Mumbai, May 25 (ANI): Abdul Samad Bhatkal, a key accused in Pune's German Bakery blast was produced in a Mumbai court on Tuesday.
Buzz up!Bhatkal, who was arrested by the Mumbai Anti-Terrorism Squad (ATS) on Monday, was produced in the Mazgaon court amid heavy media presence.
He was arrested on his arrival to Mangalore from Dubai.
Sleuths had begun tracking the movements of Bhatkal after scanning the CCTV footage of the blast site.
Bhatkal had moved to Dubai 12 days after the explosion and had returned on Monday after his visa expired.
The Pune blast, which killed seventeen people and wounded at least 57, was seen as the first major attack on India since the 2008 Mumbai terror attack.
The bakery is located in Koregaon Park, which is close to the Osho Ashram and the Chabad House, a Jewish prayer house, frequented by numerous foreigners and tourists. (ANI)

للاسف من قام بتفجير المقهى ،الذي راح ضحيته الشهيدان امجد شيقوق وانس الفاتح ، هو هندي مسلم اسمه عبد الصمد وقد هرب الى دبي وعاد منها بعد انتهاء مدة زيارته .
تم التعرف عليه عن طريق الكاميرات التي كانت منصوبة في الفندق المجاور .

The state anti-terrorism squad (ATS) claimed on Monday to have cracked the February 13 Pune German Bakery blast case with the arrest of a 23-year-old at the Mangalore airport.
Abdul Samad, arrested in the morning, was identified by the police as the younger brother of Yasin Bhatkal, alias Siddibappa, a key member of Indian Mujahideen (IM) — suspected of being involved in bomb blasts across the country in recent years.
However, the ATS officials in Mumbai maintain that Samad is wanted in a 2009 arms haul case, but is not connected to the German Bakery case.
The Pune blast, which left 17 dead and more than 60 injured, was the first terror attack in the country after 26/11.
DNA has obtained a picture of Samad at the bakery’s counter with a rucksack, in which he is suspected to have carried the bomb. The picture was captured by a CCTV camera inside the bakery.
The police said Samad went to Mangalore from Bhatkal, Karnataka, from where he boarded a flight to Dubai on February 27. The police traced Samad’s residence, Zarrar Manzil, in Bhatkal from his passport. His father, Mohammed Zarrar, has a garment business in Dubai from his establishment Zarrar Complex.
The police said Samad entered the bakery around 6pm. After placing an order at the counter, he took a corner table. He was inside the restaurant for about 45 minutes. The blast took place at 6.52pm, which the police suspect was triggered by a timer; the timer’s make is not clear.
Central agencies informed of Samad’s suspected involvement in the blast issued a lookout notice for him in Dubai.
The Dubai government refused to extend his visa on the request of the Indian embassy. So Samad was forced to return to Mangalore.
His brother Yasin Bhatkal is wanted in the Gujarat, Bangalore and Hyderabad blast cases. Bhatkal is suspected to be in Karachi with Riyaz and his brother Iqbal, the founder members of IM.

In this White Paper the following aspects of CCTV are explored: Technical Aspects, Installation and Management Aspects, Legal and Evidentiary Aspects.
Although technical aspects are addressed in the Technical section, the aim was to limit specifications that might lead to the White Paper being outdated in the near future due to technology developments. The aspects addressed included:
The system purpose; whether for monitoring, detection, recognition or identification.
Required system performance including a performance guideline, a guideline table for camera, video recorder, operator and control room components.
Installation and Management Aspects addressed the following:
Restrictions of cameras installed may include the detection of movement rather than identification; black and white systems are insufficient for identification of clothing and vehicle colour; the use of compression techniques may result in low-resolution images.
Role players and responsibilities are indicated in this section in order to ensure that the correct service and guidelines for installation are followed, including the retailer and system provider. This section also includes guidelines for provider selection and camera selection, placement and picture quality. Installation and management also includes best practice systems for installers as well as what training programmes to users should include. As well as using CCTV for measuring performance in a company and as a result either reprimand or incentivise staff accordingly.
The purpose of including the legal and evidentiary aspects in this document is to standardise protocols in the handling of video/DVD or other material that has evidential value that is in the possession of private persons employed by the retail industry. During the investigation of offences committed and incidents in chain stores, the visual footage, captured on close circuit television (CCTV) equipment is of crucial importance during the investigation and procedures that could follow. Included in this section are: Important aspects of CCTV evidence, rules applicable to digital images, the chain of custody, persons usually involved in the handling of evidence, information for CGCSA as well as pitfalls to watch out for.
This document also includes recommended checklists for operational requirements of the camera, recommended basic formats for basic affidavits and a recommended general checklist for the CCTV system.
The experts who shared their expertise in compiling this document included members from CSIR, SAPS Forensic, Retail Business Intelligence (RBI), Spar, MBRS, Business Against Crime, SACO. |

