Quote: CNN) -- A Sudanese journalist could receive 40 lashings after she was caught wearing trousers.
Lubna al-Hussein was arrested with 18 other women this month for wearing indecent clothes. A Sudanese court began hearing Lubna al-Hussein's case Wednesday. It will continue the hearing August 4.
At the time of her arrest, she was wearing pants, a blouse and a hijab, she said. Police accused her of wearing trousers that were too tight and alleged that her blouse was too transparent, al-Hussein said.
Al-Hussein, who works for a newspaper and the media department of the United Nations mission in Sudan, said she did nothing wrong. She has been released to her home in Khartoum.
The crime of wearing indecent attire has only one punishment under Sudanese law, a 40-stroke public flogging, according to the Arabic Network for Human Rights Information.
"This case is the official retaliation against the reporter for her writings criticizing the Sudanese regime and extremists," the organization said in a statement.
Al-Hussein was arrested along with 18 others July 3 after Sudan's "discipline police" accused the women of wearing indecent clothes, al-Hussein said. Six were released, and 10 received the 40 lashes, she said.
Al-Hussein and two others fought the charges and hired attorneys, she said.
U.N. Secretary-General Ban Ki-moon spoke out against the decision Wednesday, saying he was "deeply concerned" and would take every effort to protect his staff member.
"The flogging is against the international human rights standards," he said. "I call on all parties to live up to their obligations under all relevant international instruments." |

Quote: Sudanese woman to give up immunity to stand trial By MOHAMED OSMAN Associated Press Writer KHARTOUM, Sudan (AP) -- A Sudanese female journalist facing 40 lashes for wearing trousers in public in violation of the country's strict Islamic laws told a packed Khartoum courtroom Wednesday she is resigning from a U.N. job that grants her immunity so she can challenge the law on women's public dress code.
Lubna Hussein was among 13 women arrested July 3 in a raid by members of the public order police force on a popular Khartoum cafe for wearing trousers, considered indecent by the strict interpretation of Islamic law adopted by Sudan's Islamic regime. All but three of the women were flogged at a police station two days later.
But Hussein and two other women decided they wanted to go to trial and Hussein invited human rights workers, western diplomats and fellow journalists to Wednesday's hearing.
Some of her women friends showed up in court Wednesday wearing trousers in a show of support.
"This is not a case about me wearing pants," said Hussein, who works in the media department of the U.N. Mission in Sudan and contributes opinion pieces to a left-leaning Khartoum newspaper.
"This is a case about annulling the article that addresses women's dress code, under the title of indecent acts. This is my battle. This article is against the constitution and even against Islamic law itself," she said after the hearing.
Judge Mudathir Rashid adjourned the hearing until Aug. 4 to give Hussein time to quit her job.
Hussein said she would immediately quit and thanked the U.N. for intervening to spare her possible punishment.
She said the U.N. mission was trying to stand by her, invoking a clause in an agreement between the Sudanese government and the world body's representatives in Sudan that obliges authorities to ask permission before starting legal proceedings against a member of its staff.
When asked about the case, U.N. Secretary-General Ban Ki-moon described himself as "deeply concerned" and said flogging was a violation of international human rights standards.
"The U.N. will take every effort to ensure that the rights of its staff members are protected," Ban told a news conference.
Hussein's defense lawyer, Nabil Adeeb, said the U.N. wanted to protect its staff, but Hussein wanted her trial to proceed.
"We have contradicting interests," he said. Hussein can face at least 40 lashes, according to Adeeb.
Islamic Sharia law has been strictly implemented in Sudan since an army coup led by President Omar al-Bashir seized power in 1989, toppling an elected but ineffective government. Activists and lawyers say the implementation of the law is arbitrary.
Public order cases usually involve quick summary trials with sentences carried out shortly afterward, as was the case with the 10 of the 13 women arrested earlier this month. They were flogged and fined 250 Sudanese pounds, or about $120.
Women in the mostly Arabized and Muslim northern Sudan, particularly in the capital Khartoum, dress in traditional outfits that include a shawl over their head and shoulder. Western dress is uncommon.
Still, the raid on a Khartoum cafe popular with journalists and foreigners was unusual |

Quote: Sudan court adjourns 'lashes for trousers' case By Peter Martell (AFP)
KHARTOUM — A Sudanese court on Wednesday adjourned the case of a woman journalist facing 40 lashes for wearing "indecent" trousers, with 10 women already whipped for similar offences against Islamic law.
The judge deferred the case to Tuesday after Lubna Ahmed al-Hussein, who works for the left-wing Al-Sahafa newspaper and for the media department of the United Nations Mission in Sudan, waived the immunity given to UN workers.
"The court gave Lubna the choice either to accept immunity from the UN or to waive that and go on with the trial," her lawyer Nabil Adeeb told AFP.
"I wish to resign from the UN, I wish this court case to continue," Hussein told a packed courtroom before the judge adjourned the case to August 4.
Hussein, who wears a hijab or Islamic headscarf, faces 40 lashes and a fine of 250 Sudanese pounds (100 dollars) if found guilty.
She wore the same clothes to court as when she was arrested -- moss-green slacks with a loose floral top and green headscarf.
She waved defiantly to crowds as she left the court.
Hussein said she was at a restaurant on July 3 when police came in and ordered 13 women wearing trousers to follow them to the police station.
Ten of the women were summoned to a police station two days later and were lashed 10 times each, according to Hussein.
The women whipped earlier this month included some from animist and Christian south Sudan where the Muslim north's Islamic or sharia law does not apply.
Scores of people crammed into the courthouse to hear the ruling, many of them female supporters -- some of them also wearing trousers out of solidarity.
Some held up placards on the street outside. "A woman is not for flogging," read one in Arabic.
"We are here to support Lubna, because this treatment of women is arbitrary and not correct," said Zuhal Mohammed Elamin, a law professor in Khartoum. "Women should not be humiliated in this manner."
Police have also cracked down on another woman journalist, Amal Habbani, after she wrote an article condemning Hussein's treatment.
Habbani wrote an article for Ajrass Al-Horreya newspaper following the arrests entitled "Lubna, a case of subduing a woman's body."
"I am waiting for a decision," Habbani told AFP after she was charged with defaming police, a charge which can carry a fine of up to several hundred thousand dollars.
The Arabic Network for Human Rights Information said the charge against Habbani stemmed from her claim that Hussein's arrest was "not about fashion but a political tactic to intimidate and terrorise opponents."
Unlike many other Arab countries, particularly in the Gulf, women have a prominent place in Sudanese public life. Nevertheless, human rights organisations say some of Sudan's laws discriminate against women.
In December 2007, British teacher Gillian Gibbons faced 40 lashes after being convicted of insulting religion by allowing her pupils to name a teddy bear Mohammed.
Gibbons, 54 at the time, was eventually sentenced to 15 days in prison but was pardoned by Sudanese President Omar al-Beshir following the mediation of two Muslim members of Britain's upper house of parliament. |
