A Petition to the National Election Commission via the Sudan Embassy in Norway

Sudanese Citizens in the Diaspora Denounce Disenfranchisement During Voter Registration for the General Election in 2010 by the unlawful decisions of the Sudanese National Election Commission.

We the Sudanese Citizen in the Diaspora aware of our rights and duties and upholding of basic freedoms as enshrined in

• The Interim National Constitution of the Republic of the Sudan, 2005"
• African Charter on Human and Peoples' Rights article 13
• The international convention on civil and political rights

In pursuit of democratic principles that requires leadership over the people is endorsed or appointed by popular participation of the people through periodic election,

Recognizing that Sudan will soon call its citizens to exercise their freedom in the mandatory election in April 2010 as required by the Comprehensive Peace Agreement CPA and provided for by the Interim National Constitution and the Interim Constitution of South Sudan and the National Election Act of 2008; protest strongly the set devious electioneering moves in the form of a seemingly innocuous calendar that NEC has set up.

It is the desire of Sudanese citizens in the Diaspora to have the elections held on time and in accordance to the CPA that clearly stresses the amendment of all the laws that do not promote democratic transformation in the Sudan, prior to any election process. This is crucial for any credible, free and fair elections.

The Sudanese Diaspora Community in Norway was dismayed by the initial list of the countries approved to participate in the registration, and subsequent voting exercise. The initial Diaspora list, which included Kuwait, United Arab Emirates (UAE), Kingdom of Saudi Arabia, Egypt, Qatar, Sultanate of Oman, Bahrain, UK, US and Belgium was an ill-informed NEC decision that excluded registration of many aspiring voters. Setting absurdly short duration limits on voter registration all but guarantees a low turnout.

Other countries right at the doorstep of the Sudan, such as Kenya, Uganda, and the Democratic Republic of the Congo (DRC), to mention just a few, were initially excluded. After serious concerns were raised by the Sudanese in the Diaspora, NEC added Kenya

Uganda, Canada South Africa, and Malaysia. We the Sudanese Diaspora in Norway, considers this decision sorely impartial; there is a need to add more countries.
Firstly, we do not agree with the strict documentations requirements. The requirements of Sudanese passport, National ID and birth certificate as proof of citizenship in order to be registered to vote is a slap in the face for the Marginalized masses of the Sudan, most of whom were born either in a refugee camps or villages, where such required documents are naturally rare, because birth certificates are normally issued by hospitals and related modern facilities, these are rarely available for persons born in villages. This is the general case for majority of the marginalized Sudanese. Such criterion is merely unjust, suggesting that other fair criteria should be instituted.
Secondly, selection of registration/polling centers leaves even more to be desired. For instance, in western Continental Europe, there is only one registration center, Brussels; Sudanese live and work in various countries in Europe, hence logistically it is a strain on them to travel to register Brussels! In Norway alone we have over 400 Sudanese that are eligible to register, how are they to be transported to Brussels to register? This decision by NEC violates the fundamental rights of Sudanese Citizens in the Diaspora granted by the interim constitution of 2005. It creates many obstacles so that no one will be able to register and subsequently vote.

As people upholding our democratic rights, we reject this approach and demand NEC note the logistical difficulties and device a pragmatic solution to rectify the problems with immediate effect.
By rejecting these ill-informed myopic moves by NEC, we urge the Norwegian Government, the European Union, The IGAD Partners Forum, other concerned peace loving groups to diplomatically intervene immediately since registration is 37 days beginning November 1, 2009 and to examines our recommendations to reverse this inevitable disastrous elections consequences. Common sense calls for pragmatic engagement with the International Community to see to it that Sudan stays peaceful and conducts peaceful National Elections, we therefore appeal to the International Community, Civil society, Think Tank, NGOs and educational institutions to proactively engage.
We thus urgently recommendations the points to pave the way for a fair and democratic elections process
• Extend the registration period from one month to three ending January 30th 2010 to allow uninterrupted registration of all citizens in Sudan and in Diaspora.
• The voter registration centers in Brussels for Europe, is not enough we call that vote registration center be established in Norway at the Sudan Embassy.

