U.S. drops objection to International Criminal Court trial of Sudanese war criminals
WASHINGTON (AP) --

The United States is dropping its objections
to use of the U.N.'s International Criminal Court to try Sudanese
responsible for an ethnic cleansing campaign in the Darfur region
that has killed tens of thousands of people and uprooted more than
2 million, administration officials said Wednesday night.
The administration had preferred that an African court try the
case but agreed to a compromise during daylong discussions at the
United Nations on Wednesday.

The United States has strongly opposed the ICC on grounds that
American service members or civilians serving overseas could be
subject to politically motivated or frivolous prosecutions.
In return for its concession, the United States received
assurances that Americans deployed in Sudan, in whatever capacity,
would not be subject to ICC prosecutions, the officials told The
Associated Press. They asked not to be identified because the
decision has not been officially announced.

The decision could raise hackles among conservatives for whom
the ICC is an unaccountable body that cannot be trusted to the
right thing. The 97 countries that have ratified the 1998 Rome
Treaty establishing the court maintain that there are sufficient
safeguards built into the process to prevent unwarranted
prosecutions.

The administration agreed to a compromise after concluding that
opposition to the U.S. stand was too strong, particularly among
Europeans, who have been united in support of the Rome-based ICC as
the trial venue.
Concerned about a possible U.S. veto, France on Wednesday
delayed a U.N. Security Council vote on a resolution to authorize
an ICC prosecution.
The western Sudanese region of Darfur has been the scene of
perhaps the world's worst humanitarian crisis. The widespread death
and destruction has been the result of a brutal counterinsurgency
campaign led by government-support Arab militias against black
African farmers. The conflict began in February 2003.
Last September, former Secretary of State Colin Powell said the
perpetrators had engaged in genocide. Tens of thousands of
displaced Darfurians are confined to refugee camps, refusing to
return to their villages for fear they would only be forced to flee
once again.

The United States, as one possible option, has suggested that
"a hybrid court" be impaneled by the United Nations and the
African Union to try the Darfur perpetrators. It has said the ICC
is already overextended, with existing commitments in Congo,
Rwanda, Central African Republic and Ivory Coast.

But critics have said the ICC is ready to take on the Darfur
prosecution, arguing that the tribunal proposed by the United
States would take a year to get off the ground.

On Resolution 1591

The spokesperson of the United Nations Mission in Sudan (UNAMIS), Radhia Achouri, stated yesterday that the names of the individuals who are to be sanctioned are yet to be identified.

Achouri emphasized that the list will be established by the sanction committee established by the Security Council with the assistance of the panel of experts.
“Within 30 days from the adoption of the resolution, the UN Secretary General is expected to have established a four men panel of experts”. Achouri added that “this panel will work together with the sanction committee and will establish a list later”.

Achouri stated that the individuals who are banned from traveling and whose assets are frozen for impeding the peace process and for violating human rights are different from the 51 suspects whose names were identified by the commission of inquiry. “The names submitted by the commission of inquiry are still sealed.

She said the Council decided that the measures would be effective 30 days from the adoption date, unless the Council determines that the parties have complied with all the commitments and demands set out by the previous resolution.

Achouri emphasized that any bridging of international laws by any individual should be accounted for. “Those who bridge the international human rights laws are responsible, and they have to account for that”. Achouri repeated.

Reacting on the criticism by the British parliament that the UN had under estimated the death toll in Darfur, Achouri emphasized that the UN had conducted a scientific survey on counting the death toll.

Achouri admitted that the samples taken and studied by WHO had not covered the whole of Darfur region. She insisted there was not underestimation of the figures. Achouri stated that the Security Council had voted and adopted individual sanctions and arm embargo on Sudan by 12 members in favor with three abstentions. (Algeria, China and Russia).

“The four-member panel of experts will be based in Addis Ababa and will assist the committee in monitoring the implementation of the measures”, Achouri concluded.

Would you tell me why USA was opposing the trials by ICC, I mean, more details than what is written here.

Another thing that I don't understand: The assets, will be they be frosen only abroad or also in Sudan. I mean, would the sanctioned persons be unable to travel abroad, while enjoying complete freedom of movement and continue practising their the political activity. WOuld their assets in Sudan be frosen?

قال دبلوماسيون إن الولايات المتحدة طلبت إدخال تعديلات على مشروع قرار تقدمت به فرنسا يتيح للمحكمة الجنائية الدولية محاكمة المتهمين بارتكاب مذابح واغتصاب وأعمال نهب في إقليم دارفور السوداني.

