المحكمة الدستورية العليا في البرازيل تدرس الجوانب القانونية في اعتقال البشير على اراضيها

بعثت وزارة الخارجية البرازيلية مذكرة توقيف البشير للمحكمة في يوليو الماضي لإبداء الرأي القانوني في اعتقال وتسليم البشير متى وجد على اراضيها وطلبت ان يعامل الأمر بسرية ولكن تم رفض الطلب على اعتبار ان الأمر ليس سرا

الحكومة البرازيلية كانت قلقة حيث ان البشير كان مدعوا لفنزويلا وبالتالي من المرجح ان يعبر أجواء البرازيل ويجب حينها ان تجبر طائرته على الهبوط

المحكمة العليا البرازيلية فالت في تقييم اولي ان هناك تعارض بين ميثاق روما والدستور البرازيلي الذي يحظر السجن مدى الحياة وبالتالي يجب ان تدرس نوع العقوبة التي ينوي الإدعاء طلب بتوقيعها على البشير
