قبل قضاة الاستئناف في المحكمة الجنائية الدولية الاستئناف الذي قدمه المدعي العام مورينو اوكامبو ضد قرار سابق بعدم قبول تهمة "الابادة الجماعية" ضد الرئيس السوداني عمر حسن البشير في اقليم دارفور السوداني.
وطلب الاستئناف من المحكمة اعادة النظر في قرارها السابق.
وقال القاضي اريك كورولا "على الغرفة التمهيدية الأولى بالمحكمة الجنائية الدولية اتخاذ قرار جديد" لان القرار السابق والذي خلا من تهم الابادة الجماعية جاء بناء على "قواعد غير سليمة للادلة".
اصدرت المحكمة مذكرة اعتقال للبشير سابقا
واضاف ان الاستئناف لن يستجيب لطلب المدعي تحميل البشير المسؤولية الجنائية عن جريمة الابادة كما طلب المدعي.
وفي اول رد فعل سوداني على القرار وصف مسؤول اعلامي رفيع القرار بانه مسيس ويهدف الى عرقلة الانتخابات التي من المقرر ان تجرى في ابريل/نيسان المقبل.
وقال "ان الهدف الوحيد لهذا القرار عرقلة جهود الحكومة السودانية لاجراء الانتخابات وانتقال السلطة بشكل سلمي".

وقد رحبت كبرى الجماعات المسلحة في الاقليم بالقرار وقالت حركة العدل والمساواة انها ستعيد النظر بقرارها المشاركة في مفاوضات السلام حول الاقليم التي ترعاها قطر.
وقال ممثل الحركة في مفاوضات السلام احمد توغود "هذا قرار صحيح حيث ما رأيناه على ارض الواقع في دارفور يصل الى مستوى الابادة الجماعية".
واضاف ان الحركة لا ترى انه من المقبول اخلاقيا الجلوس على طاولة المفاوضات مع حكومة "متهمة بارتكاب جرائم ابادة ضد ابناء شعبنا".
وكانت المحكمة قد ادانت البشير بارتكاب جرائم حرب وارتكاب جرائم ضد الانسانية في شهر مارس آذار الماضي فيما رفضت حينها اتهام البشير بتهمة "الابادة الجماعية" لعدم كفاية الادلة التي تدين الحكومة السودانية بالسعي لتدمير قبائل الفور والمساليت والزغاوة.
لكن الادعاء استأنف ضد قرار المحكمة وقال انه قدم ما يكفي من الادلة لتوجيه تهمة الابادة الجماعية للبشير.
وكانت المحكمة عند اصدراها مذكرة اعتقال للبشير قد قالت ان هناك ما يكفي من الادلة لاتهامه بالقتل والتصفية العرقية والتعذيب والاغتصاب ومهاجمة المدنيين في دارفور كما طلب الادعاء من دون اتهامه بالتهمة الاخطر وهي "الابادة الجماعية".
وسواء اضيفت هذه التهمة الى المذكرة او لم تضف، فان البشير قد يبقى حرا طليقا، فالمحكمة لا تملك شرطة خاصة بها، وتعتمد على تعاون الدول في تقديم المتهمين للمحاكمة.

وسيكون على القضاة في الجلسة الإجرائية التي تسبق المحاكمة أن يقرروا ما إذا كانوا سيضيفون تهمة الإبادة الجماعية إلى صحيفة الاتهام الموجهة للبشير التي تتضمن سبع تهم بارتكاب جرائم ضد الإنسانية
وجرائم حرب منها القتل والتعذيب والاغتصاب.
وقال مراسل الجزيرة في بروكسل لبيب فهمي إن القرار كان مفاجئا لأن المحكمة التمهيدية كانت قد أكدت سابقا عدم وجود دلائل كافية تدل على أن البشير يمكن أن يكون قد ارتكب فعلا جرائم إبادة.
وأشار إلى أن محكمة الاستئناف رأت أن سقف الدلائل كبير على الرغم من أنه لم يجر تقديم دلائل جديدة بل إن القرار الجديد يلزم المحكمة التمهيدية بالعودة مجددا للنظر في الدلائل التي كان قد قدمها الادعاء سابقا
للنظر في احتمال إضافة أو عدم إضافة تهمة جديدة تتعلق بالإبادة لتهم الرئيس السوداني.

