RIYADH, Saudi Arabia (AP) — A Saudi court sentenced a woman who had been gang raped to six months in jail and 200 lashes — more than doubling her initial penalty for being in the car of a man who was not a relative, a newspaper reported Thursday.
The decision by the Qatif General Court came in a case that had sparked rare debate about the kingdom's justice system when it surfaced more than a year ago.

In its decision Wednesday, the court also roughly doubled prison sentences for the seven men convicted of raping the 19-year-old woman, the Arab News reported on its English-language website.

According to Arab News, the court said the woman's punishment was increased because of "her attempt to aggravate and influence the judiciary through the media."

She had initially been sentenced to 90 lashes after being convicting her of violating Saudi's rigid laws on segregation of the sexes.

Under Saudi Arabia's interpretation of Islamic Sharia law, women are not allowed in public in the company of men other than their male relatives.

The initial sentences for the men convicted of the gang rape ranged from 10 months to five years in prison. Their new sentences range from two to nine years, the paper said.

The attack took place in 2006. The woman has said that it occurred as she tried to retrieve her picture from a male high school student she used to know. While in the car with the student, two men got into the vehicle and drove them to a secluded area. She said she was raped there by seven men, three of whom also attacked her friend.

Reports of the story triggered debate about Saudi Arabia's legal system, in which judges have wide discretion in punishing a criminal, rules of evidence are shaky and sometimes no defense lawyers are present. The result, critics say, are sentences left to the whim of judges.

The judges, appointed by the king, have a wide discretion in handing down sentences, often said to depend on their whim. A rapist, for instance, could receive anywhere from a light or no sentence, to death.

The woman was identified in the media only as the Girl from Qatif. The case was referred back to the General Court by an appeals court last summer, after the woman's attorney argued the verdict was too lenient for the rapists and unjust for the victim.

The court also banned the lawyer from defending her, confiscated his license to practice law and summoned him to a disciplinary hearing later this month.

"I explained to them that it was my job to do everything legal in order to serve my client. But they did not listen," the lawyer, Abdul Rahman al-Lahem, was quoted by the paper as saying.

جماعي من قبل عدد من الشبان. لكن محامي الفتاة اعتبر الحكم مناقضا للشريعة الإسلامية.

وكانت محكمة سعودية قد اصدرت سابقا حكما اوليا على المرأة لاتهامها بما يعرف بـ "الخلوة غير الشرعية".

وعندما استأنفت المرأة الحكم الاولي الذي صدر بحقها، اتهمها القضاة بمحاولة استخدام الاعلام من أجل التأثير على سير المحاكمة.

في المقابل، ضاعفت المحكمة عقوبة المعتدين على الفتاة من 5 اعوام الى 10 اعوام من السجن.

وحسبما اشارت الصحف السعودية، فان الفتاة البالغة من العمر 19 عاما والتي تنتمي لعائلة من الاقلية الشيعية في السعودية قد تعرضت منذ نحو عام ونصف الى الاغتصاب 14 مرة في المحافظة الشرقية في البلاد.

وقد أدانت المحكمة سبعة رجال من الطائفة الشيعية وتراوحت أحكام السجن الصادرة ضدهم بين أقل من عام وخمسة اعوام.

لكن الضحية عوقبت أيضا بسبب ما اعتبرته المحكمة انتهاكا لقانون سعودي يتعلق بالفصل بين الجنسين ووجهت بها اتهاما بموجي ما يعرف بـ "الخلوة غير الشرعية". ويحرم هذا القانون الرجال والنساء من الاتصال ببعضهم البعض. وقد حكم عليها في بادئ الأمر بتسعين جلدة بسبب وجودها في سيارة مع رجل غريب.

"الخلوة غير الشرعية"
وقال محامي الفتاة، عبد الرحمن اللاحم أن الحكم "يثير الدهشة" واعتبره مخالفة "لأحكام الشريعة والإتفاقات الدولية بهذا الشأن"، مشيرا إلى "مخالفات" أخرى من قبل المحكمة بينها منعه من الترافع عن موكلته في جلسة النطق بالحكم.

