We, the undersigned organizations, are seriously concerned over reports of a possible visit to Chad by Sudanese President Omar al-Bashir—wanted by the International Criminal Court (ICC) on charges of genocide, crimes against humanity and war crimes—to attend the Community of Sahel-Saharan (CEN-SAD) summit to be held on February 16, 2013 in Ndjamena.

President al-Bashir is the subject of two arrest warrants issued by the ICC. Permitting President al-Bashir to visit Chad without executing these warrants would run counter to Chad’s obligations as a state party to the Rome Statute of the International Criminal Court, in particular Articles 86 and 89(1) of the Rome Statute. It would also send damaging signals to victims of mass atrocities in Darfur and globally, and undermine Chad’s credibility on issues of justice and accountability.

The Chadian government participated in the eleventh session of the Assembly of States Parties to the ICC held in The Hague, the Netherlands. During this session, the ASP called upon states parties to strengthen their efforts to ensure full and effective cooperation with the Court and express their political and diplomatic support. Avoiding situations of non-cooperation, including visits by President al-Bashir, was a topic featured prominently in official statements and discussions at the tenth and eleventh sessions of the ASP .

Recent events point to a readiness on the part of states to uphold their obligations under the ICC treaty and to avoid situations of non-cooperation with the Court. Most recently, President al-Bashir cancelled a scheduled trip to Malawi in the summer of 2012 to participate in the AU Summit, after the strong signals from newly-elected Joyce Banda, indicating that he would not be welcome in the interests of international justice and solidarity with victims of mass crimes. In the past years, President al-Bashir cancelled a scheduled trip to the Central African Republic for independence celebrations in Bangui in December 2010 amid calls for his arrest, and anticipated travel by the President to Kenya was forestalled in October 2010 with the relocation of a meeting of the Intergovernmental Authority on Development from Nairobi to Addis Ababa. President al-Bashir’s curtailed travel sends a strong signal that, as a suspected perpetrator of the worst crimes known to humankind, he is not a welcome guest and should be arrested to face justice before the International Criminal Court.

Already on 13 December 2011, following the visit of President Al-Bashir to Chad, Trial Chamber I had found a violation by Chad of its obligation to cooperate and had passed through the President of the ICC, the decision to the Security Council.

For all of these reasons, we urge the Chadian government to clearly affirm its commitment to cooperate with the ICC, as states such as South Africa, Uganda and Botswana, Burkina Faso and Malawi have already done, and clarify that should President al-Bashir enter Chad, he will be arrested. This would be an important way to demonstrate respect for victims of the crimes committed, along with Chad’s commitment to end impunity.

Nous, les organisations soussignées, sommes gravement préoccupées par les informations faisant état d'une éventuelle visite au Tchad du président soudanais Omar el-Béchir, recherché par la Cour pénale internationale (CPI) pour génocide, crimes contre l'humanité et crimes de guerre. Celui-ci s’y rendrait pour assister au sommet de la Communauté des Etats sahélo-sahariens (CEN-SAD) qui se tiendra le 16 février 2013, à Ndjamena.

Le président el-Béchir fait l'objet de deux mandats d'arrêt délivrés par la CPI. Permettre au président el-Béchir de se rendre au Tchad sans exécuter ces mandats irait à l'encontre des obligations du Tchad en tant qu'and#201;tat partie au Statut de Rome de la Cour pénale internationale, en particulier en vertu des articles 86 et 89 (1) du Statut de Rome. Cela enverrait également un message négatif aux victimes d'atrocités de masse au Darfour et dans le monde, saperait la crédibilité du Tchad sur les questions de justice et de responsabilité.

Le gouvernement tchadien a participé à la onzième session de l'Assemblée des and#201;tats parties à la CPI à La Haye, aux Pays-Bas. Au cours de cette session, l'Assemblée des and#201;tats parties a appelé les and#201;tats parties à intensifier leurs efforts pour assurer une coopération pleine et entière avec la Cour et à exprimer leur soutien politique et diplomatique. and#201;viter les situations de non-coopération, y compris dans le cadre des visites du président el-Béchir, était une question majeure dans les déclarations officielles et les discussions lors des dixième et onzième sessions de l'AEP.

Les événements récents indiquent une volonté de la part des and#201;tats de respecter leurs obligations en vertu du traité de la CPI et d'éviter les situations de non-coopération avec la Cour. Plus récemment, le président el-Béchir a annulé un voyage prévu pour le Malawi l'été 2012 pour participer au Sommet de l'UA, après que Joyce Banda, nouvellement élue présidente ait indiqué qu'il ne serait pas le bienvenu dans l'intérêt de la justice internationale et en solidarité avec les victimes de crimes de masse. Dans les années passées, le président el-Béchir a annulé un voyage prévu en République centrafricaine pour les célébrations de l'indépendance à Bangui en décembre 2010 à la suite des appels à son arrestation, et le projet de voyage prévu par le Président au Kenya a été contrecarré en octobre 2010 avec le déplacement d'un réunion de l'Autorité intergouvernementale pour le développement de Nairobi à Addis-Abeba. La réduction du nombre de déplacement du président el-Béchir envoie un signal fort selon lequel, en tant qu’auteur présumé des pires crimes connus de l'humanité, il n'est pas le bienvenu et devrait être arrêté et répondre à la justice devant la Cour pénale internationale.

Déjà le 13 décembre 2011, suite à la visite du président El -Béchir au Tchad, la Chambre préliminaire I avait conclu à la violation par le Tchad de son obligation de coopération et avait transmis, par l'intermédiaire du président de la CPI, cette décision au Conseil de sécurité.

Pour toutes ces raisons, nous demandons au gouvernement tchadien d'affirmer clairement sa volonté de coopérer avec la CPI, comme l’ont déjà fait l'Afrique du Sud, l'Ouganda et le Botswana, le Burkina Faso et le Malawi, et de préciser que si le président el-Béchir se présentait sur le sol tchadien il serait arrêté. Ce serait un moyen important de faire preuve de respect pour les victimes des crimes commis, ainsi que l'engagement du Tchad à mettre fin à l'impunité.

هنالك همس في اروقة النظام التشادي بأن البشير طلب زيارة الي شرق تشاد الي منطقة الطينة بالتحديد
فابشروا اهلنا هنالك فان المجرم يحمل راسه الفاسق بين يديه ويأتيكم في دياركم
فان ابسط شئ يتم قبضه ...
من المعلوم ان عموم المنطقة ابتداء من معسكر ابونبق مرورا بالطينة التشادية ثم السودانية ثم الي كرنوي وام برو ومسبت شرقا
وطنطباي وجريرة جنوبا او قمرة شرقا والمزبد جنوبا لا يوجد بيت الا وقتل البشير منهم افراد ها الان يريد ان يدذهب ويرقص
علي جماجمهم فان ذبحه من الوريد الي الوريد ابسط ما يقدمه نازحوا المنطقة ....
ما ارخص السلاح
نطالب حكومة الجنرال ادريس دبي بالتعاون في الخلاص من المجرم وليعلم ان حسين هبري في طريقه الي المحاكمة بفعل جرائم ارتكبه في نفس المنطقة علي الارجح
وجرائم هبري لا يساوي الواحد علي المائة من جرائم المجرم الهارب من الجنائية الدولية عمر البشير
انشاء سوف يكون هنالك اخبار سارة لاهل السودان
