    The U.S. embassy in Sudan is concerned by the recent detentions of Dr. Hassan al-Turabi and Dr. Bashir Adam Rahama and the previous detention of Ali Mahmud Hassanein by the Government of Sudan. This does not contribute to a political atmosphere that is conducive to organizing free and fair elections in 2009. As Sudan begins to prepare for these elections, we urge the authorities to respect an open exchange of viewpoints and fully uphold the freedom of expression so vital to upholding a functioning civil society.

    ان سفارة الولايات المتحدة فى السودان مهتمة بالاعتقالات الاخيرة لكل من د. حسن عبدالله الترابى
    ود. بشير ادم رحمة والاعتقال السابق لعلى محمود حسنين من قبل حكومة السودان. وهذا الاعتقال لا يسهم فى خلق المناخ الملائم لقيام انتخابات حرة وعادلة فى 2009. وبما ان السودان يبدأ بالترتيبات لهذه الانتخابات ، فاننا نحث السلطات لاحترام وجهات النظروالضمان الكامل لحرية التعبير والتى هى ضرورة لضمان مجتمع مدنى فاعل.

    Dr Hasan Al-Turabi, Secretary General of Popular People’s Congress Party (PCP), was arrested on 14 January 2009, following certain comments he made with regards to the widely expected ICC warrant against Sudanese President Omer Hassan Al-Bashir.


    2. Background

    Arrest

    Dr Hasan Al-Turabi, Secretary General of Popular People’s Congress Party (PCP), and Dr Bashir Adam Rahma, the External Relations Secretary of the party, were arrested on 14 January 2009 in Khartoum. According to report by Amnesty International (AI), Dr Al-Turabi was taken from his home by armed agents of Sudanese National Intelligence and Security Services (NISS), and has since been held incoummunicado and without charge. He was recently transferred to Kober prison from the NISS detention centre where he was initially held, reports stated.


    Reasons

    It is reportedly believed that Dr Al-Turabi was arrested in relation to recent comments he made about the President Omer Hassan Al-Bashir, calling on him to surrender to the International Criminal Court. He reportedly stated last Monday, 12 January 2009, “He [President Al-Bashir] should assume responsibility for whatever is happening in Darfur, displacement, burning all the villages, rapes, I mean systematic rapes, continuously, I mean on a wide scale and the killing.”

    An ICC warrant is widely expected against the Sudanese President after the ICC Chief Prosecutor Luis Moreno-Ocampo filed a number of charges on 14 July 2008, with the ICC board for review against President Al-Bashir, consisting of “…three counts of genocide, five of crimes against humanity and two of murder and accused Al-Bashir of masterminding a campaign to get rid of the African tribes in Darfur; Fur, Masalit and Zaghawa.”

    According to AI, Dr Al-Turabi is one of the many individuals who have been recently arrested, especially since 14 July 2008, for their peaceful use of their right to freedom of expression.

    With the ICC warrant imminent, the government is reportedly doing their utmost to curb any dissension against the regime by suppressing all views in support of the warrant. The spokesperson for the Sudanese cabinet has been quoted as saying, “There is zero tolerance to any attempts to break the national consensus. We will not allow any movements to create instability and confusion.”


    Prison and health conditions

    AI has called for Dr Al-Turbai’s immediate release and has appealed against the PCP’s leader’s detention conditions and his denial to medication and specific diet that he requires. AI reports state that Dr Al-Turabi is about to turn 77 and thus has special requirements with regards to his health and food which are not being met in prison.

    Further, according to reports, Dr Al-Turabi’s family has not allowed to see him nor have they been informed of his health conditions and treatment in prison. His lawyers and family members are also unaware about the reason for his arrest.

    Hassan Al Turabi, leader of the opposition group Popular Congress Party (PCP), was arrested on 14 January by armed agents of the Sudanese National Intelligence and Security Services (NISS), at his home in the capital, Khartoum. He has been held incommunicado, without charge, since then, and has had no access to medical treatment.
    Although his family followed him to the NISS detention centre, they were not allowed to go in with him. The NISS have since refused to allow them to see him, to give him his medicine and special food.

    Al Turabi is about to turn 77 and requires medication as well as a special diet (his doctors have told him not to eat spicy or salty food). He was first held at an NISS detention centre, and then moved to Kober prison in Khartoum.

    Al Turabi’s arrest came two days after he addressed journalists in the PCP offices: he told them that President Al Bashir should present himself to the International Criminal Court and face trial, to spare Sudan further internal crisis and collapse. He told them that, because he was in power, President Al-Bashir was politically responsible for the crimes such as killings, rape, displacement and burning of the villages that have been taking place since 2003 in Darfur.

    Al Turabi has not been charged with any offence. Neither his family nor his lawyer have been officially informed of the reasons for his arrest. His family do not know how he is being treated, or how his health has been affected.

    Hassan Al Turabi is the latest in a series of individuals, including human rights activists and others, detained solely for the peaceful exercise of their right to freedom of expression in Sudan, particularly since on 14 July 2008, when the ICC Prosecutor applied for a warrant for the arrest of President Al Bashir. Some of those arrested and detained were tortured and otherwise ill-treated.

    Amnesty International believes that Al Turabi’s arrest is arbitrary, carried out in response to his 12 January statement to journalists.

    PCP leader Hassan Al Turabi, who was one of the people behind the 1989 coup d'état that brought President Omar Al Bashir to power, had fallen out with the president. He was imprisoned in Kober from February to May 2001, after which he was put under house arrest until October 2003, when he was pardoned by presidential decree. He was never brought to trial. He was again incarcerated between 2004 and 2005.

    BACKGROUND INFORMATION

    Although Sudan’s Criminal Procedure Code contains safeguards against incommunicado detention, Article 31 of the National Security Forces Act, which governs arrests by the NISS, allows incommunicado detention without charge for up to nine months. This increases the likelihood of torture and other ill-treatment.

    RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in English or your own language:
    - urging the authorities to charge Hassan Al Turabi with a recognisable criminal offence or else release him immediately;
    - urging them to allow Hassan Al Turabi immediate access to his family, legal representation and any medical treatment he may require;
    - urging them to immediately stop the harassment and unlawful arrest of human rights activists and members of the opposition for the peaceful exercise of their right to freedom of expression and assembly;
    - urging the authorities to repeal Article 31 of the National Security Forces Act, which allows detainees to be held for up to nine months without access to judicial review.

    وكانت الهيئة القيادية للمؤتمر الشعبي قد عقدت اجتماعها عقب الإعتقال حيث أعلنت دعهمها الكامل للمعتقلين وطالبت باطلاق سراحهم، كما قررت وقف كافة اشكال الإتصالات بالمؤتمر الوطني، وقررت تكثيف الإتصال بالقوى السياسية بهدف تسريع وتيرة التشاور لتجنيب البلاد الدخول في نفق المواجهة مع المجتمع الدولي.

    وفي المؤتمر الصحفي للحزب أكد الأستاذ عبدالله حسن أحمد والأستاذ كمال عمر المحامي أن الأمين العام للمؤتمر كان يتحدث بلسان الهيئة القيادية وعبر عن موقف الحزب المعلن من ضرورة التعاون مع المحكمة الدولية والتعامل الجاد مع قضية اتهام الرئيس البشير عوضا عن التمترس خلف شعارات تعبر عن جهل تام باجراءات المحكمة الجنائية الدولية وتطورات قضية الإتهام الموجه للرئيس البشير.
