InterNational Human rights declaration & double standards

    INTRODUCTION
    Human rights issue occupies the attention of mankind and continued to be the focus of concern of the different population groups from the village, the city, the region ,the states and the international community level at large.
    The international concern with the issue of Human Rights has begun since an immemorial time. Human rights principles were derived from religious beliefs that uphold the values of mankind and call for removal of injustice.


    The humanity ceaseless endeavor and protracted search to legalize the human rights ,were preceded by heaven holy books as protection of the human beings . The Islamic religion in particular was the leading and the pioneer in this respect and the preaching’s of prophet Mohamed and the practices and statements of early Guided Caliphs stand as evidence of the concern of Islamic religion with human rights. The principles of Islam and the preaching’s Prophet Mohamed ( peace and blessings be upon him)
    are supposed to be the preamble of the International Declaration of Human Rights if peoples were well aware of the essence and the reality of religions and the Islamic religion in particular.T Islam
    has preceded the international charters and agreements that tackled the issue of human rights in a view that it has been authenticating and defending human rights for 14 centuries. We can say that the content of the International Declaration on Human Rights, the consequent conventions and the UN charter are all echoes of the teachings of Islam. Islam has honored the mankind and has established all the human rights. It further considers them not only as recommendations but also as duties and obligations. The State is responsible to maintain these rights and the Ruler is to make sure that human rights are guaranteed for the all. The Islamic Order of human rights is more comprehensive and includes all rights and has not ignored any right while International Declaration of Human Rights confined the rights in30 ones.
    We can say that all the principles of Human rights of nowadays – Freedom, Equality and Brotherhood - which have been mentioned in the international Declaration of Human Rights, are called for in the Holy Qur’an.
    The new vision for this order was presented by the international expert Dr. Ahmed Al-mufti and it will be our resource for the ideas in this file
    Universal Declaration of Human Rights
    Adopted and proclaimed by General Assembly resolution 217 A (III) of 10 December 1948
    On December 10, 1948 the General Assembly of the United Nations adopted and proclaimed the Universal Declaration of Human Rights the full text of which appears in the following pages. Following this historic act the Assembly called upon all Member countries to publicize the text of the Declaration and «to cause it to be disseminated, displayed, read and expounded principally in schools and other educational institutions, without distinction based on the political status of countries or territories.»

    PREAMBLE

    Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world, Whereas disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind, and the advent of a world in which human beings shall enjoy freedom of speech and belief and freedom from fear and want has been proclaimed as the highest aspiration of the common people,
    Whereas it is essential, if man is not to be compelled to have recourse, as a last resort, to rebellion against tyranny and oppression, that human rights should be protected by the rule of law,
    Whereas it is essential to promote the development of friendly relations between nations,
    Whereas the peoples of the United Nations have in the Charter reaffirmed their faith in fundamental human rights, in the dignity and worth of the human person and in the equal rights of men and women and have determined to promote social progress and better standards of life in larger freedom,
    Whereas Member States have pledged themselves to achieve, in co-operation with the United Nations, the promotion of universal respect for and observance of human rights and fundamental freedoms, Whereas a common understanding of these rights and freedoms is of the greatest importance for the full realization of this pledge,


    Now, Therefore THE GENERAL ASSEMBLY proclaims THIS UNIVERSAL DECLARATION OF HUMAN RIGHTS as a common standard of achievement for all peoples and all nations, to the end that every individual and every organ of society, keeping this Declaration constantly in mind, shall strive by teaching and education to promote respect for these rights and freedoms and by progressive measures, national and international, to secure their universal and effective recognition and observance, both among the peoples of Member States themselves and among the peoples of territories under their jurisdiction.

    Stages of International Declaration
    Resources and Objectives
    Director of Khartoum International Centre for Human Rights Dr. Ahmed Al-Mufti i classified the fifth stages of the Human Rights and the resources as follow:
    • *The first stage was philosophical one based on the hypothesis and the thoughts of philosophers and their visions of an imaginary world based on ideals values free of evils.
    • * The second stage coincided with the coming of Christianity and as it was known that all religions propagate for human rights and the human right draw its authority from the religions which considerthese rights as sacred ones . Unfortunately, the religious men exploited the religion at that time for political purposes ,the matter that caused the uprising and revolutions in France and in Russia calling for right and justice.
    • *The third stage was characterizes by the new slogans which derived the right from the imaginary philosophies of the first stage which called for ( equal rights and democracy) and of the religious values of the second stage as well. As these slogans were bearing religious principles, they succeeded in changing the life in Europe and the European revolutions adopted most of these principles as fraternity , justice and equality.
    • * The fourth stage During this stage it was essential to legalize these slogans as rights and to be included in the constitutions’ and laws but the matter was too difficult to apply and only a partial legalization was achieved( the right of work and the rights of minorities) before the foundation of the League of Nations . The target of this partial legalization was associated with political targets aiming to create stability inside the states and to protect the minorities after the collapse of the colonization in some states.
    • *The fifth stage witnessed the comprehensive legalization of the human rights in 1945 as the date of the birth of new international order , the international Declaration of Human Rights and this is so clear in the preamble of the United Nations which states to save generations from the scourges of war, to respect human rights and not to use force_

