Open letter calls for protection of Darfur women

The Minority Rights Group International is sending an open letter to human rights leaders calling for better protection for women in Darfur. Gender officer Katrina Naomi says, “Rape is being used as a tool of war and militias are being allowed to act with impunity.”
From London, she spoke to VOA English to Africa Service about the reasons for the open letter. “The situation in Darfur has been in a bad way for quite a while now. And we feel that in some ways the attention of the world is moving elsewhere. But the number of rapes that are happening on minority women in Darfur, unfortunately, that isn’t lessening, and we felt it was important to try and keep a spotlight on the way that militias are able to rape women with impunity, it seems, in Darfur.”
Asked how UN or human rights officials could pressure the Khartoum government, Naomi says, “We felt, Minority Rights Group, that by sending open letters to various experts at the United Nations that we could try and draw the attention back onto that very difficult situation in Darfur. After all, the government of Sudan under international law does have to try and protect women within the state, regardless of who’s actually carrying out these attacks”....
“Some of the UN officials will have more access to the government of Sudan or perhaps to the some of the voices that the government of Sudan may listen to. The other thing that these UN experts can do is to keep the focus on the level of attacks that are happening to minority women in Darfur. Otherwise, we feel the attention will have moved away from Darfur and onto other parts of the world.” She added.

UN - Darfur is becoming ’catastrophic

The United Nations’ top humanitarian official warned Thursday that the situation in Darfur was becoming dramatically more dangerous, as rapes and attacks by militias and rebel factions continue despite a three-month old peace deal.
The U.N. had said a day earlier that the May 5 peace deal, signed between Sudan’s government and Darfur’s main rebel group, was "doomed to failure" unless the government provided more support.
"It’s going from real bad to catastrophic in Darfur," Jan Egeland told reporters at the U.N.’s European headquarters in Geneva.
Fighting has actually increased since the peace deal, "and it has been particularly terrible among (rebel) factions fighting each other," Egeland said. "That’s led to tens of thousands of people being displaced, and sexual abuse and many other types of violations."
More than 200,000 have been killed in the region since 2003, when ethnic African tribes revolted against the Arab-led Khartoum government.
The peace deal, signed in Nigeria, was supposed to help end the conflict, but instead has triggered months of fighting between factions of the Sudan Liberation Army. The U.N., aid groups and beleaguered African Union peacekeepers say rebel factions are seeking to gain advantage before peace takes hold.
The report released Wednesday by the U.N. High Commissioner for Human Rights called on Sudan’s government and all parties to immediately comply with the peace deal’s cease-fire provisions. It also called on the international community to support the African Union force in Sudan until a U.N. operation could be deployed.
The U.N. report said armed militias continued to attack villages, and on at least one occasion they were supported by government forces.
"The government should disarm the militia and protect the physical security of all Darfurians by putting in place a credible, capable and professional police force and judiciary," the 20-page report said.
"Civilian populations continued to be targeted by militia and the government and rebel movements are in breach of the new cease-fire," the report said.
New clashes have left countless dead, the conflict has caused more than 2 million to flee their homes, and 1 million people are relying on food aid because their fields were razed or they are too afraid to go out to farm.
Violence also has affected humanitarian efforts. The U.N. said at least 250,000 people who needed aid at the end of June could not be reached because of the insecurity.
Last month was the deadliest month for aid workers since the conflict began. Eight Sudanese humanitarian workers were killed in road ambushes when they were working at water pumps, or in one case, during a nighttime village attack.
Aid groups warned Tuesday that conditions for millions of civilians could deteriorate quickly if security did not improve. They said spiraling violence was causing a rise in malnutrition and the spread of disease in some camps for displaced persons.
The U.N. estimates that 25,000 people were newly displaced by fighting in the last month.

