Free Saeed Mohamed Al-Awad; a GIRIFNA member facing a military trial
On November 24, 2013; a force belonging to the military intelligence and the National Intelligence and Security Services (NISS) arrived at the house of Saeed Mohamed Al-Awad, a university of Khartoum student and a GIRIFNA member, and arrested him along with his mother and brother. During the arrest, they were beaten by the force until his mother’s arm was broken.
Recently Al-Awad returned to his family house in the village of Shamashka in Southern Kordofan state, from Khartoum where he studies economics at the University of Khartoum. The young activist took a year off to stay with his sick elderly parents who are alone with his brother.
He made the risky journey to his village only to find a different place. He found that the situation is dire with the army carrying out sporadic arrests and harassing the citizens of the village to push them to leave their homes so the village can be used for military operations.
Some families including Al-Awad’s refused to leave their land in a state where tens of thousands were displaced and others had to seek refuge in caves since the fighting broke out between the SPLM-N and the Sudanese Armed Forces (SAF) in June 2011.
Al-Awad’s mother and brother were released after they were all taken to army detention facilities in El-Obeid in Northern Kordofan. They were released without charges, but were left in El-Obeid, miles away from their house without any money or shelter.
Al-Awad was kept in detention in an unknown place until he was presented to court two months later without the presence of a lawyer to our knowledge.
He currently faces a military trial and a trial was supposed to take place yesterday afternoon (February 17), however, GIRIFNA, found out that Al-Awad was sick with Hepatitis and the court date was postponed to an unknown date.
Al-Awad currently faces the following charges: 1) refusal to leave his village (refusal to be displaced) by refusing military orders; and 2) espionage for the Sudan Revolutionary Front (SRF) against the Sudanese government.
GIRIFNA stands against the military trial of civilians, which has gained legitimacy as the Sudan Armed Forces Act was amended and passed in parliament in July 2013. The new amendments allows civilians to be prosecuted in military courts. It also gives the military judiciary powers to try civilians for articles in the 1991 criminal code such as “undermining the constitutional system,” “leaking of classified information,” and “publication of false news.”
GIRIFNA demands the immediate release of Saeed Mohamed Al-Awad, who is a non-violent activist and university student. We are also against the military trials of civilians as Saeed is currently held with 10 other civilians from Rashad and Kadugli.
We also demand that Saeed Mohamed Al-Awad gets immediate medical support as well as access to a lawyer and a transparent civilian trial if he is to be tried.
أطلقوا سراح سعيد محمد العوض-عضو حركة قرفنا يواجه حالياً محاكمة عسكرية
يوم 24 نوفمبر 2013 وصلت قوة من الاستخبارات العسكرية وجهاز الامن والمخابرات الوطني الي منزل سعيد محمد العوض الطالب بجامعة الخرطوم وعضو حركة قرفنا وقامت باعتقاله هو ووالدته وأخيه. وتم ضربهم اثناء الاعتقال حتي كسرت يد والدته.
يدرس سعيد بكلية الاقتصاد/ جامعة الخرطوم، وقد قام بتجميد العام الدراسي والعودة الي منزل الاسرة في قريته شمشكا بولاية جنوب كردفان للبقاء مع والديه المريضين وأخيه.خاطر برحلة العودة الي قريته ليجدها مكانا مختلفاً، والجيش يقوم بالاعتقالات المتفرقة ويتحرش يالمواطنين ليدفعهم لمغادرة المكان حتى يتمكن من استخدام القرية كقاعدة عسكرية.
بعض الاسر مثل أسرة سعيد رفضت مغادرة اراضيها، حيث اضطر عشرات الالاف في الولاية للنزوح بينما اتخذ آخرين من الكهوف ملاجئاً منذ اندلاع القتال بين الحركة الشعبية لتحرير السودان-شمال و القوات المسلحة السودانية في يونيو 2011.
تم اطلاق سراح والدة سعيد وأخيه بعد أن تم ترحيلهم لمعتقلات خاصة بالحيش في ولاية شمال كردفان بدون توجيه أية تهم ضدهم وتركوا في الابيض بلا مال أو مأوى علي بعد أميال من منزلهم. بينما ظل سعيد قيد الاحتجاز في مكان غير معروف، وتم تقديمه لمحاكمة عسكرية بعد شهرين من الاعتقال ومن دون حضور محامي حسب معلوماتنا.
يواجه سعيد حالياً محاكمة عسكرية، حيث حدد ظهر يوم أمس موعداً للمحاكمة ولكن قرفنا علمت بتأجيلها الي تاريخ غير مغروف نسبة لاصابة سعيد بالتهاب الكبد الوبائي. يواجه سعيد التهم التالية: 1) رفض مغادرة القرية (رفض النزوح) برفضه للاوامر العسكرية 2) التجسس لصالح الجبهة الثورية السودانية ضد حكومة السودان.
تناهض قرفنا المحاكمات العسكرية للمدنيين التي شرعها البرلمان السوداني بتمرير تعديل قانون القوات المسلحة في يوليو 2013 حيث سمح التعديل بمقاضاة المدنيين امام المحاكم العسكرية وتسمح ايضا للقضاء العسكري بالفصل في مواد من القانون الجنائي لسنة 1991 مثل تقويض النظام الدستوري وتسريب معلومات سرية و نشر الاخبار الكاذبة.
تطالب قرفنا باطلاق سراح الناشط اللاعنفي والطالب بجامعة الخرطوم سعيد محمد العوض فوراً.
كما نعلن عن وقوفنا ضد المحاكمات العسكرية للمديين التي يواجهها سعيد وعشرة مدنيين من رشاد وكادقلي. و نطالب بتوفير الرعاية الطبية العاجلة لسعيد، واتاحة محامي للدفاع عنه ومحاكمته بشفافية امام محكمة مدنية اذا دعت الحاجة لمحاكمته.
