SOAT Press Release: 22 June 2004

Three men at risk of being hanged

[CENTER/]

On 30 May 2004, the Specialised Criminal Court in Nyala sentenced three men to death by hanging following their convictions under articles 130 (Murder) and 168 (armed robbery (Hiraba) of the 1991 Penal Code.

The three men had allegedly killed one man and injured two others in the process of an armed robbery in Burkaz near Nitaiga village, east of Nyala in March 2004. The three men were arrested on 23 March 2004, all three men are farmers from the Mesayra tribe in Nitaiga village, and their details are as follows:

1. Musa Issa Dikko, 21 yrs

2. Adam Harin Issa, 27 yrs

3. Ahmed Mohamed Abdel Gadir, 30 yrs

The men’s lawyers have submitted an appeal before the Appeal court in Nyala and the case is still pending.

SOAT is unconditionally opposed to the death penalty and strongly condemns its use by the Government of Sudan. SOAT is gravely concerned by executions occurring in Darfur, and by the procedures of these Criminal Courts, which do not comply with international or national standards for fair trials.

SOAT strongly urges the Government of Sudan to:

i) Abolish the death penalty in Sudan

ii) Ensure respect for rights to fair trial and to legal appeal in accordance with international human rights standards, for all detainees throughout Sudan

iii) Guarantee respect for human rights and fundamental freedoms throughout Sudan in accordance with national laws and international human rights standards

The above recommendations should be sent in appeals to the following