شاهد العوا الأول، نائب والي دارفور، الذي كاد أن ينفجر غضباً وفقد القدرة على الكلام حينما ذكرت كلمة "الاغتصاب"، يرى أنه لم يحدث اغتصاب في دارفور لأن أهل دارفور، ببساطة، يستحيل عليهم ارتكاب الزنا. أما شاهده الثاني فقد روى قصة عن أن المتمردين في دارفور في سعيهم لدمغ الحكومة بالاغتصاب قاموا بتجنيد عاهرات وساقطين لتمثيل فعل الاغتصاب في فيلم إباحي يوزع لوسائل الإعلام الدولية كدليل على الاغتصاب، وأنه قد تم إلقاء القبض على المجموعة وتقديمها للمحاكمة حيث أدلت باعترافات كاملة. بصرف النظر عن تناقض هذه الشهادة مع ذلك المجتمع الفاضل لنائب الوالي حيث لايمكن لأحد من رعيته من حيث المبدأ ممارسة الزنا، فإن القصة قد تم دحضها تماماً من قبل منظمة العفو الدولية التي قابل مندوبها النسوة المعنيات وذكرن له كيف أجبرن تحت التعذيب على الاعتراف بأشياء لم يفعلنها وأنهن ذكرن ذلك للقاضي في المحكمة فأمر بإعادتهن لجهاز الأمن الإيجابي، وتم نشر ذلك كله بالتفصيل في تقرير للمنظمة بعنوان "دارفور السودان: لا أحد نشتكي له، لا *** للضحايا، الحصانة للجناة".
أما الشهادة الثالثة فكانت من رئيس القضاء الأسبق رئيس اللجنة السودانية للتحقيق في دارفور، دفع الله الحاج يوسف، وهو أحد الإسلاميين السودانيين، والذي ذكر للعوا أنه توقع أن نساء دارفور ربما لن يتمكّن من الحديث عن موضوع حساس كهذا للجنته مباشرة فلذا، وحتى يقطع الشك باليقين، فقد استعان بنساء ذوات خبرة قضائية وطبية لإجراء المقابلات، وأنهن ذهبن إلى معسكرات النازحين وقابلن النساء ولم يجدن حادثة اغتصاب واحدة. إذا لم كانت خبيرات رئيس القضاء الأسبق لم يخطئن الطريق إلى المعسكرات، فلابد أن فجوة المصداقية بينهن وبين النساء الدارفوريات كانت من الاتساع بحيث جعلت الحديث إليهن بلا جدوى، وإلا فما الذي جعل نساء كحواء وكليمة يواجهن كاميرات هيئة الإذاعة البريطانية ويتحدثن عن مصيبتهن ويصفن بالتفصيل كيف تم اغتصابهن، ويمنع نساء أخريات من الحديث إلى لجنة التحقيق السودانية أو نسائها المعينات؟
وإذ يطمئن إلى أنه قد أثبت قضيته، يخلص العوا إلى أن اتهامات الاغتصاب قد اختلقت للتشهير بالحكومة والشعب السودانيين ولتبرير التدخل الأجنبي في البلد وأن حكومة السودان بريئة وأن كل الاتهامات ضدها زائفة. إن السبب في استهداف دارفور، كما يراه، هو أنها غنية بخام الحديد واليورانيوم والبترول، وأنها بوابة الإسلام إلى أفريقيا، ولذا فإن مسلمي دارفور الموحدين يمثلون خطراً على الغرب، وأن ما يجري في فلسطين ودارفور هو جزء من المؤامرة فالأعداء الصهاينة يعملون في دارفور.
ذلك الصوت هو صوت ممثل المركز يدافع عن وكلائه. في هذا الدفاع فإن الاعتبارات الاستراتيجية للمركز تحجب المأساة الإنسانية وما يهم المركز هو الأرض وليس البشر، وهو الثروة وليست الأرواح، وفي هذه الرؤية يُختزل السودان برمته إلى جسر يحمل المركز إلى قلب القارة المظلمة وتختزل دارفور إلى بوابة في نهاية ذلك الجسر، وتُحجّم الحكومة ذاتها إلى حراس يجلسون عند البوابة.