    The absent Vision
    Dr. Mufti explained that when the allies achieved the triumph in the Second World War, and drafted the International Declaration of the Human Rights in 1948,most of the Arab and Islamic world were directly under the British and the French Colonization or under trusteeship Therefore, their religious beliefs and views were not taken into consideration as they belong to the third world .Consequently, the Islamic and Arab vision was not contained in the International Declaration of Human Rights.
    When Scrutinizing the 30 articles of the International Declaration of Human Rights, we will apparently notice the absence of the religious spirit and the comprehensive values which all religions and the Islamic religion in particular call for .
    It is obvious that the West is planning to deepen and enhance the absolute materialistic values and seek to adopt them as the ideal principles and model to be adopted and followed.Also, they intend to ignore the three quarter of the world population as they belong to the African, Arab and Islamic world
    Most of the issues and the accusations against the Islamic and Arab world, concentrate on violations of human rights in these states but through an unbalanced double standard. Organizations concerned with rights say that situations of human rights are bad in the Islamic and Arab region although these Organizations are witnessing the violations of human rights in Afghanistan, Somali, Palestine, Shish an , Lebanon, and in Iraq (Abu Ghuraib) Prison which represent an apparent violation of all human values and in Guantanamo Prison , which is shame in the face of the West civilization which claims protection and preservation of human rights and at the same time ignore the major negative actions they commit and focus on the minor violations in the Islamic and Arab world and describe them as major sins.
    Islam
    ISLAM : The New vision for the ideal system of human rights
    Dr. Ahmed Al-mufti sees that the relation between the Interrnational Declaration of Human Rights and religions are similar in general with regard to the essence and the principles of respecting and preserving human rights which the Declaration calls for , religions have called for observing these rights before many centuries. “ Not only that but the rights the religions call for are not confined only in the thirty ones contained in the International Declaration of Human Rights but they are more comprehensive “ Al-mufti said. He explained that the Islamic religion contains all the principles of this system and adds more and more rights, calling for an alliance among civilizations rather than conflicts as seen now in the media. He pointed out that in Islam there is religious and legal commitment and this would have positive effect on the international community , because in Islam if you are not abide by the orders, AllAH watches you but in man- made law you are watched by no body. Moreover, rights in Islam include other rights not included in the International Declaration as the right of education, neighbourhood ,health , adoption and the old.
    Islam enacted the following rights
    1- Parents right
    2- Right for neighborhood
    3- Right of Muslim towards a Muslim
    4- Right of the employee
    5- Right of the ruler over his subordinates
    6- Right of the spouse
    7- Nation right
    8- Domestic animals right a
    9- Right of Children in Education
    10- Rights of Non-Muslims (Jewish, Christians and other non- religious groups)

    International Declaration of Human Rights
    & DOUBLE STANDARDS
    The International Declaration of Human Rights which was adopted on January 10th,represents an step towards the slaw development of the protection of human beings. The principle of conclusiveness domains this declaration in which each items bears the same importance. But this declaration sometimes turns into a weapon hold up by the big powers against some states. One of the most powerfull state in the world which enjoys democratic institutions and possesses the merits of economy and security, practices the absolute influence and dominance on the other states .This State has for along period been a model for a political and a social system that respects the basic rights and has been the pioneer for the human rights, the democracy , freedom and justice . Later we discovered the contradictions with regard to the policies it follows in many cases. While it claims to be abided by the idealism of” Wilson” to defend the human rights, and freedom all over the world , the realists see that the United States should not ignore its interests where academics and political analysts support that trend and warn that sometime the idealism is dominant over the foreign policy calling for a compromise between idealism and interest.