وقال المبعوثون إن هذه الصيغة تستثني المواطنين الأميركيين في السودان من الخضوع لولاية المحكمة، وذلك مرتبط برفض واشنطن الاعتراف بالمحكمة الجنائية الدولية.

وتأجل حتى اليوم الخميس إجراء تصويت على مشروع القرار الفرنسي لإفساح الوقت أمام المسؤولين الأميركيين للتباحث في الأمر مع أعضاء مجلس الأمن بشأن المكان الذي ينبغي أن يحال إليه المتهمون بارتكاب جرائم حرب.

ولا يتوقع أحد أن تصوت الولايات المتحدة بالموافقة على مشروع القرار. لكن السفراء الأوروبيين المؤيدين بقوة للمحكمة الدولية يأملون أن تمتنع واشنطن عن التصويت وألا تستخدم حقها في النقض (الفيتو) مقابل إدخال بعض التغييرات على النص. وقال الدبلوماسيون إن واشنطن حتى الآن تريد تنازلات يرفض أنصار المحكمة الجنائية الدولية تقديمها، ولم يفصح عن نوعية هذه التنازلات.

وقال المتحدث باسم وزارة الخارجية الأميركية آدم إيرلي إن "الولايات المتحدة مع المحاسبة"، وأضاف "نأمل أن نتمكن من التوصل إلى قرار مقبول ينص على المحاسبة".

ويستطيع مجلس الأمن أن يحيل قضية إلى المحكمة الجنائية الدولية بلاهاي إذا كانت الدولة التي وقعت فيها الجرائم غير راغبة أو غير قادرة على مقاضاة مرتكبيها.

وكانت واشنطن طلبت من مجلس الأمن تأجيل التصويت على مشروع قرار فرنسي بشأن محاكمة متهمي دارفور في ظل تصاعد الخلاف، إذ ترى فرنسا محاكمتهم بلاهاي فيما تفضل واشنطن محكمة خاصة يكون مقرها مدينة أروشا التنزانية.

موقف السودان
يأتي ذلك في وقت ضاعفت فيه الحكومة السودانية اتصالاتها مع الدول الأعضاء في مجلس الأمن للحيلولة دون صدور القرار.

القرار ساوى بين المتمردين الذين خرجوا على النظام وبين واجبات الدولة (رويترز-أرشيف)
واستبقت ذلك بالإعلان أنها ستقدم 15 من مرتكبي الفظائع في دارفور -بينهم مسؤولون حكوميون- إلى محكمة سودانية، رافضة مثول أي مواطن سوداني أمام محاكم خارج البلاد.

وردت الحكومة السودانية بغضب على هذا القرار، ووصفته وزارة الخارجية في بيان بأنه "غير متوازن وغير موفق" وتجاهل جهود الحكومة في الجوانب السياسية والأمنية والإنسانية في معالجة مشكلة دارفور.

وأضاف البيان أن القرار ساوى ظلما بين حقوق وواجبات الدولة والتمرد.

وفي موضوع آخر طالب متمردو شرق السودان بإجراء محاكمات لقوات الأمن السودانية وحملوها مسؤولية مقتل مدنيين في أعمال شغب يناير/كانون الثاني الماضي في مدينة بورسودان، قبل الموافقة على بدء محادثات سلام مع الخرطوم.

وتقدم متمردو جبهة الشرق السودانية التي تضم حركتي "مؤتمر البجة" و"الأسود الحرة" بذلك الطلب في اجتماع عقد قرب الحدود مع إريتريا لوضع إستراتيجية عقب عرض الحكومة السودانية منتصف فبراير/شباط الماضي إجراء محادثات معهم.

Reporter: Could you just state what the accountability resolution, for broadcast purposes here, people who don’t have the document here, what does it state about people who are suspected of war crimes? What is the Council going to be deciding on this issue?

Ambassador Patterson: The Council will consider, again this is a follow-up to the Commission of Inquiry, the United States was the delegation that promoted the Commission of Inquiry report. We’re very much behind accountability; it’s obviously a central part of our strategy on Sudan. What the resolution will say, and I would call it fairly a placeholder resolution, would say there are several options here one of which is the Nigerian proposal, which is a combination of a court and a reconciliation commission, the second is an AU hybrid court that would be based in Tanzania and the third of course is the ICC. The resolution makes no judgment as to which would be preferable, but simply enables discussions to continue until a decision is reached.