وقال اللاحم إن الحكم على "موكلتي وهي ضحية لجريمة بشعة يخالف أحكام الشريعة والاتفاقات الدولية"، مضيفا أنه كان "يفترض التعامل معها على أساس أنها ضحية وليست جانية".

وأشار المحامي إلى أن مصادرة حق المتهمة بحضور محامي يترافع عنها "أمر غير قانوني"، وأكد لـ بي بي سي ما ذكر عن سحب رخصة مزاولة مهنة المحاماة منه.

وفي ما يتعلق بـ "الخلوة غير الشرعية" قال المحامي إنها "غير متوافرة في هذه القضية" وهو ما قدمه الدفاع أمام القاضي.

وقالت صحيفة اخبار العرب ان المحكمة التي نظرت في حكم الاستئناف قررت رفع عدد الجلدات الى 200 إضافة الى السجن مدة ستة أشهر.

دوافع شخصية
وعلى الرغم من مضاعفة عقوبة المعتدين، فان الحكم لا يزال يعتبر "غير كاف"حسبما ترى الصحيفة.

ونقلت الصحيفة عن احد المسؤولين قوله ان "القضاة قرروا مضاعفة العقاب للمعتدى عليها لانها حاولت التأثير على القضاء من خلال الاعلام".

واتهم المحامي عبدالرحمن اللاحم المحكمة بالسماح لوجهات نظر شخصية بالتأثير على قرارها، موضحا أن الحكم "على ما يبدو" تأثر بـكون "المرأة صعدت الموضوع مع محاميها أمام الجهات القضايا العليا" مشيرا إلى أن الجهاز القضائي "عدم التأثر بالمواقف المسبقة".

وأكد المحامي أنه بعد استلام الحكم سيتقدم بـ "لائحة اعتراضية" عليه وعلى مخالفات أخرى مثل حرمان المتهمة من محام يترافع عنها.

Judge sentences female victim to more lashes than her assailant


AL-AWWAMIYA, Saudi Arabia - When the teenager went to the police a few months ago to report she was gang-raped by seven men, she never imagined the judge would punish her — and that she would be sentenced to more lashes than one of her alleged rapists received.The story of the Girl of Qatif, as the alleged rape victim has been called by the media here, has triggered a rare debate about Saudi Arabia’s legal system, in which judges have wide discretion in punishing a criminal, rules of evidence are shaky and sometimes no defense lawyers are present.

The result, critics say, are sentences left to the whim of judges. These include one in which a group of men got heavier sentences for harassing women than the men in the Girl of Qatif rape case or three men who were convicted of raping a boy. In another, a woman was ordered to divorce her husband against her will based on a demand by her relatives.

In the case of the Girl of Qatif, she was sentenced to 90 lashes for being alone in a car with a man to whom she was not married — a crime in this strictly segregated country — at the time that she was allegedly attacked and raped by a group of other men.

Struggling to forget
In the sleepy, Shiite village of al-Awwamiya on the outskirts of the eastern city of Qatif, the 19-year-old is struggling to forget the spring night that changed her life. An Associated Press reporter met her in a face-to-face interview. She spoke on condition of anonymity to protect her privacy; the AP does not identify rape victims unless they ask to be named.

Her hands tremble, her dark brown eyes are lifeless. Her sleep is interrupted by a replay of the events, which she describes in a barely audible whisper.

That night, she said, she had left home to retrieve her picture from a male high school student she used to know. She had just been married — but had not moved in with her husband — and did not want her picture to remain with the student.

While the woman was in the car with the student, she said, two men intercepted them, got into the vehicle and drove the couple to a secluded area where the two were separated. She said she was raped by seven men, three of whom also allegedly raped her friend.

Lashes for the victim
In a trial that ended in November — in which the prosecutor asked for the death penalty for the seven men — four of the men received between one and five years in prison plus 80 to 1,000 lashes, said the woman. Three others are awaiting sentencing. Neither the defendants nor the plaintiffs retained lawyers, as is common here.

