Last chance for appeal against death sentences



Case 1

On 31 March 2004 the Criminal Court in Nyala sentenced two men to death by hanging after being convicted under article 130 (Murder) of the 1991 Penal Code. They were charged with killing a man called Adam Mohamed Omer on 14 September 2003 in Nittaiga village in Southern Darfur state. The two men's details are as follows:



1. Ali Salih Ahmed, 28 yrs, farmer, lives in Nittaiga
2. Adam Abdel Rahman Ishag, 27 yrs, farmer, lives in Labado



An appeal has been lodged on January 2004 before the Appeal Court in Nyala and the case remains pending.

Case 2

On 27 December 2003 the Criminal Court in Nyala sentenced two men to death by hanging after being convicted under article 130 (Murder) of the 1991 Penal Code. The two men were charged with murdering a man called Zakaria Shummu Ali on 31 August 2003 in Tandelti village near Yaseen, east Nyala. Their details are as follows:



1. Hassan Alfadoul Adam, 19 yrs, nomad, lives in Rehaid Albirdi
2. Abdel Gadir Ahmed Youseif, 24 yrs, nomad, lives in Wadi Salih



An appeal was lodged before the Appeal Court in Nyala and the sentence was confirmed on 4 Feb 2004. Currently the case has been brought before the Supreme Court in Khartoum to agree for the sentence being carried out.



Case 3

On 24 December 2003 the Criminal Court in Nyala sentenced a man to death by hanging after being convicted under article 130 (Murder) of the 1991 Penal Code. He was charged with murdering a man called Abdel lateef Adam Bashir on 5 September 2003 in Nyala Hey Alsed Al- Ali. His details are as follows:



1. Ibrahim Idriss Imam, 18 yrs, soldier with the armed forces, lives in Nyala Hey Alsalm



The Appeal Court in Nyala confirmed the sentence on 24 February 2004 and
currently the case has been brought before the Supreme Court to agree for the sentence to be carried out.





SOAT is unconditionally opposed to the death penalty and strongly condemns its use by the Government of Sudan. SOAT is gravely concerned by executions occurring in Darfur, and by the procedures of these Criminal Courts, which do not comply with international or national standards for fair trials.



SOAT strongly urges the Government of Sudan to:



i) Abolish the death penalty in Sudan

ii) Ensure respect for rights to fair trial and to legal appeal in accordance with international human rights standards, for all detainees throughout Sudan

iii) Guarantee respect for human rights and fundamental freedoms throughout Sudan in accordance with national laws and international human rights standards

STOP the government of Sudan moves immediately to stop further slaughter and ethnic cleansing, and allow unhindered international humanitarian assistance, the Security Council must be prepared to authorize the use of force, if necessary, to protect those catastrophically at risk.
