    Joint Statement of the Sudanese Political and Civil Society Organization to the International Community on the situation in
    Sudan


    December 16, 2009

    We the undersigned, as representatives of Sudanese political and civil society organizations in the United States, note with great concern the latest acts of repression and intimidation by the ruling National Congress Party (NCP) in Sudan. The arrest of leaders and activists and the disruption of the peaceful processions that were launched on the 7th and 14th of December represent a grave violation of the Constitution of Sudan and a serious setback to the quest for democratic transformation and peaceful resolution of the protracted conflicts facing our country. It also represented a clear repudiation of the spirit of the Comprehensive Peace Agreement (CPA) that ended the longest running civil war in Sudan.

    The peaceful processions were organized to submit a popular petition to the leadership of the National Assembly to expedite the enactment of outstanding laws and statutes that are essential to the implementation of the CPA, and the organization of a credible and transparent election in April, 2010. This procession was important because the NCP has stalled the implementation of many provisions of CPA that should have already been resolved if not for the intransigence of the NCP. It is therefore an utmost outrage for the NCP to order police and security forces to violently disrupt these constitutionally sanctioned processions, and arrest political leaders and activists who were exercising their right to assemble and petition their Parliament.

    The situation in Sudan is grave and deserves the utmost attention of the international community because of the dire implications to the whole region if the country reverts back to war. We are here to ring the alarm bells and to summon the collective moral and political energies of our friends around the world to assist us in pressuring the ruling party in Sudan to not thwart the democratic aspirations of the people of Sudan.

    We believe that the following concrete and immediate steps must be taken to stop the prospect of renewed conflict and to comprehensively resolve the issues that are at the heart of the instability in Sudan:

    The complete implementation of the CPA

    • Expeditiously enact the laws governing the upcoming Referendum in Southern Sudan, and the popular consultations in Southern Blue Nile and Southern Kordofan.

    • Bring all laws and statutes in compliance with the Interim National Constitution, namely the National Security Law, Criminal Procedures Law, Trade Unions Law, Immunities Law, Personal Status Law, Press and Publications Law, Public Order Laws. This is a necessary condition to ensure a fair and credible election across the whole country in 2010.

    • Implement the Abyei arbitration award and expeditiously demarcate the North-South borders as called for in the CPA.

    Darfur

    We affirm the legitimate cause of the people of Darfur and urge the international community and all stakeholders in Sudan to ensure that a credible peace process is reinvigorated to address these legitimate grievances and end the long suffering of our fellow Sudanese. To that end, we believe that the following demands of the people of Darfur should be addresses by a credible and internationally mediated peace process:
    a) Affirm zero tolerance to impunity from prosecution and ensure that those who have committed war crimes are brought to book before independent judiciary.
    b) Immediate cease-fire to create conducive atmosphere for delivery of humanitarian assistance and return of internally displaced persons and refugees to their villages.
    c) A credible share for the region in power and civil service at the national level according to its demographic size.
    d) Individual and group compensation for material and moral damages as a result of the destructive conflict unleashed by the government in Darfur.
    e) Grant the people of Darfur the right to determine through a credible process whether the region should revert back to one singular region instead of the current three states.

    International Engagement

    The international community has played a commendable role in helping usher an end to the conflict in Sudan through the IGAD Peace Process that culminated in the 2005 CPA. The same level of engagement if not more is now needed, not only to sustain the existing agreement but to essentially ensure that Sudan does not completely collapse. The reversion to armed conflict as a result of the intransigence of the NCP will have disastrous consequences beyond the shores of Sudan, and can potentially plunge the whole region into a protracted period of strife.

    The United States and the rest of the International Community must therefore know that the Sudanese people have staked their future on a peaceful democratic transformation of the power structure in the center as the solution to their problem. The ruling NCP party however, wants to thwart that aspiration through the use of state power, resources and intimidation.

    Our organizations and membership are committed to the struggle against this dictatorial mindset, and we collectively appeal to the world to remain engaged in the side of the forces of democracy, peace and justice in Sudan. We commend the US for its recently released policy framework on Sudan, especially with regards to compelling the government to honor its commitments under the CPA and resolve the conflict in Darfur. This policy however needs robust engagement and a clear-eyed understanding of the expedient nature of the ruling party for it to bear fruit.

    Finally, we take this opportunity to salute the stalwart and determined people of Sudan who have suffered immensely under dictatorship and failed leadership, but continue to strive for their democratic rights in their own country.
