الاعتقال التعسفي:
1- انتهاك الحق في اخبار الاسرة:
اذا كان الاسلام حسب تفسير الاسلاميين لا يجد ما يوجب
منح المقبوض عليه الحق في اخطار ذويه في نفس لجظة
القبض!!! فهو تفسير مخالف لمبادي حقوق الانسان ومخالف
ايضا للتفسير السليم للاسلام حسب نظر المعتدلين من المسلمين
لكن امامنا هذا هو التفسير العملي الممارس لنظر الاسلام
ولا اظن اننا في يوم من الايام سنحتاج لمن ياتي ليقول لنا ان
الاسلاميين يرون ان ذلك من الحقوق المكفولة للمقبوض عليه
في الاسلام او بالاحري حسب تفسيرهم للاسلام. فاخر دليل
لينا هو هذا الحادث الذي كان عبد القادر فك الله اسره شاهدا عليه.
وفي الجانب الاخر يمكن ان نقول بكل اطمئنان ان الاسلاميين في
ذلك لا يطبقون الاسلام بل يطبقون تفسيرهم الضيق للاسلام
لانه علي الاقل عدد مقدر من المسلميين يعرف بالفطرة ان
ذلك ليس من اخلاق البشر قبل ان يكون من صميم تعاليم اديانهم
ان تغل يد المحبوس عن اخطار ذويه بمكان اعتقاله اذا كان لا سبيل
لاخطاره بسبب الاعتقال في تلك اللحظة او بعدها بيوم او يومين او
اسبوع في حال عبد القادر وشهور كما نعلم.
لكن القانون الدولي لحقوق الانسان علي العكس جعل هذا الاخطار
احد اسس اعمال العدالة واحد الضوابط الكفيلة بضمان سلامة
الشخص المقبوض عليه، وضمان سير العدالة بحقه.
ومن ينكر هذا الحق للمقبوض انما يرمي عن طريق المخالفة الي
1- انتهاك سلامته
2- انتهاك اسس العدالة بحقه

بشري قمر المعتقل منذ يناير تمنع عنه الزيارة
وتتفاقم حالته الصحية الي الاسوأ

Unfortunately on the following day (Thursday evening), another call was received cancelling the approved visit for unknown reasons. During the latest visit on 6th October Bushra was found to be in a very bad health condition, furthermore it was confirmed that he went into a second hunger strike on 10th October; we therefore strongly believe that the reason for denying his family access to meet him is either because he is in a very bad condition, after being subjected to severe torture, or maybe his life is in danger, if still alive at all. The family of Bushra Gamar urges all human rights, civil society organizations, and the Indigenous People Rights Network Coordinator to exert maximum pressure on the Sudanese authorities to give him access to his family, provide him with medical treatment and hand him over to the proper judicial authorities to decide his fate. The family believes that their son is innocent and he should not be imprisoned indefinitely on unfounded accusations and baseless rumors. We plead with all concerned organizations to do whatever they can do to save the life of a civil society activist whose guilt was his keenness to help on solving conflicts in Darfur and Southern Kordofan.
