Mexico, France Alstom says barred from Mexico govt tenders for two years Wall Street Journal, 29 July 2004 PARIS -- French heavy engineering company Alstom SA (ALS) said late Thursday it has received notice from the Mexican government that it has been barred from seeking new business with state bodies in the country for two years.
In a legal filing with the French stock market regulator, the Paris-based maker of power station turbines, trains and ships said it received a "resolution" from Mexico's Ministry of Civil Service ordering government entities not to do business with Alstom in connection with a 2001 corruption case.
Alstom said a former unit now owned by French state-controled energy services company Areva (4524.FR) is also the subject of a two-year ban.
Debt-strapped Alstom, recently the subject of of a multi-billion euro state-backed bailout, said it participated fully in the investigation into the case at the time.
"Alstom is examining the order of the Ministry and confirms its intention to look positively to the continuity of its operations in the fields of energy and transportation," the company said.
"Our company is fully committed to the strict compliance of the laws of Mexico and we take the resolution very seriously and with much preoccupation," Alain Toubiana, president of Alstom Mexico, said in the statement.
"From the moment the facts were reported in 2001, through the support in the investigation process, Alstom has collaborated in full openness with the authorities."
Officials of the company in Paris weren't immediately available for further comment.
Mexico's Civil Service Ministry said that in addition to the ban, the companies were fined about $30,000 for acting "deliberately in bad faith" in tenders by Luz y Fuerza de Centro, a state-owned utility that distributes electricity in central Mexico, including the capital city.
The ministry said Areva and Alstom International signed contracts with a company called Inamex SA, which bribed Luz y Fuerza officials in exchange for contract awards. The contracts were for about $3.2 million and $2.4 million, for the acquisition of transformers and switches, the ministry said.
Alstom also has contracts with the Federal Electricity Commission, or CFE, the larger of Mexico's two state utilities. CFE generates more than 90% of the country's power and distributes electricity in the rest of the country.