THE HAGUE (Reuters) - The International Criminal Court must rule again on whether Sudanese President Omar Hassan al-Bashir must face an additional charge of committing genocide in Darfur, appeals judges at the tribunal ruled on Wednesday.

The judges reversed a decision that prosecutors had not provided sufficient evidence to add genocide to Bashir's charge sheet, which already includes seven counts of crimes against humanity and war crimes, including murder, extermination, torture and rape.
"The decision by the pre-trial chamber not to issue a warrant in the respect of the charge of genocide was materially affected by an error of law and it is for this reason the appeals chamber has decided to reverse the decision," ICC judge Erkki Kourula said in reading the appeal ruling.
Kourula said the appeals chamber would not grant the prosecutor's request for a ruling that Bashir was criminally responsible for the crime of genocide.
But legal observers said the decision to require the pre-trial chamber take another look at the genocide question brought the prospect of such a charge a step closer.
Sudan said the ruling was political in its timing and aimed at hindering Sudan's first democratic elections in 24 years, which are due to be held in April.
"This procedure of the ICC is only to stop the efforts of the Sudanese government toward elections and a peaceful exchange of power," Rabie Abdelati, a senior information ministry official, told Reuters in Khartoum.
He said last year's ICC arrest warrant for Bashir had not affected his movements or his nomination for the presidential elections and Wednesday's ruling would be no different.
"Our president has visited a lot of countries and right now he is in Qatar for the second or third time," Abdelati added.
"We are not bothering actually what the ICC will say, whether it includes genocide or not."
Bashir has repeatedly dismissed the allegations made by the ICC, the world's first permanent court for prosecuting war crimes, as part of a Western conspiracy. The Sudanese government has refused to co-operate with the court.
'GET A LAWYER'
ICC Chief Prosecutor Luis Moreno-Ocampo welcomed the decision and warned Bashir he needed to "get a lawyer," adding he would present fresh evidence to the court in a second bid to have Bashir charged with genocide.
"Expelling humanitarian assistance is a great element of his genocidal intentions," Moreno-Ocampo told Reuters.
"When he expelled these people who were providing the water and the food he confirmed his intention to destroy his people. So I would like to present this new aspect of the case."
The arrest warrant against Bashir was the first ever issued against a sitting head of state by the ICC. It prompted Bashir to expel international aid agencies last year.
Darfur's main rebel group welcomed the ICC's decision, saying they would now reconsider taking part in peace talks.
"This is a correct decision," said the chief negotiator for the Justice and Equality Movement (JEM) Ahmed Tugud. "We believe that what we have seen on the ground in Darfur amounts to a crime of genocide."
"Now we are assessing our situation on whether it is ethically possible to negotiate with a government accused of committing genocidal crimes against our people."
Tugud spoke from Doha, where JEM has been holding discussions with Khartoum supposed to lead to full peace talks.
Adding a charge of genocide to the arrest warrant could further isolate Bashir and provoke further unrest in Darfur, where 4.7 million people have been left dependent on aid by a seven-year conflict.
The investigation into Darfur was launched in June 2005 after the United Nations Security Council referred the situation to the ICC.
In its ruling on Wednesday, the appeals chamber said the pre-trial chamber had placed too high a threshold on the evidence needed to include genocide in the arrest warrant.
Before the ruling, Sudan presidential adviser Bona Malwal told Reuters the timing of the ICC announcement, less than 10 weeks before Bashir is due to stand in presidential elections, proved it was pursuing a political agenda against the president.
Mostly non-Arab rebels took up arms in Darfur in 2003 accusing central government of neglecting the remote region. Khartoum mobilized militias to quell the revolt, sparking a humanitarian crisis which the United Nations estimates has claimed 300,000 lives. Bashir puts the death toll at 10,000.
Washington, Darfur rebels and activists all call Darfur's conflict genocide. A U.N.-appointed commission of inquiry found no genocide, but said some individuals may have acted with genocidal intent.

