Darfur: 16 men at risk of being hanged
On 1 January 2005, Military Intelligence in Nyala arrested twelve men from the Birgid tribe from Doumma village, 12 Km North of Nyala. The men are accused of supporting the Sudan Liberation Army (SLA) and of committing crimes against state. Their details are as follows:

Musa Abdel Kareem Abdel mawla, 29 yrs
Hassan Soulieman Ibraheam, 41 yrs
Mohamed Ibraheam Abdella, 25 yrs
Hafiz Adam Soulieman, 19 yrs
Adam Abdel raheam Abdel rahman, 35 yrs
Mohamed Hassan Abdel Ghani, 40 yrs
Yahya Ishag Ali, 18 yrs
Jafer Mohamed Abdella, 21 yrs
Soulieman Mohamed Arbab, 22 yrs
The twelve men were reportedly tortured by the Military Intelligence during their arrest and on the way to Nyala. They beat the men with their hands and kicked them with their boots. The twelve detainees were initially taken to the military intelligence offices in Nyala and detained there for 1 day.
On 2 January 2005, the men were transferred to Nyala Wasat (central) police station where they were officially charged under articles 51 (Waging War against the State) and article 58 (Abetment of Mutiny) of the 1991 Penal Code.
Following the official charges, the men were transferred to Nyala prison where they remain in detention.
In a separate incident, on 30 November 2004, the Armed forces arrested four men from Adwa village, 47 km North of Nyala, Southern Darfur state. The men were arrested from their homes following an earlier arrest of 19 people ranging in age from 21 to 85 belonging to the Fur and Dajo tribe from their homes and on the streets in Adwa village by the armed forces and the Janjaweed (militias) in Land Rovers on 28 November 2004.
The four men are accused of supporting the SLA, their details are as follows:

The men were initially detained at Nyala Wasat (central) police station where they were officially charged under article 51 and article 58 of the 1991 Penal Code.
On 7 December 2004, the four detainees were transferred to Nyala prison where they remain in detention.
SOAT is unconditionally opposed to the death penalty and strongly condemns its use by the Government of Sudan. SOAT is gravely concerned by the arbitrary arrest and detention of civilians in Darfur perceived as sympathising with armed opposition groups in Darfur.
SOAT strongly urges the Government of Sudan to:
Take all necessary measures to ensure the physical and psychological integrity of all the detainees
Investigate allegations of torture and bring the perpetrators to justice.
Abolish the death penalty in Sudan.
Ensure respect for rights to fair trial and to legal appeal in accordance with international human rights standards, for all detainees throughout Sudan.
Guarantee respect for human rights and fundamental freedoms throughout Sudan in accordance with national laws and international human rights standards

Darfur: IDPs from Outash IDP Camp facing the death penalty
On 5, 7, 8 and 9th January 2005, the police and the security forces arrested 7 Internally Displaced Persons (IDPs) from Outash camp, North of Nyala. The arrest followed the death of a police officer on 5 January 2005 in the camp during disturbances following attempts to force the IDPs to leave the camp and return to their villages. The men were initially detained at Nyala Wasat (central) police station where they were officially charged with murder under article 130 of the 1991 Penal Code. The details of the detainees are as follows:
Khamees Musa, arrested on 9 January 05
Abdella Ishag Mohamed, arrested on 8 January 05
Abdel Aziz Ahmed Ali, arrested on 7 January 05
Ahmed Mohamed Khaleel, arrested on 5 January 05
Adam Altahir Abdella, arrested on 5 January 05
Adam Rasheed Mohamed, arrested on 5 January 05
Omer Rasheed Mohamed, 5 January 05
During the arrest, the police officers reportedly tortured the IDPs. The 7 men were beaten with sticks all over their bodies.
The 7 men remain in detention at Nyala prison.
Background
The later half of 2004 saw an escalation in violent attacks on IDPs in camps by security and police forces as part of strategic attempts to forcefully remove them from these camps back to their homes or to ‘safe designated areas’. IDPs that protested or refused to return to villages that were not their original villages, and to their original villages that were unsafe were summarily arrested, detained and tortured. The violence has decreased somewhat with the signing of the Abuja Protocols in November 2004.
SOAT urges the government of Sudan to refrain from returning to the policy of force returns of IDPs. Forceful relocation or return of IDPs and refugees is against all international humanitarian laws and the Protocol Additional to the Geneva Conventions of 12 August 1949, and relating to the Protection of Victims of Non-International Armed Conflicts (Protocol II), 8 June 1977. Furthermore, article 2 of the Abuja Protocols (‘Protection of Civilians’) of the humanitarian accords requires all parties to the agreement to “ensure that the principle of voluntary return is fully respected and is not tampered with in any shape or form, consistent with general UN return principles”.
SOAT is unconditionally opposed to the death penalty and strongly condemns its use by the Government of Sudan. SOAT is gravely concerned by executions occurring, and by the procedures of these Criminal Courts, which do not comply with international or national standards for fair trials.

