Quote: Sudanese president said to be mulling end-month trip * Bashir no "chicken thief", Kampala says By Justin Dralaze KAMPALA, July 13 (Reuters) - Uganda said on Monday it would consider acting on an International Criminal Court (ICC) warrant against Sudan's President Omar Hassan al-Bashir if he comes to Kampala for an international conference at the end of the month. But Bashir -- whom the ICC has indicted over crimes in Sudan's western Darfur region -- is not a "chicken-thief" to be pursued unceremoniously, added Okello Oryem, a junior foreign minister responsible for international relations. "So until Bashir is here, I cannot tell you if or not he will be arrested," he said at a news conference together with ICC chief prosecutor Luis Moreno-Ocampo. Media in the region say Bashir has been considering attending a global affairs meeting, called Smart Partnership Dialogue, along with other ######### of state, at the end of July. Sudanese officials seldom confirm his trips in advance. Uganda is a signatory to the ICC, so a visit by the Sudanese leader would force Kampala to decide if it implements or ignores the arrest warrant, which has stirred controversy across Africa. Moreno-Ocampo said Uganda would be obliged to arrest the Sudanese president, and cited the case of South Africa where he said the possibility of detention stopped him attending President Jacob Zuma's inauguration in May. "LEGAL OBLIGATION" "South Africa informed Bashir that he could be invited to President Zuma's inauguration, but if he is there he could be arrested," the ICC prosecutor said. "It's a legal obligation not a political decision, it's a court decision and Uganda, South Africa and the 30 African (member) state parties have this legal obligation, it's clear." The Ugandan official, Oryem, said Kampala had an "unwavering" commitment to the ICC statute. "The warrant against Bashir is already deposited here in the solicitor general's office," he said, adding that police inspector-general Kale Kayihura would take any final decision. "If and when Bashir arrives here in Uganda, then it is up to Kayihura to see to it that he takes action if and when it arises," he said. "On the other hand, he (Bashir) is not a chicken thief whom you start arresting in an unceremonial manner so let's wait for Bashir to arrive and see what the government of Uganda would do." The ICC has indicted Bashir on seven counts of war crimes and crimes against humanity, including murder, rape and torture. He has dismissed the allegations as part of a Western conspiracy, and the African Union has sought a deferment of the indictment, saying it is complicating peace efforts in Darfur. An AU summit in Libya earlier this month voted to suspend cooperation with the ICC in the matter. Fighting between Sudan's government, its allies and a myriad of rebel groups in Darfur has claimed as many as 300,000 lives, according to the United Nations. Khartoum says only 10,000 have died since the ethnic and politically driven Darfur conflict flared in 2003. Henry Oryem Okello, Uganda's minister for international affairs, spoke after meeting with the International Criminal Court's chief prosecutor, Luis Moreno Ocampo, in Kampala. "It is a legal obligation for Uganda to arrest Bashir if he comes to Uganda," Ocampo said. Earlier this month at an African Union summit, Africa's leaders criticized the International Criminal Court and refused to extradite al-Bashir, who has been indicted for crimes against humanity in Darfur. Sudan welcomed the move, and other Africans said it was a signal that the West should not impose its ways on Africa. But several African leaders appeared to strongly disagree with the AU statement, and Benin Foreign Minister Jean-Marie Ehouzou said Sudan's neighbor and antagonist, Chad, objected to the wording. ######### of state at AU summits reach decisions by consensus behind closed doors, not from a vote, and it was not clear how the measure was approved. A fugitive rebel leader in Uganda, Joseph Kony, also is wanted by the international war crimes court. Kony is the leader of the notorious Lord's Resistance Army, which has waged a vicious two-decade insurgency in northern Uganda. But Kony, who has not been seen in public since 2006, wants clarification on how the government will address charges of atrocities against him and other rebels, mediators say. Ugandan President Yoweri Museveni has agreed to approach the international court and request that the indictments be withdrawn if Kony signs a final peace deal. But any decision to drop the international charges would have to be approved by judges at the court, who would first want to be sure the rebels get a proper trial in Uganda.

