Arbitrary arrest of General Trade Union Council members



On Sunday, 21 December 2003, the National Security Agency arrested the following nine members of the General Trade Union Council. Their names are as follows:



1. Mahjoub Ahmed Alzubair

2. Minallah Addalwahab

3. Nasr Mohamed Nasr

4. Sidiq Yahya

5. Hadalrayed Abdalmahi Mohamed Attia (f),

6. Ali Khalifa Mahadi,

7. Mohamed Suliman Mohamed

8. Mohamed Mahmood

9. Akasha Babikr Mohamed



They were arrested at 1.45pm at Mr. Mahjoub Ahmed Alzubair house, in Shambat, Khartoum North, during a peaceful meeting, and were taken to the NSA offices near Farouq cemetery. They were released at 10.30pm and ordered to report back to the NSA offices at 11am on Monday, 22 December 2003 and released on the same day at 6 pm and, for a second time, ordered to report the following day. They were questioned about the activities of the union, only on the first day, and were not questioned on their second day of detention.



SOAT condemns these arbitrary arrests and part-time detentions and urges the Government of Sudan to:



i. Take all necessary measures to ensure the physical and psychological integrity of all the detainees.



ii. Order the immediate release of all the detainees in the absence of valid legal charges, or if legitimate charges exist, bring them before an impartial tribunal and guarantee procedural rights at all times.



iii. Ensure that all detainees have access to legal advice



iv. Guarantee the respect of human rights and fundamental freedoms, including freedom of association throughout Sudan in accordance with national laws and international human rights standards.

Arbitrary arrest of opposition parties members





The National Security Agency has launched a mass arrest campaign of opposition parties' members. They include some representatives of the Popular National Congress (PNC), headed by Hassan Al Turabi, and several members of the Umma Party from the Darfour region.



Their arrests took place on 18 December 2003 at 4.30 am. The names of those arrested are as follows:



Alkhair Algadi'el, PNC Secretary for Union relations
Altigany Sinain, PNC member
Mohamed Hafiz Abdallah, PNC member
Dawood Atiah- Umma Party member
Isamel Abashar Arabi, Umma Party member
Ismael Abshar Mohamed, Umma Party member


It is alleged that these new wave of arbitrary arrests are due to the failure of the negotiations between the government of Sudan and the Sudan Liberation Army (SLA) in N'djamena, Chad over the conflict in Darfur, Western Sudan.




SOAT condemns these arbitrary arrests and the continued restriction on freedom of expression and urges the Government of Sudan to:



Take all necessary measures to ensure the physical and psychological integrity of all the detainees.


Order the immediate release of all the detainees in the absence of valid legal charges, or if legitimate charges exist, bring them before an impartial tribunal and guarantee procedural rights at all times.


Ensure that all detainees have access to legal advice


Guarantee the respect of human rights and fundamental freedoms, including freedom of association throughout Sudan in accordance with national laws and international human rights standards.

Arbitrary arrests in Zalingy



On 2 January 2004, the security forces in Zalingy, Darfour, arrested 4 men from the Fur ethnic group; they were arrested from the local market in Zalingy at 11am. They are currently being detained at the security forces offices in Zalingy. Their names are as follows:



Adeab Abd El Rahman Yousif, 30 yrs, teacher
Saead Imam Alhaj, 35 yrs, teacher
Ibrahim Osman, 36 yrs, merchant
Arbab Abd El Mowla, 34 yrs, teacher
They were arrested in suspicion of belonging to the Sudan Liberation Army (SLA), one of the main armed rebel groups operating in Darfour. They have not been officially charged. There are significant fears that they may have been subjected to torture as thee have been other reported cases of torture by the security forces in Zilingy.



Background



The situation in Darfur continues to deteriorate; many civilians have been displaced and many killed due to the ongoing fighting in the region. This has continued even with the extension of the ceasefire agreement until 4 December 2003, following the initial ceasefire agreement, on 3 September 2003, for 45 days between the Sudan Liberation Army (SLA) and the Government of Sudan (GoS) on. The conflict continues with various parties to the conflict including government sponsored militias and the Justice and Equality Movement (JEM). In the meantime, many civilians are killed and displaced within Darfour and neighbouring Chad with limited or no humanitarian aid getting through to those in need.