    Marshal Plan for West Europe
    This plan is an apparent example of the exploitation of the US to the Western states. The dollars which were extended for France and Belgium nearly amounts to the money deducted from the Funds of these two states to finance the American troops sent to commit atrocities in East South Asia. Moreover, the rehabilitation of Europe was carried out in away far from the aspirations of the Resistance Movement and on the contrary it satisfied the supporter on the Nazi Regime. Moreover, Marshal Plan have opened doors for American investors to invest in Europe putting the base for flow of capitals in dollars under the protection “of American force shield “within a foreign negative intervention. It succeeded in playing a major role in restoring the balance resulted from the flee of European Capitals towards the US. The huge fund distributed through Marshal Plan did not represent the resources allocated for the reconstruction of Europe .Nonetheless, it reflected the amount of funds necessary for facing tension and fluctuations of capitals which economists anticipated to exceed the actual aid provided by American tax payers for(. rich European and New York Banks)
    Helping GOVERNMENT TORTURING PEOPLES
    American human rights expert Laris Sholtz, disclosed that American aid always extend to governments that practice torture against the people and to those who violate human rights . Such practice was apparent in the military assistance which neglect the needs of the countries .The Economist Edward Herman expresses in his studies the same practices in the investment. There was a link between extending aid and violations of human rights.
    Violations of International Financial Institutions
    In Geneva Conference non of the advocators of the International Declaration of Human Rights tackled the issue of the Violations of International Financial Institutions. But , during a general a hearing session organized by an NGOs the interventions of legal men , activists and universities academics indicated the violations of International Financial Institutions under the consent of the US.

    Right of Migration & return Item 13/2
    If the Americans are not aware of the Iinternational Declaration of Human Rights, some of its item are familiar to them e.g. item 13/2 which states that Everyone has the right to leave any country, including his own, and to return to his country. This principle stirred up demonstrations every year for the rejection of the Soviet Union to allow the Jewish the right of migration .Following the adoption of the Resolution NO. 194 by the General Assembly, it gave the Palestinians the right to return to their home or the right of indemnity if they wish that. This right was assured many times since that date but at the session of the General Assembly in 1993, Clinton Administration decided to change the American official policy and joined Israel in rejecting the resolution NO. 194 but the resolution was taken despite that rejection and was approved by 172 votes against two votes but the first part of item 13/2 lost all its jurisdictions and the US rejects the second part.
    Persecution
    Article 14.
    (1) Everyone has the right to seek and to enjoy in other countries asylum from persecution.
    (2) This right may not be invoked in the case of prosecutions genuinely arising from non-political crimes or from acts contrary to the purposes and principles of the United Nations.
    Despite this item 78 Tahitisi were arrested during the besiege imposed during Clinton time and were deported …. To their home without any trial with the inauguration of Vienna Conference.
    The legal justification for their return was that those people were fleeing from poverty but not from persecution imposed by the military Junta. The American Administration declined to justify this clever analysis .Aliet Solino pointed in her report on Vienna Conference that some of the NGOs severely accused the American Government for not fulfilling Clinton promises concerning the human rights . The decision to use force to return back the Haiti ( Boat People ) who are seeking political asylum was atragic one. This case proves that Washington commitment towards the human rights is just “ lip service” and it is just a weapon raised against the otherts.The deportation of the Haiti’s to dictatorship of DUVALIER) who has turned Haiti into abase to supply the American Companies) with the manpower. This dictatorship has turned Haiti into (Caribbean Taiwan) as this term is used by USAID.
    The treaty signed between Rigan and DUVALIER) is an authentication of the violation of item 14 and when a military coup overthrown the first elected democratic president Arstied and restore the terror system. The decision of President Bush to return the group of refugees to their torture centre was irresponsible and illegal . When President Clinton became the president , his first decision was to tighten the illegal besiege along with new measures to support the Haiti junta.