السودان: لا عدالة لضحايا دارفور
المحاكم الخاصة تمتنع عن مقاضاة جرائم الحرب

قالت منظمة هيومن رايتس ووتش في دراسةٍ موجزة نشرتها اليوم أن المحاكم التي شكلتها الحكومة السودانية لمعالجة الجرائم المتفشية في دارفور فشلت حتى الآن في توفير العدالة لضحايا جرائم الحرب المرتكبة منذ أوائل عام 2003.
وكان مكتب المدعي العام في المحكمة الجنائية الدولية قد أعلن في 6 يونيو/حزيران في السنة الماضية عن بدء التحقيقات في أحداث دارفور. وفي اليوم التالي، أعلن رئيس القضاء ورئيس المحكمة العليا السوداني إنشاء المحاكم الجنائية الخاصة بأحداث دارفور مصرحاً للصحافة السودانية أن هذه المحاكم "تعتبر بديلاً عن المحكمة الجنائية الدولية".
وقالت سارة داريهشوري، كبيرة مستشاري برنامج العدالة الدولية لدى هيومن رايتس ووتش وكاتبة الدراسة الموجزة التي صدرت اليوم: "لم تتضمن القضايا المعروضة على هذه المحاكم حتى الآن إلا جرائم عادية كالسرقة وحيازة المسروقات؛ وهذا لا يعكس فداحة الدمار الذي حل بدارفور"، مضيفة بأن "على الحكومة السودانية خدمة فكرة العدالة بما يتجاوز مجرد الكلام".
ومنذ أوائل عام 2003، يتعرض عشرات الآلاف من المدنيين إلى الاعتداء والاغتصاب والقتل. وقد دمرت مئات القرى، وأجبر قرابة مليوني شخص على الهجرة بفعل ذلك النزاع. إن هيومن رايتس ووتش على علمٍ بثلاث عشرة قضية فقط قدمت إلى المحكمة الخاصة الجديدة حتى الآن. وقد شملت هذه القضايا أشخاصاً قليلي الشأن متهمين بجرائم صغيرة نسبياً. ولم يوجه الاتهام إلى أيٍّ من كبار القادة أو الزعماء بشأن دورهم في الفظائع المرتكبة.
وفي الدراسة الموجزة الواقعة في 31 صفحة تدرس هيومن رايتس ووتش العام الأول من عمل المحكمة الخاصة وتحدد أكبر العقبات التي تعترض مقاضاة جرائم الحرب في دارفور. ومن هذه العقبات:
• افتقار القانون السوداني إلى الوضوح بشأن جرائم الحرب والجرائم ضد الإنسانية التي يمكن مقاضاتها؛
• غياب الأساس القانوني لمحاسبة القادة وفقاً لمبدأ "مسؤولية القائد" عن الجرائم التي لا يقوم بمنعها أو إنزال العقاب بمرتكبها؛
• الأحكام القانونية التي تمنح الحصانة القضائية لأفراد القوات المسلحة وأجهزة الأمن الوطنية والشرطة، وهذا ما يخلق عقبةً محتملة أمام نجاح المقاضاة؛
• إدخال كثير من عناصر ميليشيا الجانجاويد في قوات الدفاع الشعبية وقوات الشرطة الخاصة، وغير ذلك من الجماعات شبه العسكرية؛ وهذا ما يتيح لهم الاستفادة من الحصانة لتجنب المحاكمة؛
• الامتناع عن التحقيق في شكاوى الضحايا؛
• تعرض الضحايا (وخاصةً ضحايا العنف الجنسي) في كثيرٍ من الأحوال إلى المضايقة عندما يذهبون إلى الشرطة، بل وتهديدهم أحياناً بالاعتقال والمحاكمة.
وقالت داريهشوري: "تمثل الدعاوى الثلاث عشرة المنظور فيها حتى الآن إهانةً للضحايا". وأضافت: "إن فشل النظام القضائي في دارفور يجعل الملاحقات القضائية من جانب المحكمة الجنائية الدولية أمراً شديد الأهمية. وعلى الخرطوم الآن أن تظهر تعاوناً كاملاً مع تحقيقات المحكمة الجنائية الدولية".