It is alleged that these new wave of arbitrary arrests are due to the failure of the negotiations between the government of Sudan and the Sudan Liberation Army (SLA) in N'djamena, Chad, over the conflict in Darfur, Western Sudan. This has led to the escalation of the conflict in Darfur and the rapid deterioration of the situation in the region.



SOAT condemns these arbitrary arrests and urges the Government of Sudan to:

3 from Zaghawa tribe arbitrarily arrested



On the 5 - 7 January 2004, the security forces in Nyala arrested three men belonging to Zaghawa tribe. Their names are as the follows:



Yousif Idris, merchant, 33 yrs, arrested on 5 January
Salim Idris, merchant, 35 yrs arrested on 6 January ( they are brothers)
Suleiman, merchant, 40 yrs, arrested on 7 January


The three men are currently being detained at the security office in Nyala and have no official charges made against them. They have allegedly been tortured; they were punched, flogged and has cold water poured on them at night.



Background



The situation in Darfur continues to deteriorate; approximately 670,000 people have been displaced and many killed due to the ongoing fighting in the region.



Unfortunately, the failure of the peace negotiations in December 2003 between the GoS and the SLA in N'djamena, Chad, has led to the continuation of the conflict in Darfur and the rapid deterioration of the humanitarian situation in the region



All parties involved in the conflict; including government sponsored militias and the Justice and Equality Movement (JEM), have resumed fighting. Also, the new wave of arbitrary arrests can be seen as a response to the failure in resolving the conflict.



Due to the GoS imposing severe restrictions on humanitarian relief organisations the refugees are being placed in extreme danger. The GoS has also restricted the media from reporting on the conflict from within Darfur.





SOAT condemns these arbitrary arrests and urges the Government of Sudan to:



Take all necessary measures to ensure the physical and psychological integrity of all the detainees.


Order the immediate release of all the detainees in the absence of valid legal charges, or if legitimate charges exist, bring them before an impartial tribunal and guarantee procedural rights at all times.


Ensure that all detainees have access to legal advice


Guarantee the respect of human rights and fundamental freedoms, including freedom of association throughout Sudan in accordance with national laws and international human rights standards.

Death penalties and cross amputations to take place in Darfur



SOAT has received confirmed information that 9 people's appeals against their death sentences and 1 person against their cross amputation, at the Supreme Court in Khartoum, have not been unsuccessful and the Supreme Court approved the initial Specialised Criminal Court's convictions. They are now at risk of execution and cross amputation without the right for further appeals. Below are their details:



Omer Alajib Jobara, sentenced to death on 17 March 2003 before Aldeain town Criminal Court, the Appeal Court confirmed the sentence on 29 April 2003


Ibraheam Dawood Abdelrahman, sentenced to death on 17 May 2003 before Nyala Court, the Appeal Court confirmed the sentence on 12 July 2003


Abdelraheam Omer Zakaria, sentenced to death on 17 May 2003 before Nyala Court, the Appeal Court confirmed the sentence on 12 July 2003


Ibraheam Yahya Yagoub, sentenced to death on 29 May 2003 before Bouram Court, the Appeal Court confirmed the sentence on 15 July 2003


Hassan Shigaf Ali , sentenced to death on 8 June 2003 before Nyala court, the Appeal Court confirmed the sentence on 12 July 2003


Ibraheam Mohamed Hussain, sentenced to death on 8 June 2003 before Nyala court, the Appeal Court confirmed the sentence on 12 July 2003


Bilal Hamid Alhabu, sentenced to death on 30 September 2003 before the Aldeain Court, the Appeal Court confirmed the sentence on 4 December 2003


Ibraheam Ahmed Omer Abaker, sentenced to death on 30 September 2002 before Kass Court, the Appeal Court confirmed the sentence on 28 June 2003


Mustafa Adam Abdella, sentenced to death on 27 March 2003 before Nyala Court


Mohamed Ishag Mohamed, sentenced on 31 May 2003 to cross amputation before Kass Court




SOAT is unconditionally opposed to the death penalty and strongly condemns its use by the Government of Sudan. SOAT is gravely concerned by executions occurring in Darfur, and by the procedures of these criminal courts, which do not comply with international or national standards for fair trials.



SOAT strongly urges the Government of Sudan to:



i) Abolish the death penalty in Sudan

ii) Ensure respect for rights to fair trial and to legal appeal in accordance with international human rights standards, for all detainees throughout Sudan

iii) Guarantee respect for human rights and fundamental freedoms throughout Sudan in accordance with national laws and international human rights standards
