اتصلوا بالمحكمة في إطار هذه القضية وترى الدائرة أنهم قد يتعرضون للخطر من جراء الإفراج عن الشخص أو نتيجةً للشروط المفروضة عليه. ماذا يحدث إذا لم يتقيد الشخص المطلوب حضوره بالشروط التي وضعتها الدائرة التمهيدية؟ إذا اقتنعت الدائرة التمهيدية بأن الشخص المعني لم يتقيد بالتزام واحد أو بأآثر من التزام مفروض عليه، فيجوز لها، على هذا الأساس، أن تصدر أمراً بالقبض على هذا الشخص.

لا ه ا ي ، ف ي 26 ف ب ر ا ي ر 2007 ICC-20072702-Ar وقائع متعلقة بالحالة في دارفور في 31 آذار/مارس 2005 ، أحال مجلس الأمن التابع للأمم المتحدة، متصرفا بموجب الفصل السابع من ميثاق الأمم المتحدة، حالة دارفور انطلاقاً من 1 تموز/يوليو 2002 إلى Resolution (2005) المدعي العام للمحكمة الجنائية الدولية، وذلك من خلال القرار 1593 .1593 (2005) في 4 نيسان/أبريل 2005 ، قام المدعي العام بإبلاغ رئيس المحكمة رسمياً بأن الحالة في دارفور، السودان، قد أحيلت إلى المحكمة. في 5 نيسان/أبريل 2005 ، تلقى المدعي العام ظرفاً مختوماً يتضمن النتائج التي توصلت ، إليها لجنة التحقيق الدولية المعنية بدارفور، السودان 1 في 7 نيسان/أبريل 2005 ، قام المدعي العام، ونائب المدعي العام سيرج برامرتز، ونائبة المدعي العام فاتو بن سودا، ومديرة المكتب سيلفيا فرنانديز دي غورمندي بفتح قائمة مختومة أدرجت فيها لجنة التحقيق الدولية التابعة للأمم المتحدة أسماء أفراد يُشتبه بأنهم قد ارتكبوا جرائم دولية خطيرة في دارفور، بالسودان. في 21 نيسان/أبريل 2005 ، أصدرت هيئة رئاسة المحكمة الجنائية الدولية قراراً تسند فيه مهمة تولّي الحالة في دارفور، بالسودان، إلى الدائرة التمهيدية الأولى المؤلفة من القاضية أكوا كوينيحيا (غانا) والقاضي آلود جوردا (فرنسا) والقاضية سيلفيا شتاينر (البرازيل).
في 6 حزيران/يونيو 2005 ، أعلن المدعي العام للمحكمة الجنائية الدولية، لويس مورينو أوآامبو، قراره بفتح تحقيق في الحالة في دارفور، بالسودان، انطلاقاً من 1 تموز/يوليو

NOTING the "Decision of the Registrar Appointing Mr Hadi Shalluf as ad hoc Counsel for the Defence", filed by the Registrar on 25 August 2006;2 NOTING the "Application requesting the presence and participation of the ad hoc Counsel for the Defence during the proceedings that the Office of the Prosecutor will undertake in Sudan", filed by the ad hoc Counsel for the Defence ("the ad hoc Counsel") on 18 December 2006;3 NOTING the letter sent by the Head of the Division of Victims and Counsel to the ad hoc Counsel, dated 24 January 2007, asking him to provide the legal basis for his request for payment of fees for the period of 1 to 31 December 2006;4 NOTING the response of the ad hoc Counsel to the above request, dated 27 January 2007, in which he provided the legal basis of his request for payment of his fees arguing, inter alia, that since he had not received any instructions from the Chamber his mandate encompasses all duties and obligations of defence counsels in general, under articles 5 and 6 of the Code of Professional Conduct;5 NOTING the "Decision on the Ad hoc Counsel for the Defence Request of 18 December 2006", issued on 2 February 2007, in which the Chamber, inter alia, (i) rejects the request to permit the ad hoc Counsel to participate in, and be informed of, any proceedings undertaken by the Prosecution relating to the Situation in Darfur, Sudan; (ii) specifies that the mandate of the ad hoc Counsel is strictly restricted to proceedings pursuant to rule 103 of the Rules; (iii) determines that the ad hoc Counsel's mandate does not extend automatically to other proceedings at the pretrial stage set out in the Rome Statute and the Rules; and (iv) finds that the ad hoc Counsel's request falls outside the parameters of his legally assigned responsibilities;6 NOTING the letter sent by the Head of the Division of Victims and Counsel to the ad hoc Counsel, dated 13 February 2007, in which, after noting the above decision, the Head of the Division of Victims and Counsel informed him that no payments would be made for the periods of 1 to 31 December 2006 and 1 to 31 January 2007, on the ground that the ad hoc Counsel had been acting beyond the scope of his mandate;7 NOTING the "Decision on the Ad hoc Counsel for the Defence's Request for leave to Appeal the Decision of 02 February 2007", issued on 21 February 2007, in which the Chamber states that "the Ad hoc Counsel's mandate is restricted to particular proceedings under rule 103 of the Rules (...)"; and that therefore the Ad hoc Counsel's reliance on articles 5 and 6 of the Code of Professional Conduct "suggests that the Ad hoc Counsel attempts to extrapolate the specificity, the limits and the scope of his mandate";8 NOTING the "Request for Review of the Registry's decision of 13 February 2007",9 ("the Request for Review"), filed on 27 February 2007, in which the ad hoc Counsel requests the Chamber inter alia to (i) declare the decision of the Head of the Division of Victims and Counsel unlawful, flawed, void and unfair; (ii) declare that the work done by the ad hoc Counsel fell within the scope of his mandate; and (iii) - order the Registrar to pay the ad hoc Counsel's fees for all the work done in December 2006, January and February 2007; NOTING the "Réponse du Greffier au "Recours à l'encontre de la décision du Greffe du 13 février 2007" déposé le 27 février 2007 par Me Hadi Shalluf' (Response of the Registrar to the Request for review of the Registry Decision of 13 February 2007, filed on 27 February 2007 by