April 7, 2010 The Honorable Hillary Rodham Clinton Secretary of State U.S. Department of State 2201 C Street, NW Washington , DC 20520 Dear Madame Secretary: We are writing today on a wide range of issues related to Sudan . We are deeply concerned about the upcoming national elections. As you know, the Comprehensive Peace Agreement (CPA) between the National Congress Party (NCP) and the Sudan People's Liberation Movement/Army (SPLM/A) was designed to create a path towards democracy, equality, and a just system. Sudan is scheduled to hold its first national election in nearly 25 years, but the current circumstances make free and fair elections seem unlikely. The ruling NCP is not providing fair access to the media for opposition candidates and the security services intimidate and harass opposition supporters. The other critical issue related to the upcoming election is the presidential candidate of the ruling party, President Omar Bashir. On March 4, 2009, the International Criminal Court (ICC) issued a warrant of arrest for President Bashir for war crimes and crimes against humanity. This is the first warrant of arrest issued for a sitting head of state. According to the pre-trial judges, President Bashir intentionally directed attacks "against an important part of the civilian population of Darfur ." President Bashir has consistently ignored and dismissed the ICC indictment. We are deeply troubled that President Bashir's participation undermines the legitimacy and credibility of the elections. We strongly urge the Administration to make it clear to President Bashir that he must begin cooperating with the ICC. In October 2009, we were encouraged by the release of the Administration's Comprehensive Sudan Strategy, and we said then that full implementation of the policy objectives was critical. Unfortunately, a number of the provisions outlined in the policy have not been implemented. The new policy focuses on three priorities: an end to the conflict in Darfur; implementation of the Comprehensive Peace Agreement (CPA); and ensuring Sudan does not become a safe haven for international terrorist groups. Meanwhile, millions of displaced people in Darfur remain in camps and women and girls continue to suffer from gender based violence. Treatment and support for these victims in Darfur must be a priority, and the U.S. Government must use all diplomatic and technical resources to reduce gender based violence. The new policy pledged support for South Sudan in various sectors in addition to help preparing the country for a two-state scenario. Since October, we have not seen any serious effort in meeting these priorities. The Government of South Sudan (GOSS) continues to face many challenges. Since December of 2008 we have seen an escalation of violent ethnic clashes across Southern Sudan and humanitarian conditions have significantly worsened. According to the World Food Program (WFP) "the number of people in southern Sudan in need of food assistance has more than quadrupled from 1 million in 2009 to 4.3 million in 2010." We must take specific measure to build the capacity of the Government of South Sudan in order to be prepared for the possible secession after the 2011 referendum and provide targeted support in the security, education, and health care sectors. We are also concerned about the February 2010 framework agreement between the Government of Sudan and the Justice and Equality Movement (JEM). The parties agreed in principle to a cease-fire, the release of prisoners of war, the participation of JEM in government, and compensation to Darfur refugees and displaced people. Although a final agreement is expected soon, a number of other Darfur factions have rejected the agreement saying that it does not protect the most vulnerable groups in Darfur . We are concerned the splintering of the rebel groups makes it difficult to reach any substantive agreement that would have a positive outcome for people on the ground. This is a critical moment in Sudan 's history. We strongly urge you to fully implement the strategic objectives outlined in the new Sudan policy, and we hope to work more closely with you to achieve a more peaceful and democratic Sudan in the future. His choice of words was astonishing for its moral #####ocation. For those who follow Sudan and are aware of the numerous ways that these elections have already been corrupted beyond repair, it is clear that Gration's statement needs to be completed to be accurate. For example, the elections will be as free and fair as possible given that the only viable candidate is an indicted war criminal. Or that they will be as free and fair as possible given that millions of citizens will not be able to participate due to a flawed census and security concerns, or that they will be as free and fair as possible given that there has not been freedom of assembly or freedom of the press during the campaign. The long list of systemic problems in the electoral process have been comprehensively enumerated by independent experts at such reputable organizations as the Carter Center, the International Crisis Group and Human Rights Watch. On Monday, the Obama administration updated its position stating that it would support a "brief" delay in Sudan's elections set for next week if it would help resolve complaints about the electoral process. State Department spokesman P.J. Crowley said: The government of Sudan must also insure that all voters are able to participate in the election by improving conditions on the ground, including in Darfur and elsewhere, and by providing meaningful access to polling places. In the end, we will judge these elections based on whether they reflect the will of the Sudanese people and whether they meet international standards for elections. And we are currently seeing disturbing trends in both areas. While this new language is a step in the right direction, it still smacks of disingenuousness. The "disturbing trends" mentioned by Crowley have been evident for months and the systemic flaws in the credibility of the election are far too great to be fixed during a "brief delay," even if the government of Sudan were to cooperate, which it likely will not. It is simply not possible for the millions of people trapped in insecure and repressive IDP camps in Darfur to participate in the elections and thereby have their collective will fairly represented. Previously General Gration said that the elections are a step toward democracy for Sudan. Instead, these elections are a total travesty of democracy. While many Sudan advocates have questioned Gration's suitability for this post and have called for his replacement, it is now clear that since his management of U.S. policy has not been re-directed, the Obama administration must approve of providing political cover for an indicted war