Quote: SOAT Sudan Organisation Against Torture Human Rights Alert: 02 February 2005 Darfur: Zaghawa tribe members at risk of torture On 17 January 2005, security forces in Nyala arrested three Zaghawa tribe members from Khartoum Bilail neighbourhood in Nyala, Southern Darfur state, on suspicion of supporting the Sudan Liberation Army (SLA). The details of the men are as follows: Ibrahim Abaker Bakour, 45 yrs, Merchant Adam Abaker Bakour, 35 yrs, Merchant Musa Mahmoud Adam, 35 yrs, Merchant The three men were arrested from Mr. Ibrahim’s shop in Nyala central market at 12 pm and taken to security offices in Nyala. They remain in detention without charge. Their families have reportedly been denied access. SOAT expresses fears for the safety of the men and is calling on the Government of Sudan to give assurances that the men will not be tortured or ill treated. Background The targeting and widespread recourse to torture of specific ethnic groups, mostly the Fur, Zaghawa and Masalit on the pretext of these groups sympathising with armed opposition in the region with impunity continues apace and remains systematic. Over recent weeks, SOAT has reported a number of cases of arbitrary detention without charge of members of Zaghawa, Fur and Massalit tribes. On 28-30 November 2004, the Armed Forces and the Janjaweed militias arrested 23 men from Adwa village, 47 km North of Nyala, Southern Darfur state ranging in age from 21 to 85 belonging to the Fur and Dajo tribe. Four of the men are charged with offences that carry the death penalty under 51 (Waging War against the State) and article 58 (Abetment of Mutiny) of the 1991 Penal Code and remain in detention at Nyala prison. The whereabouts of 19 of the detainees are unknown. On 20 December, the armed forces arrested five men, four belonging to the Zaghawa and one from the Fur tribe from Marla village in Nyala province on suspicion of joining the rebel forces. The men were detained at a military custody centre in Marla. During the detention, the men were taken to a hole in the ground where they were tortured by the armed forces and Janjaweed militias. They tied the hands and legs of the men with rope, flogged them on their backs, beat them severely with sticks and with the barrel of their guns on their #########. One of the detainees allegedly died because of torture whilst in the custody of government armed forces, no post mortem was conducted following his death. On 1 January 2005, Military Intelligence in Nyala arrested twelve men from the Birgid tribe from Doumma village, 12 Km North of Nyala. The twelve men were reportedly tortured by the Military Intelligence during their arrest and on the way to Nyala. The men are accused of supporting the Sudan Liberation Army (SLA) and of committing crimes against state and are charged with article 51, article 58 of the 1991 Penal Code.