addition the following Countries should be included to the already existing list of NEC if not yet included in the registration/voting process: Norway, Sweden, Finland Denmark, Germany and Australia.
• The Election Law says in Chapter 3, Section 2, Paragraph 22, Part 3, that Sudanese abroad must have a Sudanese passport and a valid visa in her/her country they reside in to be eligible to register and vote should revised immediately. Any Sudanese with a passport, permanent residency card, temporary residency card, political asylum documents, refugee document in the country of residence or domicile indicating Sudan as a place of birth and or Sudanese citizen as well as their eligible children must be allowed to register and vote.
• In Norway, NorDem as a third party should be involved in safe-keeping and management of the registration/voting data.
Failure to correct this during these preliminary stages will result in the election exercise being fraudulent, rather than being executed following a pattern of true democratic process of transparency and accountability. The thirty days registration period, the selected registration Centers are designed in such a way, by the time Sudanese try to obtain documents of eligibility to register, the time will have expired and therefore disenfranchising majority of Sudanese in Diaspora as well in Sudan.
The resources for logistics, registration and voting in Sudan and Diaspora is the responsibility of National Elections Commission ( NEC) who officially requested assistance from UNDP, therefore, we urge NEC to seriously live up to its obligations

نحن المواطنين السودانيين في الشتات نستنكر أي محاوله لحرماننا من حقنا في اللانتخابات العامة في عام 2010 من خلال القرارات غير المشروعة للجنة الانتخابات الوطنية السودانية.

ولادراكنا التام بالحقوق والواجبات وإعلاء شأن الحريات الأساسية على النحو المنصوص عليه في

• الدستور الوطني الانتقالي لجمهورية السودان ، 2005 "
• الميثاق الأفريقي لحقوق الإنسان وحقوق الشعوب ، المادة 13
• والاتفاقية الدولية بشأن الحقوق المدنية والسياسية


وعلى نحو ما يقتضيه اتفاق السلام الشامل واتفاق السلام الشامل المنصوص عليها في الدستور الوطني الانتقالي والدستور الانتقالي لجنوب السودان واللجنة الوطنية لقانون الانتخابات لعام 2008 ؛ نحتج بشدة على الاساليب الملتوية للجنة الانتخابات الوطنية التي شكلت.

انها رغبة المواطنين السودانيين في الشتات أن الانتخابات التي أجريت في الوقت المحدد وفقا لاتفاق السلام الشامل الذي يؤكد بوضوح على تعديل جميع القوانين التي لا تشجع على التحول الديمقراطي في السودان ، قبل الشروع في أي عملية انتخابية. هذا أمر بالغ الأهمية لأية مصداقية ، انتخابات حرة ونزيهة.

الجاليه السودانيه بالنرويج تشعر بالاستياء لعدم تضمنها القائمة الأولية للبلدان التي صدرت ، وبعد عملية التصويت. الأولي قائمة الشتات ، والتي شملت الكويت والامارات العربية المتحدة (الإمارات) ، المملكة العربية السعودية ، مصر ، قطر ، سلطنة عمان ، والبحرين ، والمملكة المتحدة والولايات المتحدة وبلجيكا

اولا نحن لا نتفق مع المتطلبات الصارمة وثائقها. شروط جواز السفر السوداني ، الهوية الوطنية وشهادة الميلاد كدليل على الجنسية من أجل أن تكون مسجلة في التصويت . ونعتبرها صفعة في وجه الجماهير المهمشة في السودان ، ومعظمهم إما ولدوا في المخيمات والقرى ، حيث انه يصعب الحصول علي هذه المستندات ، وذلك لأن شهادات الميلاد هي عادة الصادرة عن المستشفيات والمرافق ذات الصلة الحديثة ، وهذه نادرا ما تكون متاحة للأشخاص الذين ولدوا في القرى. هذه هي الحالة العامة لمعظم السودانيين المهمشين.

وثانيا ، القرار الذي اتخذته لجنة الانتخابات الوطنية بما يتعلق باختيار مركز واحد في عرب اوربا بروكسل نري انه ينتهك الحقوق الأساسية للمواطنين السودانيين في الشتات التي يمنحها الدستور المؤقت لعام 2005.

ونحن نرفض هذا النهج ونطالب اللجنة الوطنية للانتخابات لإجاد حل عملي لمعالجة هذه المشاكل وبشكل فوري.
إننا نحث الحكومة النرويجية ، والاتحاد الأوروبي ، ومنتدى شركاء إيغاد ، وغيرها من الجماعات المعنية ، لذا و المجتمع الدولي ، والمجتمع المدني ، للمفكرين والمنظمات غير الحكومية والمؤسسات التعليمية لإشراك فعال.
لتمهيد الطريق لعملية نزيهة وديمقراطية للانتخابات المقبله.