criminal. With the support of the United States, Omar al-Bashir, the man most responsible for millions of deaths in Sudan over the last 25 years, will likely soon be legitimized as President of Sudan through this "democratic" farce. An April 5 article in the Sudan Tribune states that, "The remarks by the US official [Gration] shocked many in Sudan particularly those opposed to the ruling National Congress Party (NCP) who felt that the world power has betrayed them." The article goes on to quote a 26-year old student in Khartoum by the name of Khalid who said: So he went to the Election Commission and they assured him that they are fair and unbiased. It is like asking a thief to swear he is honest and then believing him. The US wants the [National] Congress Party to stay in power because they are the only ones who are willing to give them concessions. Obama turned out to be no different from Bush. We, the ordinary Sudanese will pay the price for this selfish policy. In the midst of this travesty of justice, a group of prominent anti-genocide and human rights organizations are calling for Congress to step up its oversight of the current U.S. Sudan policy. The group has launched a social media campaign to encourage leading members of Congress to privately and publicly engage with the Obama administration on Sudan. As part of the effort, concerned citizens are writing to the four members of Congress who oversee the foreign affairs committees in the House and Senate and have the power to shape U.S. policy -- Senators Kerry and Lugar and Representatives Ros-Lehtinen and Berman -- and asking them to press the Obama Administration, both privately and publicly, for more accountability on how the current U.S. policy toward Sudan is affecting millions of innocent civilians on the ground. "At this critical moment for Sudan, Congress should hold the administration responsible for faithful implementation of the Sudan policy released last October," states Sam Bell, Executive Director of the Genocide Intervention Network. Similarly, Robert Lawrence, director of policy for the Save Darfur Coalition, said in a Voice of America article that his group is urging the United States and the international community not to legitimize Sudan's presidential election. "We believe the election is not going to be free and fair, and it's not even going to be credible, and the last thing we want is for the results to legitimize the dictatorial rule of President al-Bashir who is the overwhelming favorite obviously to win re-election," he said. During the presidential campaign Obama called the Darfur genocide a "stain on our souls" and vowed to end it by "pressuring" the Sudanese government. Instead, he has chosen to lead an Administration of which Bashir brazenly brags, "Even America is becoming an NCP member. No one is against our will."

"They spent almost a year developing this notion of a 'new policy' toward Sudan," Jendayi Frazer, assistant secretary of state for African affairs under President George W. Bush, said Wednesday in an interview with CNN's Christiane Amanpour. "And they came up with this notion of 'carrots and stick' which every administration has. So they wasted almost a whole year on a policy review, and yet they are still talking with many different voices." She said the Obama administration is sharply divided on how to tackle Sudan, the largest country in Africa, and one that is rich in oil reserves. "I think the biggest challenge for the Obama administration is they're divided. You see very mixed signals coming out from the special envoy (to Sudan) versus the secretary (of state)." Frazer said President Obama should come out and say what he thinks should happen in Sudan, which next week will hold its first multiparty elections in more than two decades. But those elections -- a key plank in the U.S.-brokered peace deal in 2005 that ended a bitter north-south civil war that cost 2 million lives -- are facing new challenges. The main opposition group, the former rebel Sudan People's Liberation Movement (SPLM), Tuesday said it will boycott most of the upcoming election races and accused the government of President Omar Hassan al-Bashir of fraud. The SPLM's Ezekiel Lol Gatkuoth, Southern Sudan's representative to the United States, told Amanpour, "It's very clear that he (al-Bashir) has rigged the election, and he wanted to win by all means to legitimize himself." He said it's very clear that conditions are not conducive for the SPLM to participate in the election in the northern part of Sudan, though he added there will still be elections in the south. The Sudanese ambassador to the United States, Akec Khoc, insisted the elections will be free of irregularities. "The minister of foreign affairs says that they are free and fair," he told Amanpour. Frazer, however, also said the Sudanese president is trying to "rig" the election, adding it's extremely unfortunate that the SPLM is withdrawing, as it is doing al-Bashir a favor by giving him a free run. "I was very confident that their (SPLM) candidate, Yasser Aman, whom I respect tremendously, would have had a chance to give the people of Sudan a choice -- so that they wouldn't have to be left with an indicted war criminal in the person of al-Bashir." Al-Bashir has been indicted on international war crimes charges over his conduct of the war in the western Darfur region, where government-backed militias have waged a brutal campaign against African tribes, killing hundreds of thousands of people. Gatkuoth declared it is only a matter of time before Sudan disintegrates, with the south breaking a way. A referendum on secession is due to be held next year under the terms of the 2005 peace deal that ended the north-south war. He said the south is cooperating with the north on what he called a peaceful divorce. "It is very important for us to have a soft landing in 2011 by having the international community engaged in this, to make sure we have a peaceful divorce," he added. "In 2011, the world should be ready to have two countries. Sudan is going to disintegrate. " But Frazer expressed concern that President al-Bashir will refuse to allow the 2011 referendum on secession to go ahead, and warned of more violence ahead if that happens. "The low-intensity conflict that we see today will escalate to a full-blown war. ... It would be a very dark future for the Sudanese people." The involvement of the international community in Sudan took a hit Wednesday, when election observers from the European Union pulled out of Darfur. General safety concerns led to the decision to remove the observers, who have been redeployed elsewhere in Sudan, the chief of the EU Election Observation Mission in Sudan, Veronique de Keyser, told CNN. It was not immediately clear what the effect the withdrawal might have on the election.