“The big shock came when the judge sentenced me and the man to 90 lashes each,” said the woman. The sentence was handed down as part of the rape trial. Lashes are usually spread over several days, dealt around 50 at a time.

The sentences have yet to be carried out, but the punishments ordered have caused an uproar.

“Because I could make no sense (of the sentence) and became in dire need of patience, I muttered after I read the verdict against the Girl of Qatif: ‘My heart is with you,”’ wrote Fatima al-Faqeeh in a column in Al-Watan newspaper.


Sharia law at issue
Justice in Saudi Arabia is administered by a system of religious courts according to the kingdom’s strict interpretation of Islamic Sharia law. Judges — appointed by the king on the recommendation of the Supreme Judicial Council — have complete discretion to set sentences, except in cases where Sharia outlines a punishment, such as capital crimes.

That means no two judges would likely hand down the same verdict for similar crimes. A rapist, for instance, could receive anywhere from a light or no sentence to death, depending on the judge.

Saudis are urging the Justice Ministry to clarify the logic behind some rulings. In one recent case, three men convicted of raping a 12-year-old boy received sentences of between one and two years in prison and 300 lashes each. In contrast, another judge sentenced at least four men to between six and 12 years imprisonment for fondling women in a tunnel in Riyadh.
Saleh al-Shehy, a columnist for Al-Watan, asked Justice Minister Abdullah Al-Sheik to explain why the boy’s rapists got a lighter sentence than the men in last year’s sexual harassment case.
‘Do you think it satisfies God?’
“I won’t ask you my brother, the minister, if you find the ruling satisfactory or not,” wrote al-Shehy. “I will ask you, ‘Do you think it satisfies God?”

“Please explain to us how one judge ruled and how the other ruled? What evidence did the one rely on and what proof did the other use?” he added.The broad discretion judges enjoy have been a disaster for Fatima, another Saudi woman. She suddenly found herself divorced from her husband, Mansour al-Timani, after her half-brothers went to a judge and told him their sister had married beneath her.

Fatima, whose full name has not been given in media reports, had been married for over three years and was pregnant with her second child when the judge declared the marriage void in July 2005.

Today, Fatima sits in jail with her 11-month-old son — her 4-year-old daughter was recently freed — rather than return to the custody of her family as the judge decreed.

Absence of evidence
The problems over sentencing are exacerbated by loose trial rules, in which physical evidence sometimes is not presented.

The Girl of Qatif said her trial had two sessions. The three trial judges asked for her statement, then heard the statement from the seven defendants in the first court session, according to the woman. In the second, about a month later, the judges pronounced their verdict. It was not known if there were other sessions she did not attend.

Judges in the case referred The Associated Press to the Justice Ministry when asked about the sentencing. The ministry, in a statement Tuesday, said rape could not be proved. There were no witnesses and the men had recanted confessions they made during interrogation, the statement said. It said the verdict cannot be appealed.

Sharia allows defendants to deny signed confessions, according to Abdul-Aziz al-Gassem, a lawyer who was not involved in the case. They still get punished if convicted, but the verdict is lighter.

“The lack of transparency in the investigation, the trial and the sentencing, plus the difficulties that journalists have to get access lead to deep a darkness where everything is possible,” said al-Gassem.

الثانية شابة ابنة التسعة عشر عاما الملقبة بفتاة القطيف، اُغتصبت من قبل عصابة متوحشة، مكونة من سبعة رجال. وحين كُشفت الجريمة وتعرف جهاز الأمن على الجناة، اُدرج اسم الفتاة معهم، بحجة انها كانت بصحبة شاب غريب، في مكان عام. ألبست الفتاة "جريمة الخلوة غير الشرعية." وتم التغاضي تماماً عن جريمة الاغتصاب وحُكم عليها بالسجن 6 اشهر والجلد 200 جلدة؛ هذا هو العدل في عرفهم وشريعتهم. تحولت الضحية الى جانية لانها كانت متواجدة في مكان تواجد فيها ذكور سافلين ومغتصبين. الآن عقيلة تنتظر مرافعة اخرى لكي تستأنف الحكم، لكن كل الشواهد اثبتت ان العدل مغيـّب في قضيتها.