Quote: كمبالا (رويترز) - قالت اوغندا يوم الاثنين إنها ستبحث مذكرة قبض صادرة من المحكمة الجنائية الدولية ضد الرئيس السوداني عمر حسن البشير اذا جاء الى كمبالا في مؤتمر دولي في نهاية الشهر. لكن اوكيلو اوريم الوزير بوزارة الخارجية المسؤول عن العلاقات الدولية قال إن البشير ليس "لص دجاج" حتى يلاحق بطريقة روتينية. وكانت المحكمة الجنائية الدولية قد وجهت الاتهام الى البشير بارتكاب جرائم في اقليم دارفور بغرب السودان. وقال في مؤتمر صحفي مع كبير ممثلي الادعاء بالمحكمة الجنائية الدولية لويس مورينو اوكامبو "لذلك الى ان يأتي البشير الى هنا لا يمكنني ان اقول لكم ما اذا كان سيتم القبض عليه أم لا." وتقول وسائل الاعلام في المنطقة ان البشير يبحث حضور اجتماع بشأن الشؤون العالمية يطلق عليه "حوار الشراكة الذكي" مع رؤساء دول اخرى في نهاية يوليو تموز. ونادرا ما يؤكد المسؤولون السودانيون رحلات الرئيس سلفا. واوغندا موقعة على اتفاقية المحكمة الجنائية الدولية لذلك فان أي زيارة يقوم بها الرئيس السوداني ستضطر كمبالا الى اتخاذ قرار بشأن ما اذا كانت ستنفذ تعهداتها أو تتجاهل أمر القبض الذي أثار جدلا في انحاء أفريقيا. وقال مورينو اوكامبو ان اوغندا ستكون ملزمة بالقبض على الرئيس السوداني واشار الى حالة جنوب افريقيا حيث منعه احتمال القبض عليه من حضور تنصيب الرئيس جاكوب زوما في مايو ايار. وقال كبير ممثلي الادعاء بالمحكمة الجنائية الدولية "جنوب افريقيا أبلغت البشير انه يمكن دعوته لحضور مراسم تنصيب الرئيس زوما لكنه اذا جاء فانه قد يتم القبض عليه." وأضاف "انه التزام قانوني وقرار سياسي وهو قرار محكمة واوغندا وجنوب افريقيا والدول الثلاثون الاخرى اطراف في هذا الالتزام القانوني. وهذا واضح." وقال المسؤول الاوغندي اوريم ان كمبالا عليها التزام "لا يتزعزع" ازاء قانون المحكمة الجنائية الدولية. وقال "امر القبض ضد البشير اودع بالفعل هنا في مكتب المحامي العام" مضيفا ان المفتش العام للشرطة كالي كايهورا سيتخذ أي قرار نهائي. وقال "اذا وصل ... وعندما يصل .. البشير الى هنا في اوغندا فان الامر متروك الى كايهورا لكي يتابع الامر وان يتخذ اجراء .. اذا .. وعندما.. يطرح الامر." واضاف "من ناحية اخرى فانه (البشير) ليس لص دجاج تقوم ببدء اعتقاله بطريقة روتينية لذلك دعونا ننتظر البشير حتى يأتي ونرى ما الذي ستفعله حكومة اوغندا." ووجهت المحكمة الجنائية الدولية الى البشير سبع اتهامات بارتكاب جرائم حرب وجرائم ضد الانسانية من بينها القتل والاغتصاب والتعذيب. ونفى البشير هذه المزاعم ووصفها بأنها جزء من مؤامرة غربية وسعى الاتحاد الافريقي الى تأجيل الاتهامات قائلا انها تعقد جهود السلام في دارفور. وصوتت قمة للاتحاد الافريقي في ليبيا في وقت سابق من الشهر الحالي على تعليق التعاون مع المحكمة الجنائية الدولية بشأن هذا الموضوع. وتتراوح تقديرات أعداد القتلى بين عشرة الاف وهو الرقم الذي تعلنه الخرطوم و300 ألف وهو ما يقوله جون هولمز مساعد الامين العام للامم المتحدة للشؤون الانسانية.