Mr. Hadi Shalluf) ("the Registrar's Response"), filed on 6 March 2007, in which the Registrar requests the Chamber to rule the Request for Review inadmissible for non-compliance with regulation 135(1) of the Regulations of the Registry, or, in the alternative, that it be dismissed on its merits;10 NOTING the "Application requesting the intervention and opinion of the Prosecutor in the proceedings to be undertaken by the ad hoc Counsel for the Defence "Request for Review of the Registry Decision of 13 February 2007", filed by the ad hoc Counsel on 12 March 2007;11 NOTING rule 103 of the Rules and regulation 135 of the Regulations of the Registry; CONSIDERING that, effectively, the procedure provided for in regulation 135(1) of the Regulations of the Registry has not been followed; that the ad hoc Counsel should have sought a decision from the Registrar on the dispute relating to the payment of his fees; and that, therefore, the current Request for Review of the decision of the Head of the Division of Victims and Counsel should in principle be deemed inadmissible; CONSIDERING, nevertheless, that, in his response, the Registrar states that "[t]he Registrar has delegated authority to the Head of the Division of Victims and Counsel for those matters which fall within his remit, in this instance managing the Court's legal assistance scheme, including the payment of counsel fees";12 and that "in this matter the decision of 13 February 2007 was taken under the authority delegated by the Registrar - to the Head of the Division of Victims and Counsel in this case – to rule on the daily requests for the payment of counsel fees, and the decision is therefore not flawed in any way";13 CONSIDERING, furthermore, that, in his response, the Registrar has expressly and impliedly endorsed the decision taken by the Head of the Division of Victims and Counsel;14 and that therefore, in the view of the Chamber, the criteria for the admissibility of the Request for Review have been met; CONSIDERING that the Chamber, in previous decisions,15 and as mentioned above, has clearly defined the legal scope of the mandate of the ad hoc Counsel as being strictly limited as follows: "to represent and protect the general interests of the Defence in the Situation in Darfur, Sudan during particular proceedings, pursuant to rule 103 of the Rules, namely: inviting observations on issues concerning the protection of victims and the preservation of evidence in Darfur; and , accordingly, the mandate of the ad hoc Counsel for the Defence is strictly restricted to those proceedings and does not extend automatically to other proceedings at the pretrial stage set out in the Statute and the Rules";16 CONSIDERING that the Chamber unambiguously stated that under rule 103 of the Rules, both the Office of the Prosecutor and the ad hoc Counsel had 10 days to submit a written response to the observations of the Amid Curiae in the Sudan situation file;17 and that the ad hoc Counsel, by not submitting his response in writing, forfeited his right to respond; CONSIDERING, however, that the ad hoc Counsel has continued to file an inordinate number of baseless requests and motions; that he has completely disregarded the precise and clear scope of his mandate by adopting his own interpretation of the mandate;18 and that all such requests and motions have been denied by the Chamber on the ground that the ad hoc Counsel has no mandate, for instance, to challenge the admissibility of the case, or to participate in the proceedings relating to the Prosecution's investigation in the Sudan situation file; CONSIDERING that the Chamber agrees with the submission of the Registrar that the continuous filings of the ad hoc Counsel are frivolous and vexatious;19 that, in the view of the Chamber, such filings extrapolate the limits and scope of the ad hoc Counsel's specific mandate20; and, as such, can be considered an abuse of procedure; CONSIDERING, accordingly, that, given the fact that the ad hoc Counsel has been acting beyond the scope of his mandate, the Chamber is of the view that he is in no position to demand payment of fees for the vexatious and frivolous claims instituted before this Chamber for the said period; CONSIDERING, furthermore, that the ad hoc Counsel's motion requesting the Chamber to invite the Prosecution to submit observations on the Request for Review has no legal basis; CONSIDERING, lastly, that the Chamber is satisfied with the observations and response filed by the participants in the proceedings under rule 103 of the Rules, FOR THESE REASONS, REJECTS the ad hoc Counsel's Request for Review; REJECTS the ad hoc Counsel's motion requesting that the Prosecution be invited to submit observations on the Request for Review; ORDERS the Registry to inform all participants that the proceedings under Rule 103 of the Rules have come to a conclusion; Counsel for the defence authorised to act before the Court In January 2004, the Registry invited applications from interested persons in order to establish a list of counsel as required under rule 21(2) of the Rules of Procedure and Evidence: “The Registrar shall create and maintain a list of counsel who meet the criteria