Images generated using a face-recognition software, combined with careful study of CCTV visuals from Pune’s German Bakery where a bomb exploded on February 13 and comparison with photographs of suspects, helped police zero in on Abdul Samad Mohammed Zarrar alias Abdul Samad Bhatkal. The younger brother of Yasin Bhatkal alias Ahmed Mohammed Zarrar is the susptected planter of the bomb.
Abdul Samad was arrested by the Maharashtra ATS on Monday morning when he arrived from Dubai at Mangalore airport after a three-month visit to the UAE that had begun 10 days after the Pune blast.
He was remanded in police custody until June 1 by a Metropolitan Magistrate’s court for his alleged involvement in a little known case of 2009. He was booked under various sections of the Arms Act and the ATS made no mention of the bomb blast in the |

يا اخي والله كلما اسمع عن مسلم فجر نفسه بحزام ناسف أو قتل نفوساً بريئة أحتار فى فهم هؤلاء البشر للاسلام والمصيبة يا شيقوق ان منظرى هذا التطرف كثر فى عالمنا اليوم.. حتي اصبح الاسلام مرتبطأ بالقبح فى نظر غير المسلمين ..صحيح ان أفعالهم لا تمثل الاسلام حقاً ولكن المصيبة انها تتم باسم الدين الاسلامي والمحيرني اكثر ان تاريخنا الاسلامي له فيها جذور منذ الخلافة الراشدة (مع اختلاف الزمان والدوافع). والمعركة ضد مثل هذا المنهج طويلة وتحتاج لفهم وعلاج عميق .
نسأل الله ان لايرينا فى عزيز لدينا مكروهاً مرة أخري بجريمة مثلها .

استاذنا الطيب اثرت نقطة مهمة جدا ، ولو أن المقام مقام وجيعة وحزن، وهي قرينة البراءة و عدالة ونزاهة القضاء الهندي، ديل ناس رتنلال ودهرلال وفاسديف كريشنا،واضع اعظم مرجع في إعتقادي عن قانون الإثبات السوداني. قبل ما يجيبوا لينا قبول " البينة المتحصل عليها بصورة غير مشروعة!". وبمناسبة إلتقاط الكاميرا لصورة للمتهم، أظن أن هذه القضية ستثير جدلا ساخنا في قانون الإثبات خاصة فيما يتعلق بـ:

التطور في تقنية المعلومات - اعتقداخي الفاتح - صار مستصحبا بكثير من التطور في القانون على جميع الاصعدة بما فيها الجوانب الشرعية من جهة اثبات نسب البنوة عن طريق ال DNA وصدرت الكثير من التشريعات التي تقر قبول مستخرجات الكمبيوتر كبينة امام المحاكم مع تعزيز الحماية الامنية للمعلومة الالكترونية حتى لا تكون عرض للتزوير والتغيير والتبديل .
اما فيما يتعلق بقبول بينة الفيديو كاميرا فقد كتب عنها الكثيرون وصدرت مؤلفات تجيز قبولها امام المحاكم كبينة بتصنيفها في غياب ما يعضدها بال best evidence .

