النظام الليبي يخرق القانون الدولي ويعتقل موظفي الICC

احتجاز أربعة من موظفي المحكمة الجنائية الدولية في ليبيا: المحكمة تطلب تحريرهم فوراً

منذ يوم الخميس 7 حزيران/يونيو، يتعرض أربعة من موظفي المحكمة الجنائية الدولية للاحتجاز في ليبيا, وطالب رئيس المحكمة، القاضي سانغ ـ هيون سونغ، بالتحرير الفوري لكل موظفي بعثة المحكمة المحتجزين حالياً: "نحن في غاية القلق على سلامة موظفينا، في ظل انقطاع الاتصالات معهم. هؤلاء الموظفون الدوليون الأربعة يتمتعون بالحصانة في نطاق عملهم لصالح المحكمة، في خدمة العدالة الدولية. أطالب السلطات الليبية بأن تتخذ دون إبطاء كل الإجراءات الضرورية لضمان أمنهم وسلامتهم ولتحريرهم فوراً". وتتواصل المحكمة مع الجهات المختصة لتحريرهم على الفور.


وكانت البعثة قد وصلت إلى ليبيا يوم الأربعاء، 6 حزيران/يونيو، إنفاذاً لقرار الدائرة التمهيدية، الصادر بتاريخ 27 نيسان/ابريل 2012، وكان أحد أهدافها أن يعقد المكتب العمومي لمحامي الدفاع، المعين حالياً للدفاع سيف الإسلام القذافي، لقاء خاصاً معه في الزنتان. كما تضمنت البعثة موظفين من سجل المحكمة بهدف مباحثة سيف الإسلام في بإمكانية أن يختار محامياً له. وكانت ليبيا قد أكدت، في مذكرة قدمتها إلى الدائرة التمهيدية الأولى، تسهيلها لقاء سيف الإسلام القذافي بمحاميه. وتم تأكيد هذا الاتفاق لاحقاً في إطار الاتصالات التي انعقدت بين الحكومة الليبية وسجل المحكمة.

وبناء على القرار 1970 المتخذ بإجماع أعضاء مجلس الأمن التابع للأمم المتحدة، والذي أحال الوضع الليبي على المحكمة، فإن على ليبيا موجباً قانونياً بالتعاون الكامل مع المحكمة الجنائية الدولية، بما في ذلك التزام النظام القانوني الذي تتضمنه اتفاقية روما والذي يشدد على حق المشتبه بهم باحترام خصوصية تواصلهم مع محاميهم.

وتأمل المحكمة الجنائية الدولية أن يتم حل هذا الوضع في أقصى سرعة وضمن روحية التعاون التي سادت حتى الآن بينها وبين السلطات الليبية.

Four ICC staff members detained in Libya; Immediate release requested

Four staff members of the International Criminal Court (ICC) have been detained in Libya, since Thursday, 7 June. The ICC President, Judge Sang-Hyun Song, requests their immediate release: “We are very concerned about the safety of our staff in the absence of any contact with them. These four international civil servants have immunity when on an official ICC mission. I call on the Libyan authorities to immediately take all necessary measures to ensure their safety and security and to liberate them”. The ICC is communicating with the relevant authorities of Libya to ensure their release.

In accordance with the Pre-Trial Chamber I decision, dated 27 April 2012, the delegation travelled to Libya on Wednesday, 6 June, to meet with Saif Al-Islam Gaddafi in Zintan, in part as a privileged visit by the Office of Public Counsel for the Defence, currently appointed to represent Mr Gaddafi in the case brought against him. The delegation also included members of the ICC Registry with the view of discussing with Mr. Gaddafi the option to appoint counsel of his own choosing. Libya made a submission to the Pre-Trial Chamber ensuring that it would facilitate access to Mr Gaddafi by his lawyers. This agreement has been further confirmed during the contacts between the Libyan government and the ICC Registry.

In accordance with the unanimous resolution 1970 of the United Nations Security Council, which seized the ICC with the Libyan situation, Libya has the legal obligation to fully cooperate with the ICC, including the respect of the legal regime imposed by the Rome Statute which emphasizes the rights of the suspects to have privileged contacts with their lawyers.

The ICC hopes that the situation will be speedily resolved in the spirit of the cooperation that has existed between the Court and the Libyan authorities.

Alexander Khodakov

Mr Alexander Khodakov, 60 years old, was born in Moscow, Russia. He is the External Relations and Cooperation Senior Adviser at the Registry of the ICC. Before joining the ICC in September 2011, he worked at the Organization for the Prohibition of Chemical Weapons (OPCW) for 7 years. He is a Russian national career diplomat and was the Ambassador Extraordinary and Plenipotentiary to the Kingdom of the Netherlands from 1998 to 2003. Mr Khodakov is married and has two children.








Esteban Peralta Losilla

Mr Esteban Peralta Losilla, 48 years old, was born in Zaragoza, Spain. He is the Chief of the Counsel Support Section at the ICC where he has been working since 2003. Before joining the ICC he was professor of Public International Law at the University of Zaragoza. He is married and has 2 children.








Helene Assaf

Mrs. Helene Assaf, married, born in 1979 in Lebanon, is an ICC translator and interpreter since 2005, with both legal and translation background. She takes part regularly in ICC missions to provide interpretation services to victims, witnesses, counsel within Defence teams and ICC officials.









Melinda Taylor

Mrs. Melinda Taylor, 36 years old, is Australian national. She has been working at the ICC since 2006 as counsel in the Office of Public Counsel for the Defence (OPCD).

The OPCD have been appointed on 6 December 2011 to assist Saif al-Islam Gaddafi by the ICC judges. She is married and has a 2 years old baby girl.