الثالثة، فتاة من الطائف ابنة ستة عشر عاما، تـُعد قاصرة في القانون. كانت تدرس في المرحلة المتوسطة، زُجت في صفقة زواج من قاتل محكوم عليه بالاعدام. والدها محمد الزهراني المجرم المحكوم عليه بالسجن هو من اتم تلك الصفقة. باع ابنته لذلك القاتل، وتم عقد الزواج واحتفل السجناء بتلك المناسبة في سجن الطائف. المأذون بكل فرحة بارك تلك الجريمة، وطلب من ادارة السجن ان يوفروا مكانا وخلوة للزوجين ، كي يمارس القاتل حقه الشرعي كعريس جديد. سمح مدير السجن بخلوة شرعية للسجين اربعة مرات في الشهر، وهذه حالة استثنائية لم توفر لمجرم من قبل. ما المستقبل الذي ينتظر هذه الفتاة؟؟ حياتها سُلمت من يد مجرم "والدها"، إلى يد مجرم آخر زوجها.

تلك الشابات السعوديات الثلاث يمثلن كل نساء السعودية. فاي امرأة سعودية هي معرضة لتلك الانتهاكات، لأنها لا تمتلك حق تقرير مصيرها. فقد ولّي الرجل على كل شؤونها وكل قرراتها الخاصة منها والعامة. الوصاية حين اُعطيت للرجل السعودي جردت المرأة من الشعور بالأمان والطمأنينة. فمتى ما غضب هذا الرجل القائم على شؤونها تحولت الى امرأة بمصير مجهول شديد القتامة. صارت المرأة السعودية أمَة بالقانون، تـُباع وتـُشترى في سوق النخاسة. الى متى ستظل النساء في السعودية ألعوبة في ايدي الرجال حتى لو كانوا مجرمين وقتلة ومدانين وقابعين في السجون؟؟ الى متى سيستمر ظلم النساء مسكوت عنه في مملكة الصمت هذه؟؟ الى متى قضاة السعودية سيظلون يعاملون النساء على انهن خلقن ليلهو بهن الرجال؟؟ هل اصيب المسؤولين في السعودية بصمم وفقدوا البصر والبصيرة ليغضوا الطرف عن كل هذه الانتهاكات الصارخة ضد النساء؟؟ الى متى سيظل النساء يناشدن ويطالبن بحقهن في الحياة والأمان دون ان يسمعهن احد؟؟ أما آن لهذا الظلم ان يترجل؟؟

انتقد وزير الخارجية السعودي الأمير سعود الفيصل الحكم الذي أصدرته محكمة سعودية بجلد امرأة تعرضت للاغتصاب الجماعي، في ما صار يُعرف بقضية "فتاة القطيف".

وقال الفيصل للصحفيين في واشنطن حيث يحضر مؤتمراً للسلام في الشرق الأوسط الثلاثاء 27-11-2007، "مثل هذه الأمور كالأحكام السيئة للمحاكم تحدث في كل مكان حتى في الولايات المتحدة. وهي عملية مازالت جارية. ويجري مراجعة هذا من خلال عملية قضائية ونرجو أن يتم تغييره".

العاهل السعودي يصدر عفوا عن "فتاة القطيف"


اصدر العاهل السعودي عبد الله بن عبد العزيز عفوا عن المرأة التي تعرضت للاغتصاب الجماعي فيما يعرف بقضية "فتاة القطيف"، والتي كان قد صدر بحقها حكم بالسجن لستة اشهر و200 جلدة.

ونسبت صحيفة الجزيرة السعودية إلى وزير العدل السعودي عبد الله بن محمد آل الشيخ قوله "إن هذا القرار لا يعني أن الملك يشكك في القضاء، ولكنه تصرف بما فيه مصلحة الشعب".

ومضى يقول "إن الملك يعمل دائما على تخفيف معاناة المواطنين عندما يتيقن بأن تلك الأحكام سيكون لها تأثيرها النفسي على المحكومين، وذلك مع قناعته بعداله الأحكام".