(CNN) -- Judges at the International Criminal Court ruled Wednesday that Sudanese President Omar al-Bashir may be charged with genocide for his role in a five-year campaign of violence in western Sudan's Darfur region.
Al-Bashir, who remains in office, has already been charged with war crimes and crimes against humanity. Prosecutor Luis Moreno-Ocampo had the genocide charge on his original arrest warrant for al-Bashir, but the pre-trial judges left off the charge when they approved the warrant last March.
Moreno-Ocampo appealed in July, saying that the judges' standard for adding the genocide charge was too high. The appellate court agreed with Moreno-Ocampo and ruled in his favor Wednesday.
The appeals judges said the pre-trial chamber had applied an "erroneous standard of proof" to the genocide charge.
The judges said they were not ruling on whether al-Bashir should be charged with genocide -- only whether the charge could be added to the arrest warrant. They said it will be up to the pre-trial chamber to determine whether to add the charge to the warrant, which could take several weeks.
The International Criminal Court at The Hague, Netherlands, is a permanent, treaty-based tribunal dealing with the most serious crimes against humanity.
It is an independent court that is not part of the United Nations. It is funded primarily by nations, but also receives contributions from governments, corporations and individuals.
Even if genocide is added to the arrest warrant, Moreno-Ocampo still faces a challenge in proving the charges at trial, said Mark Ellis, the executive director of the International Bar Association.
"Genocide is a much more complicated legal position to meet (than war crimes and crimes against humanity), because you have to show in proving genocide that there was an intent to destroy, in whole or in part, a group based on -- in this case -- ethnicity or race," Ellis told CNN in July. "Obviously, the prosecutor believes he would be able to prove this intent and so he wants the opportunity to prove that in trial."
The warrant for al-Bashir was the first ever issued by the ICC for a sitting head of state. It currently includes five counts of crimes against humanity, including murder, extermination, forcible transfer, torture and rape. It also includes two charges of war crimes for intentionally directing attacks against civilians and for pillaging.
Al-Bashir has traveled to several countries since the warrant was issued, even though any country that is party to the ICC has an obligation to hand him over to The Hague, the court says.
He openly attended the African Union conference in Ethiopia, which ended this week. Ethiopia is not party to the ICC.
Al-Bashir is the front-runner in an election scheduled to take place in April, and a genocide charge is unlikely to harm his prospects.
A genocide charge could further isolate Sudan, but it could also mobilize African nations around Sudan. Leaders from several African countries have said the ICC has been unfair to Africa, and they have threatened to pull out of the court.
The United Nations estimates that 300,000 people have been killed in the conflict in Darfur, and 2.5 million have been forced from their homes. Sudan denies that the death toll is that high.
The violence in Darfur erupted in 2003 after rebels began an uprising against the Sudanese government. To counter the rebels, Sudanese authorities armed and cooperated with Arab militias that went from village to village in Darfur, killing, torturing and raping residents, according to the United Nations, Western governments and human rights organizations.
The militias targeted civilian members of tribes from which the rebels drew strength.

لكن الموضوع بقول تم قبول الاستنئاف ضد قرار عدم القبول
ودا معناهوا القرار الجديد لسة ما طلع سوي كان بقبول اضافة التمهة او رفضه

سلطة محكمة الاستئناف عادة ما تكون اما برفض الاستئناف او قبوله
وفي حالة قبوله تقرر اما
الغاء القرار المستانف واصدار قرار جديد
واما اعادة الملف الي الدائرة التمهيدية لتصدر القرار بنفسها حسب ما جاء بالمذكرة
وطالما ان القرار قد جاء بمخالفة القرار المستانف للقانون فان ذلك بمثابة وضع للقرار
امام الدائرة التمهيدية لتصدره بنفسها، حيث من غير الجائر ان تقول بان قرارها لم
يكن مخالفا للقانون .