    Violation of Civil & Political rights
    Article 13. and Article 14 come within the category of civil and political rights. The International Declaration of Human Rights recognize of another one , the cultural, economic and social right . The West ignore the cultural rights in general. Ambassador Moris Ibraham has ignored these rights saying in 1990 that the basic civil and political rights are contradicting the principle of the Declaration. The same values and principles are leading the international institutions which are controlled by the US,The World Bank and the International Monetary Fund have committed great insult against the human rights as the Chairman of the UN Cultural, Social and Economic Committee, Philip Aleston, at the inaugural session in Vienna> Nori Abdel Raziq, Organization of Afro- Asian people Solidarity, says the the international monetary institutions contribute in the poverty of the people, collapse of environment and violations of the basic rights of the people and the Us exerts no efforts to impose the respect of these rights. The UNICEF estimates that one thousand child die every hour of diseases that could easily be avoided and more than thousand pregnant woman die at pregnancy or at delivery. The UNICEF says that if one quarter of the military expenditure of the developed world ,equal 10 % of the American military expenditure was allocated to achieve basic social service it could achieve a satisfactory level in this sector. During the 90,s the American aid decreased. Moreover, Human Rights Legal Committee pointed out in its report that the US did not pay the amount of 9206 million dollars due to the International Labor Organization the fact that paralyzed the Organization to carry out its work. Following the popular movement in the 60,s The Congress imposed some conditions with regard to the American aid commercial concessions into consideration the human rights . The White House resorted to other ways to avoid this restrictions. The Humanitarian Organizations have condemned Israeal whice receives the lion share of the American aid for torturing the Palestinians and the inhuman treatment of prisoners, executions without trials and other violations. Therefore, the American aid to Israel is illegal according to the American Law as reported by the International Amnesty Organization .
    Imposing Sanctions against States
    The US resorts to impose sanctions against human rights violations or for security needs.805 out of the 116 sanction resolutions were taken in response of US imitative. Some of these sanctions as that taken a against Cuba after 1961were condemned by some states . In 1967 the General Assemly called on the International Monetory Fund to cease its assistance to South Africa but in the second day and upon an imitative from the US and Britain South Africa received more aid than the aid allocated to all Africa.In 1958 and after the US Intelligence failed to arrange general immunity in Indonesia , it resorted to other means to get rid of Sokarno Government . It suspended the American Aid except the military one –and that was the conventional method in arranging military coup. The coup took place in 965and the news regime of Suharto which led to the genocide of half a million or more of farmers but the US Congress did not make any rejection or extended any assistance to the victims. or suggested any sanctions .

    Sanctions against Haiti
    Following the success of elected President Aristid ,the US was annoyed of the failure of its candidate Mark Bazan . As a result ,the US transferred its aid to Aristid anti elements and accepted the applications of political asylum for the
    First time and the military junta succeeded to establish anew terroristic regime and many victims lost their lives. The American trade continued and flourished with the island and increased by 50%.and the relations were so closed. President Aristid was allowed to return to back after three years of terrorism practiced against the popular organization supporting him after he promised to adopt the liberal program of his opponent who has toppled him through the military coup. Many officials at the Ministry of Justice have revealed that the Administrations of Bush and Clinton have impeded the implementation of the boycott by allowing sending of illegal….of oil for the benefit of Haiti military junta and for the rich.
    Sanctions against Cuba
    The economic war launched by the US against Cuba for 35 years stand as a clear example for the unilateral boycott imposed by the US since 1961.It is a unique one as it include sfood and medicines and after the collapse of the Soviet Union , the US escalated the measures of the boycott. This resulted in many damages and the Cuban children exposed to shortage of food and psychological disturbances and to shortage of medicines and health information. Moreover, the boycott has destroyed the improvements and the developments that occurred in Cuba in the field of distribution of potable water and in basic industries. They claimed that these sanctions were imposed because of human rights violations. in Cuba…? This boycott was condemned by the UN many times and Latin America Human Rights Organizations. T he reduction impoded on drugs contradicts the international laws and the new expansion of boycott was condemned. Washington officials see that Cuba threatens the US security.

