البرلمان الكينى يطالب الحكومة بمنع محاكمة مسئولين امام المحكمة الجنائية الدولية

نيروبي ـ د ب ا:أقر نواب في كينيا اجراء يدعو الحكومة إلى الانسحاب من القانون الأساسي للمحكمة الجنائية الدولية في خطوة تهدف إلى منع محاكمة مسئولين سياسيين بارزين.
وأعلن رئيس هيئة الادعاء بالمحكمة الجنائية الدولية لويس مورينو أوكامبو الأربعاء الماضي أسماء ستة من الساسة في كينيا يعتبرهم بأنهم أكثر المسئولين عن أحداث العنف التي أودت بحياة أكثر من 1100 شخص في أعقاب الانتخابات الرئاسية المتنازع عليها في كانون أول/ ديسمبر 2007.
ومن بين أبرز الشخصيات المتهمة، أوهورو كينياتا نائب رئيس الوزراء ونجل أول رئيس للبلاد و ويليام روتو وزير التعليم العالي الموقوف عن العمل وينتظر التحقيق معه في قضية فساد.
وطرح النائب اسحاق روتو، حليف ويليام روتو، هذه الخطوة مساء الاربعاء للمرة الثانية، موضحا أنه يرغب في محاكمة المشتبه بهم أمام محاكم وطنية محلية.
وأيد النواب الاجراء باغلبية ساحقة حيث يتهم بعضهم المحكمة الجنائية الدولية بأنها محكمة تعود إلى عهد الاستعمار.
وقال وزير الطاقة كيرايتو ميرونجي :' جرى محاكمة الأفارقة المنحدرين من مستعمرات سابقة فقط أمام المحكمة الجنائية.. يجب ألا نسمح لأنفسنا طواعية بالعودة إلى الاستعمارية'.
وأحال الأمين العام السابق للأمم المتحد كوفي عنان الذي توسط في الاتفاقية التي أنهت أعمال العنف، التحقيق في أحداث ما بعد الانتخابات إلى المحكمة الجنائية الدولية بعدما لم تؤسس كينيا محاكم محلية.
ومع ذلك يرى نواب كينيون أن إقرار دستور جديد هذا العام يعني أن البلاد ستكون قادرة على محاكمة المشتبه بهم محليا.

Kenya MPs vote to leave ICC over poll violence claims


Kenyan MPs have voted overwhelmingly for the country to pull out of the treaty which created the International Criminal Court in The Hague.

The move comes a week after the ICC prosecutor named six Kenyans he accuses of being behind post-election violence.

The prosecutor's list included senior politicians and civil servants.

The MPs do not have the power to effect any immediate change in relation to the ICC but they have sent a message to government to start withdrawing.

Some 1,200 people died and more than 500,000 fled their homes in the violence following the disputed election in December 2007.

It ended when President Mwai Kibaki and his rival Raila Odinga agreed to share power, with Mr Odinga becoming prime minister.

In the peace deal they signed it was agreed perpetrators would face justice in Kenya or at the ICC in The Hague.

'Face of impunity'

The BBC's Will Ross in the capital, Nairobi, says if the government backs the MPs' call it would take at least a year for Kenya to formally withdraw from the ICC but active cases would not be halted.

The naming of the six suspects sent a thunderbolt right to the heart of Kenyan politics, he says.

On the list was Uhuru Kenyatta, the deputy prime minister and son of the country's first president, Jomo Kenyatta.

Also included were other senior politicians - allies of both the president and prime minister - and the former head of the police force.

During the late-night session, the MPs decried the ICC as a colonial, anti-African court and said that Kenya was surrendering its sovereignty.

"It is only Africans from former colonies who are being tried at the ICC," Kenya's Daily Nation paper quotes Energy Minister Kiraitu Murungi as saying.

"No American or British will be tried at the ICC and we should not willingly allow ourselves to return to colonialism,'' he said.

Only one MP, Martha Karua, the former justice minister, offered a different view.

"The ICC did not come to us. We beckoned it," she said.

"If Kenyans were wondering about impunity, this is the face of impunity."

Our reporter says that some MPs had believed it would take many years for the wheels of justice at the ICC to start turning.

That is why they had opted for the international court rather than a local tribunal.

He says they were shocked when ICC prosecutor Luis Moreno Ocampo named the suspects because for the first time in Kenya's history it started to look as though the untouchable political elite might finally be held to account.

Kenyan PM dismisses lawmakers' bid to leave ICC


In an exclusive interview with RFI, Kenyan Prime Minister Raila Odinga on Thursday said that he and the government are opposed to leaving the International Criminal Court. This is despite a motion passed by lawmakers late Wednesday which urged Kenya to withdraw from the Rome Statute that established the ICC.

Odinga said the MPs were venting their anger and frustration at the naming of six high-profile Kenyans by ICC prosecutor Luis Moreno-Ocampo.

Three cabinet ministers, the cabinet secretary and a former police chief were among the six men named last week, accused of being masterminds of the post-election violence.


The motion was passed during a late night session - with some MPs labellingthe ICC as "colonial" and "anti-African".

But Odinga told RFI that nobody should pay attention to the motion.

"It cannot help anybody because the process that has started cannot be stopped, even if the country were to decide to pull out of the ICC today," Odinga said.

"This is part of our constitution which requires a referendum to change ... A mere vote in parliament is just an expression of opinion and does not hold any legal weight."

An ICC trial may destabilise Kenya's fragile coalition, formed by President Mwai Kibaki and Odinga to end the violence that followed the disputed presidential polls of December 2007.