الموضوع: 16 شخصا معرضون للأعدام شنقا بدارفور
في أول يناير 2005 أعتقلت المخابرات العسكرية بمدينة نيالا أثنا عشرة رجلا
من قبيلة البرقد من قرية دومة (ضمة) علي بعد 12 كيلومتر شمال نيالا.
و كانت التهمة الموجهة الي الرجال أنهم مساندون لجيش حركة تحرير السودان
و أرتكاب جرائم ضد الدولة. و أدناه أسماء المعتقلين:
- زكريا آدم عبدالله, 53 سنة, عمدة قبيلة البرقد
- علي يوسف آدم, 38 سنة
- محمد عبدالرحمن عبدالله, 31 سنة
- موسي عبدالكريم عبدلامولي, 29 سنة
- حسن سليمان ابراهيم, 41 سنة
- محمد ابراهيم عبدالله, 25 سنة
- حافظ آدم سليمان, 19 سنة
- آدم عبدالرحيم عبدالرحمن, 35 سنة
- محمد حسن عبدالغني, 40 سنة
- يحي أسحق علي, 18 سنة
- جعفر محمد عبدالله, 21 سنة
- سليمان محمد أرباب, 22 سنة
هؤلاء الأثني عشر رجلا تعرضوا للتعذيب من قبل المخابرات العسكرية أثناء أعتقالهم
و أثناء نقلهم الي نيالا. كانوا يضربونهم بالأيادي و يركلونهم بالبوت(الحذاء العسكري).
في البدء أخذ المعتقلون الأثني عشر الي مكاتب المخابرات العسكرية بنيالا و حبسوا هناك ليوم واحد.
في الثاني من يناير 2005 تم نقل الرجال الي نقطة بوليس نيالا القسم الأوسط حيث تم توجيه التهم رسميا اليهم تحت المادة 51 ( الحرابة ضد الدولة) و المادة 58 (أيواء متمردين) من قانون العقوبات لعام 1991 .
بعد توجيه التهم نقل الرجال الي سجن نيالا حيث يمكثون رهن الأعتقال.
في حادث منفصل, في 30 نوفمبر 2004, أعتقلت القوات المسلحة أربعة رجال من قرية عدوة, تبعد 47 كيلومتر شمال نيالا, في ولاية جنوب دارفور. تم أعتقال الرجال من منازلهم بعد أعتقال 19 شخص في وقت سابق تتراوح اعمارهم بين 21 سنة الي 85 سنة يتبعون لقبائل الفور
و الداجو. لقد تم اعتقال هؤلاء الخيرين من منازلهم و شوارع قري عدوة بواسطة القوات المسلحة و مليشيا الجنجويد في عربات لاندروفر في 28 نوفمبر 2004 .
الرجال الأربعة المذكورون سابقا متهمون بمساندة جيش حركة تحرير السودان و تفاصيلهم كالآتى:
- أدريس آدم عبدالله, 60 سنة
- محمد أحمد أحمد عبدالله, 35 سنة
- عبالله تيراب سيف الدين, 28 سنة
- أبراهيم سليمان أبكر, 33 سنة

منظمة السودان ضد التعذيب SOAT ضد عقوبة الأعدام و تدين بشدة تطبيقها بواسطة حكومة السودان.SOAT جد قلقه علي التوقيف و الاعتقال العشوائي للمدنيين بدارفور الذين قد يعتبرون متعاطفين مع مجموعات المقاومة المسلحة بدارفور.
SOAT تحض بقوة حكومة السودان علي :
- أتخاذ كل التدابير اللازمة لضمان سلامة المعتقلين نفسيا و جسديا.
- التحقيق في كل دعاوي التعذيب و تقديم مرتكبيه للعدالة.
- ألغاء عقوبة الأعدام بالسودان.
- أحترام الحق لأي متهم في محاكمة عادلة و ضمان الأستئناف مع ما يتفق و القوانين
الدولية لحقوق الأنسان في كل السودان.
- ضمان أحترام حقوق الانسان و مباديء الحرية في كل السودان بما يتفق و القونين الوطنية و معايير حقوق الأنسان الدولية.