African Union says lacks fund to maintain Darfur presence

The African Union lacks the funds to maintain its peacekeeping force or to boost its efficiency amid a deteriorating security and humanitarian situation in Sudan’s Darfur, a top AU official in Sudan said as the U.N. Security Council prepares to discuss a U.N. force for the region.
While the U.S., the AU and others have called for deployment of a strong U.N. peacekeeping force to replace the ill-equipped and underfunded AU force in Darfur by Oct. 1, the Sudanese government vocally opposes the move. The U.N. has asked the 7,000-strong AU force to stay beyond the end of its mandate in September.
But the chief AU negotiator in Sudan said the AU hasn’t yet decided whether it would prolong its mission.
"We can only stay if we are provided the adequate funding and equipment," Sam Ibok told The AP in a phone interview from the Sudanese capital.
"We came to help the Darfurians," Ibok said. "But Darfur rebels are attacking our people and killing our people, enough is enough," he said, echoing a widespread feeling of dismay among AU personnel as they face rising hostility from various Darfurian factions that accuse it of failing to end the violence.
International aid agencies also say insecurity has worsened in Sudan’s remote western region since the signing of a peace agreement last May. Only one rebel force joined the government in signing the agreement, and infighting among rebel factions is blamed for much of the increased violence since May.
The U.N. World Food Program said Wednesday that insufficient funding could force it to reduce the food rations it distributes to over 6 million people in Darfur.
"But funding is not the only problem," WFP said in a statement. "The deteriorating security situation...has made it too dangerous for truck convoys to drive through large areas in north and south Darfur, where fresh outbreaks of fighting and banditry have occurred."
"While the news cameras are focused on the conflict in Lebanon, the situation in Sudan has quietly grown more dangerous and desperate than ever," said WFP’s representative in Sudan, Kenro Oshidari.
U.N. Secretary-general Kofi Annan has laid out options for a much more muscular U.N. operation "to establish a stable and secure environment to protect civilians" and support implementation of the peace deal in Darfur.
The plan envisions a U.N. force of between 15,300 and 18,600 troops, depending on the number of aircraft, helicopters and rapid reaction troops. Annan also proposed more than tripling the 1,560-strong AU police contingent to about 5,300 U.N. officers.
If approved by the council, the U.N. peacekeeping mission in Darfur would become the U.N.’s largest. But Annan has said the U.N. cannot take over peacekeeping without the Sudanese government’s consent and cooperation.
John Bolton, U.S. ambassador to the U.N., said earlier this week he hoped the push for an international peacekeeping force in Darfur would make progress in the coming days.
"The question, as always, is whether the Security Council can overcome the political objection from several significant member governments, including two permanent members and the government of Sudan," Bolton said, in an apparent reference to China and Russia.
China is the largest buyer of Sudanese oil exports and a strong backer of the regime.
Meanwhile, a rebel group that was asked to leave the AU’s headquarters in Darfur because it refuses to sign the peace agreement said its expulsion could lead to an escalation of violence.
The AU said the Justice and Equality Movement had been advised to leave AU headquarters in the North Darfur town of El Fasher because it wasn’t supporting the peace deal and the main rebel group refuses to hold talks with them.
"It doesn’t mean we have lost hope that JEM will eventually join the peace process, but it reflects that we can’t fund and host people who are doing nothing," the AU’s Ibok said.
JEM delegate Mohammed Abbasher Ahmed was quoted as telling Sudan’s Akhbar Al Youm newspaper his group regarded the AU’s decision "as a declaration of war."
Delegates from JEM and other rebel groups were stationed at the AU headquarters as part of an effort to bring peace to a region where more than 200,000 people have been killed since 2003, when ethnic African tribes revolted against the Arab-led Khartoum government. The revolt triggered massive retaliation by pro-government militias, and more than 2 million people fled their homes because of the fighting.

UN official urges trials for perpetrators of Darfur crimes

A United Nations human rights official urged Thursday, after visiting Darfur, that persons involved in human rights violations in the conflict-wracked area of western Sudan be brought to trial.
"Where impunity prevails, the protection of civilians will remain elusive," said Sima Samar, the U.N. Special Rapporteur on Human Rights in Sudan, as she wrapped up a six-day tour of the country during which she visited North and West Darfur.
Khartoum’s efforts to ensure accountability, including trying persons suspected of killing civilians, rape, #####ng and destruction of property, "have so far proved inadequate," she said.
Last week, the U.S. urged that U.N. peacekeepers be in Darfur by Oct. 1. An African Union force deployed in the area has proved ineffective in halting the violence.
Since the signing in May of the Darfur peace agreement between Sudan’s government and Darfur’s main rebel group, "there has been an upsurge in violence in the region resulting in killings of civilians, rape and displacement," the U.N. official said.
Unless action is taken to protect civilians from attacks, "there will be a further deterioration in the coming months," Samar predicted.
More than 200,000 have been killed and some 2 million rendered homeless since 2003 when tribes revolted against the Khartoum government.