Law of evidence when dealing with CCTV video recordings

The objective of this article is to educate Hi-Tech Security Solutions’ readers, equipping you with the basic necessary knowledge to ensure the admissibility as real evidence of CCTV recordings in a court of law or quasi judicial tribunal, and that the maximum probative value is attached to the recording. Without this knowledge the investment in a sophisticated recording system will be of little value as such recordings may be declared inadmissible evidence or alternatively have little probative value.
Probative material refers to anything a court may take into consideration in making a finding. Real evidence can be photographs, video and audio recordings. The Criminal Procedures Act, 51 of 1977 expressly allows for production of photographs as evidence. Video recordings, including digital recordings, are to be considered as merely a series of photographs and are therefore allowed as evidence in terms of the same section of this act.
Calibration of equipment
* Where a machine need not be calibrated, a court can take judicial notice of its accuracy or call for preliminary professional testimony that the instrument or process is generally known to be accurate or trustworthy.
* Where a machine needs to be calibrated the court will need expert evidence to prove that the particular instrument was reliable.
A camera is not an instrument that needs to be calibrated. The recorder date and time, however, needs to be set or reset, which is information supplied by human agent. The party responsible for checking or setting the time and date will have to produce additional evidence to show the correct procedure was carried out in checking or setting the time and date. This may have to be supplied in the form of an affidavit.
Printouts
Computer printouts, protocol files, etc, are real evidence. Printouts are therefore reliable in and of themselves. As such, video recordings and computer data printouts constitute very strong and direct evidence of its contents.
Authentification of computer printout
Computer printouts, which may be video or data information, must be accompanied by an affidavit authenticating such printouts. The affidavit should:
* Identify the printout and confirm that it is a computer printout as defined in the Act (Computer Evidence Act 57 of 1983).
* Confirm that it is a true copy, reproduction, transcript or interpretation of the information.
* Describe in general terms the nature, extent and sources of its data, instructions supplied to the computer and the purpose and effect of the data processed by the computer.
* Certify that the computer functioned correctly.
* Certify that no reason exists to doubt or suspect the truth or reliability of any information recorded or contained in the resultant printout.
This procedure should be followed where evidence is likely to become relevant in a trial.
Evidence obtained unconstitutionally
The test that evidence must be subjected to in order to pass the Constitutional test is:
1. Was there a personal right?
2. Was this right violated in the manner in which the evidence was obtained?
3. Would its admission render the trial unfair and/or
4. Would its admission be detrimental to the administration of justice?
The onus to prove point 1 and 2 above rest with the defense.
Ensuring admissibility
What does one need to do to ensure admissibility and maximum probative value of digital recordings and printouts of computers? Simply put, one needs to:
* Make two copies of the incident onto a stiffy or CD.
* Make sure the stiffy or CD is labelled according to the incident or case number.
* Make an affidavit as detailed in 4 above.
* Store the stiffy or CD in a sealed envelope with the operator's signature and date across any place where the envelope can be opened.
* Store these in a safe.
* One copy of the disk affidavit should be handed to the investigating officer.
* If necessary, make two video cassette recordings of the incident. Label the cassette in a similar manner to the stiffy or CD. Store these with the CD or stiffy;
* Make a copy of the original incident onto a PC workstation if this is possible.
* Do not use a stiffy, CD or cassette tape for numerous incidents. Use it only for one incident.
* Make sure that camera lenses and housing glass fronts are clean to ensure the best quality recording.

اخي الفاتح هنالك الكثير من السوابق القضائية التي اجازت قبول بينة الفيديو كاميرا غير انها احيانا تتمسك بضرورة استجواب الفني الذي قام بنصبها واستخرج مادتها .

It is claimed a garda monitoring the Pearse Street station CCTV saw a group of young people allegedly kicking a telephone box and various windows and communicated what he saw to officers on the ground who subsequently arrested Mr Stirling in the Temple Bar area.
After a District Court judge refused an application to dismiss the charges against Mr Stirling on grounds the CCTV footage was no longer available, Mr Stirling brought his High Court judicial review proceedings.
In his judgment, Mr Justice Hedigan said it was unfortunate the CCTV footage was no longer available.
The loss of the footage should not have occurred and was “indicative of a certain inefficiency on the part of gardaí” over the proper storage of this type of evidence. he said. It was imperative procedures be “tightened up”.
However, the missing footage was not fatal to this case which could not be regarded as a usual “missing evidence” matter, he said. By means of elaborate technology now deployed in Dublin, it was possible for gardaí to see “far beyond the field of vision to which they would normally be limited” as if they were looking through “a special window or through binoculars.”
The garda monitoring the cameras could give evidence in the trial and could be questioned about the accuracy of his recall, acuity of his view, quality of the picture and his opportunity to observe, the judge said.
A trial judge could ask to see an example of similar footage and would have to ensure the trial was conducted in a constitutional manner, he added. |

يا أستاذ الطيب نسأل الله أن يتقبله شهيدا فهو جلي الشهادة عندنا..
أظن المقام مقام حزن بالنسبة لاستاذ الطيب وأسرته وقد أشركونا مشكورين بما استجد إيماناً منهم بحقنا العام في دمه ونقدر ذلك حق القدر، أما بالنسبة للامور القانونية والفنية يمكن للناس أن يفتحوا "بوستاً" ويناقشوا فيه ما يودون أن يناقشوه عن تطور القانون ومواكبته للتكنولوجيا ورفدها له حيث أن الحدث لا يحتمل أن ينظر إليه أحدهم بحياد فالموت تجربة خاصة جدا لا تحتمل بحسن نية أو ما عداها جعلها غير ذلك.