set forth in rule 22 and the Regulations. The person shall freely choose his or her counsel from this list or other counsel who meets the required criteria and is willing to be included in the list“. With the adoption of the Regulations of the Court in May 2004, the previously ‘provisional’ list became fully effective. In September 2006, of the 305 persons who had expressed an interest in being included in the list, 169 have been admitted and are eligible to act as counsel before the ICC. Appointment and qualifications of counsel for the defence The Registry reviews applications received to establish whether they are admissible, in conformity with the relevant provisions of the Rules of Procedure and Evidence and the Regulations of the Court. Counsel for the defence shall have [rule 22(1)]: • Established competence in international or criminal law and procedure; • The necessary relevant experience in criminal proceedings, whether as a judge, prosecutor, advocate or in another similar capacity; • Excellent knowledge of and be fluent in at least one of the working languages of the Court. • The necessary relevant experience for counsel as described in rule 22 must amount to at least ten years (regulation 67). • Counsel should not have been convicted of a serious criminal or disciplinary offence considered to be incompatible with the nature of the office of counsel before the Court (regulation 67). • Counsel for the defence may be assisted by other persons with relevant expertise, including professors of law [rule 22(1)]. Regulation 4 provides that a representative of counsel from the list created and managed by the Registry sits on the Advisory Committee on Legal Texts .
Duties and responsibilities Counsel added to this list can be called upon at any time to provide legal assistance in relation to proceedings before the Court to the persons concerned. Their conduct before the Court is governed by the Code of Professional Conduct for Counsel (ICC-ASP/4/32), adopted during the fourth session of the Assembly of States Parties. On 8 December 2006, in accordance with Articles 36 and 44 of the Code of Professional Conduct for Counsel (ICC-ASP/4/32), the members of the Disciplinary Board and the representatives of counsel on the Disciplinary Appeals Board of the ICC were appointed following the first of such elections organised by the Registry. • Results of the Election of members of the ICC Disciplinary Board and Disciplinary Appeals Board English | French
How to apply to be included in the list of counsel The Court specifically encourages and welcomes applications from female candidates, as well as from candidates practicing in countries a situation in which has been brought before the Court. Call for applications to the list of assistants to Counsel In accordance with regulation 125, paragraph 1 of the Regulations of the Registry, a list of assistants is created. Persons who possess the requisite qualifications as stipulated by Regulation 124 of the Regulations of the Registry can apply for inclusion in this list. Qualifications of assistants The Registry reviews received applications for the list of assistants in order to establish whether they are admissible in conformity with the relevant provisions of the Regulations of the Registry. To be included on the list, interested candidates shall meet the following requirements as outlined in Regulation 124 of the Regulations of the Registry, that is to have five (5) years of relevant experience in criminal proceedings, or specific competence in international or criminal law and procedure. Duties and responsibilities Assistants added to the list can be called upon at any time by defence counsel, legal representatives of victims or a person representing himself or herself, to provide legal assistance/expertise in relation to proceedings before the Court. The conduct of assistants is governed by the pertinent provisions of the Rome Statute, the Rules of Procedure and Evidence, the Regulations of the Court, the Regulations of the Registry and the Code of professional conduct for counsel. How to apply to be included in the list of assistants The Court specifically encourages and welcomes applications from female candidates, as well as from candidates practicing in countries a situation in which has been brought before the Court. Candidates seeking to be added to the list of assistants must send the following documents to the address given below: All applicants: 1. Candidate application form, duly signed 2. Detailed curriculum vitae 3. A certificate issued by the relevant authority of the State(s) in which you are domiciled, stating the existence, if any, of criminal convictions 4. Legible copy of birth certificate 5. Legible copy of passport / travel document 6. 2 passport size pictures Applicants to whom the following will apply: 7. Original or certified copy of the certificate issued by the bar association, professional association and/or the controlling administrative authority with which you are registered 8. an official letter issued by the institution where you are acting as an adjunct-, part-, or fulltime- professor, certifying your tenure and specialty as an instructor 9.