أعربت موفدة الأمم المتحدة لحقوق الإنسان في السودان سيما سمار عن «قلقها العميق» من وضع حقوق الانسان في دارفور (غرب) ووصفته بانه «خطير».
وقالت سمار للصحافيين في الخرطوم في ختام زيارة لدارفور استمرت ستة ايام «لقد شعرت بقلق كبير من وضع حقوق الانسان في دارفور»، واحتمال «تدهوره في الاشهر المقبلة، في حال لم تتخذ تدابير لحماية المدنيين». وقالت انه على الرغم من وقف اطلاق النار «هناك ارتفاع لأعمال العنف (...) مع وقوع جرائم قتل وعمليات اغتصاب ونزوح». وأوضحت انه تبين ان الجهود التي تبذلها الحكومة السودانية لمعاقبة المسؤولين عن هذه التجاوزات، ودفع تعويضات لضحايا النزاع كانت حتى الآن غير كافية. ودعت سمار الحكومة الى «تحمل مسؤولياتها، واتخاذ تدابير فورية لحماية المدنيين، ووقف الهجمات التي يتعرضون لها»، وكذلك نزع اسلحة الميليشيات العربية الموالية لها، الناشطة في هذه المنطقة. كما أعربت موفدة الأمم المتحدة عن «قلقها العميق» من «عمليات النقل القسري» للنازحين من دارفور، الذين لجأوا الى مخيم يبعد نحو أربعين كلم من جنوب غربي العاصمة السودانية. وأضافت أن الشرطة قد تكون استخدمت القوة لإرغام النازحين في هذا المخيم على الرحيل.
وعلى الرغم من اتفاق السلام الذي ابرم بين الحكومة السودانية والمتمردين في دارفور، ما زالت هذه المنطقة تشهد اعمال عنف.

Rapes on rise at Sudan’s Darfur refugee camp - IRC

More then 200 women have been raped in one of Darfur’s refugee camps over the past five weeks alone, a sign of the worsening humanitarian crisis in the violence-wracked Sudanese region, an aid group said Wednesday.
The increased violence came as the U.N. Security Council discussed a draft resolution to replace an understaffed African Union peacekeeping force with a larger and more effective U.N. mission to restore peace in Darfur, where more than 200,000 people have been killed since 2003.
The number of rapes in Kalma camp -one of Darfur’s largest with about 100,000 refugees -was one measure of the increased violence throughout the region, as was a rising number of people fleeing their homes and of attacks on aid workers, said International Rescue Committee, which collected the information.
"This is a massive spike in figures. We are used to hearing of two to four incidents of sexual assault per month in Kalma camp," said Kurt Tjossem of the IRC.
The group did not specify who committed the rapes. Refugees in the past have accused the pro-government janjaweed militias of harassing them.
The aid group’s statement echoed a report issued by U.N. Secretary-General Kofi Annan a day earlier that said there were thousands of documented cases of women and children abducted for forced labor or forced sex.
"Grave violence against women in Darfur continues to worsen," Annan said. "Girls have been targeted in interethnic conflicts as a deliberate form of humiliation of a group, and as a means of ethnic cleansing."
Violence flared three years ago in Darfur when ethnic African tribes revolted against the Arab-led Sudanese government. Khartoum is accused of having unleashed in response a paramilitary group known as the janjaweed that have been blamed for much of the atrocities.
Measuring the violence in the vast, arid Darfur region has long been notoriously difficult, with pro-government armed groups and rebel factions often barring access to international observers, and Khartoum providing scare information.
International pressure has been mounting on Khartoum to let a large U.N. mission into the country to resolve the crisis.
Wednesday, four U.S. Congressmen ended a trip to Sudan on a fact-finding mission, the U.S. embassy in Khartoum said.
The delegation was led by Connecticut Republican Christopher Shays, the chairman of the Subcommittee on National Security, the embassy said.
The New York-based IRC statement said more than 50,000 people have been made refugees in recent weeks, joining some 2 million people previously displaced by the conflict.
The U.N. and several aid organizations have also recently warned that a peace agreement signed last May between the Sudanese government and the main Darfur rebel group only led to more violence and a worsening of the humanitarian crisis.
While several militias and paramilitary forces operate in the region, most of the recent clashes are blamed on infighting among rebel factions who disagree over the peace deal.
Dissident rebels are also suspected in the killing of two AU peacekeepers earlier this month.
The financially strapped African Union has requested the transfer of its mission to the U.N., saying it is not able to do long-term peacekeeping. But Sudanese President Omar al-Bashir remains staunchly opposed and has warned that Sudan’s army would fight any U.N. forces sent to Darfur.
The draft U.N. resolution plans to replace the 7,000-strong AU force with some 22,000 U.N. troops.
Sudan wants AU troops to remain in Darfur and be beefed up with the money that would be spent on a U.N. force.