    Opening Asia Markets for American Tobacco
    The US practices economic war through imposing its law of sanctions on all states that do not subject to GAAT to open Asian markets for American tobacco and for the propaganda for children and women. All countries of the organization launched anti smoke campaigns but they are faced by the American threat of sanction and the American propaganda. E p i d e m i o l o g i s t Ritchard Beto (oxford University) expected that 50 millions of Asian youth –under twenty – would die of diseases associated with smoking.
    War against Drugs
    The US plays a major role in the barbaric actions committed by the government forces and irregular groups in Colombia which is considered as the most famous state in Latin America where human rights are violated and it is the most beneficiary state of the military aid and military experts. The International Amnesty Organization stated that all Colombian units are nearly involved in killing civilians and the convicts by the International Amnesty Organization are using US weapons and continue receiving military training from them.
    The democratic Terrorism against Afghanistan
    On November 2001, the US waged war against Taliban Government in Afghanistan. That war resulted in destruction, catastrophes and scourge on the Afghanistan people where American aircrafts dropped bombs on them . Thousands were killed and many were taken as captives in Guantanamo Prison.The US refuses to treat them as stated in the International Law of War and as stipulated in Geneva Agreement.US Defence Minister Ramisfield, refused to apply that Agreement on the captives or to give their names to the International Red Cross and the American Administration rejected all calls of the Human Rights Organizations and the Amnesty Organization to treat them in a human way .
    Fabricated Allegations of Terrorism Against Arabs & Muslims
    Following September 11th incident in 2002, the American Administration and the Zionist lobby fabricated what they called war against terrorism confining that war against the Arabs and Muslims only. They have attributed any action committed by any individual or gangs all over the world to the Arabs and Muslims to distort the image of Islamic religion. They launched intensive fabricated brain wash campaigns using all false propaganda to convince the people that Islam and Muslims are the source of terrorism.
    Examples of American Terrorism against the World
    The followings are just some of the terroristic operations practiced by the U.S in the second half of 20 th century. Among these examples:
    * The attempt to invade Cuba as the US formed gangs from the Cuban mercenaries trained them and supplied them with all needs to invade Cuba and overthrow Castro. In 1961, these gangs invaded the Island but the Cuban forces succeeded to defeat them in the battle of Pigs Gulf where the attempt was foiled and about 1500 were captured. In 1983 the American forces also invaded Grenada Island under the pretext of the establishment of a pro Soviet-Cuban government. The masses aborted the attempt . The American forces invaded the island to change the elected government and to execute the leaders of the legislative authority in 1985. The US has used all sabotage and conspiracy means to overthrow democratic or socialist systems in the world and in Latin America in particular through organizing or helping military coups and assisting and supporting dictator rulerse.e,g.its intervention in the Domininican in 1965, toppling the popular government in Chilly and the death of the Chilean president Salvador Ulundi , invaded Panama arrested Noriega and sent him to jail. During the war against Vietnam which has extended from mid sixties to the seventies of the 20 century the US has practiced all forms of tortures and terrorism against the Vietnamese people and dropped all kind of bombs all over Vietnam , in addition it has used all chemical ,bacteriological and all prohibited weapons and burnt thousands of hectares of agricultural lands cultivated with rice. During the Gulf War, the US Marine Force dropped down an Iranian civil plane in1988 and killed tens without any reason t justifying that crime and has bombarded the Libyan Presidential Palace .
    As a result of events of Sept 11 a crusade campaign was launched against the Arabs and Muslims with the aim of intimidation and announced the war against 90 states started with Afghanistan, Iraq .Colin Powel revealed that there is a new plot of colonization saying before the Congress on Friday Feb. 7( following the war on Iraq we will rearrange the Middle East area in accordance with our interests).In Afghanistan more than 500 Afghani an. Arab and Pakistani an were slaughtered in three days. The US and Britain prohibited the International Amnesty Organization to carry out any investigations in this massacre. Following the occupation of Iraq on April 9,the American forces killed, slaughtered any one and there are many incidents . Houses were destroyed, breaking into houses at any time to frighten the children and women ,arresting men and stealing all properties. The Iraqi Museum was looted , unemployment rate increased after the

    demobilization of thousands of Iraqi military men and civil service employees and crimes spread and there was no peace and safety.
    The cause of invading Iraq as stated by the US that it possesses Mass Destruction Weapon proved to be false and baseless claim as no such weapons were found. To justify this act of terrorism ,the US claims that it intends to establish and enhance democracy and to liberate the Iraqi people .
    No doubt, the military, financial and logistic support of the US to Israeal which launches organized terrorism against the Palestinians is a clear act of terrorism against the Arabs in general and the Palestinians in particular.
    Since the occupation of Iraq , America threatens to use force and impose sanctions against the people of the world a in general and the Arabs in particular. It threatened Syria, Lebanon and other states to submit to its regulations or they would be classified and faces charges of supporting terrorism and terrorists, closing of PLO offices and intervening in Lebanon sovereignty and ordering Syria to withdraw its forces out of Lebanon, disarm of Hezbollah
    Threatening Iran and Korea to cease their peaceful nuclear program while it overlook the nuclear programm of Israeli. Not only that ,but the US practiced economic pressure against the European states that stood against the war on Iraq as France ,Germany and Russia by preventing them to participate in the rehabilitation of Iraq
    The US adopt the p unilateral policy aims to intimidate the other nations and impose its strategy by force aiming to reshape the world to save its interests and to restore the International Imperialism system. Since the incidents of Sept. 11th, it launches unjustifiable preventive wars against other states which it claims that they are threatening its national security. No doubt it intends to solve its escalated financial ,political and internal crisis through these wars .
