Field Violations Report No-1 #####ng and Threatening with Full Impunity The Report: On Friday 5 March 2010, a convoy of 21 commercial trucks from El-Nahid Transportation Company (UNAMID contractor) was stopped by Sudan Liberation Movement of Mini Minawi (SLA-MM) in North Darfur/Shangel Tubai on the main road Nyala/El-Fashir around 14:00 hours. The team (45 staff-members) was reported to be harassed, looted, threatened and blocked from proceeding to Nyala for about five hours. The incident has taken-place while the convoy was in its weekly trip from El-Obied to Darfur. The convoy had to negotiate its access to Nyala and grantee the safety of its team under a lot of psychological pressure as the discussion had done under threat. The SLA-MM commanders in Shangel Tubai have taken 42 barrels of fuel and 1100 SDG (approximately 500 USD) from the company before giving a conditional access to the team throughout the areas under their control. SLA-MM told the convoy leader that the company should buy its access with paying the same amount of money and fuel each time the convoy passes through Shangel Tubai. . One of the convoy drivers (S.E) reported to HAND that it took them more than five hours to negotiate a deal with Miniawi’s commanders while the convoy was at gun-point. He added that the Sudanese Police Forces were present in the location at the time of the incident, but did not intervene to enforce the law. Another driver from the same company (M.D) believes that the Police Forces normally share the looted stuff with the SLA-MM afterword. He also reported that his company pays approximately 2500 USD as a ransom to pass more than 60 unofficial check-points between El-Obied and Nyala per-week. Appeal and Intervention: Human Rights and Advocacy Network for Democracy (HAND) sends urgent request to the Senior Assistant to the President of Sudan, Mini Minawi and his movement (SLA-MM) to take serious action to stop derogation of human rights, restriction of freedom of movement, jeopardizing the lives of civilians, illegal collection of taxes and to investigate the seizure of the right of freedom of movements of El-Nahid Company. In similar incidents in the same areas controlled by Mini Minawi there were several reports of violations against movement of goods, necessary items and blockade of civilian’s urgent needs. It is urgently needed from SLA-MM to stop all kinds of illegitimate acts which are prohibited by National laws, as well as by International Humanitarian Law and Human Rights Law. HAND calls upon SLA-MM to stick to the memorandum of understanding that the movement had signed in Abuja in 2006 with the ICRC, which has assured the protection of civilian population and granteed the freedomof movement of assistants and goods throughout their controlled areas.
