International Court to probe alleged Darfur war crimes
The International Criminal Court (ICC) in The Hague is to formally investigate war crimes in the Sudanese region of Darfur.
The chief prosecutor prosecutor is expected to announce details of his investigation later today.
A special United Nations commission of inquiry on Darfur has given the ICC a list of 51 potential war crimes suspects.
An estimated 180,000 people have died in Darfur, in one of the world's worst humanitarian crisis.
About two million others have been displaced since the conflict between rebels and government backed militia began two years ago.

The International Criminal Court will launch a formal investigation into allegations of war crimes in Sudan's troubled Darfur region, officials familiar with the case said Sunday.
The court has been analyzing the situation in Darfur since the United Nations referred to it allegations of rape, murder and plunder in April, following a U.N. Security Council vote. Dozens of court officials have begun preparing for the investigation, the largest and most important yet to be handled by the fledgling body since it was established in July 2002.
Prosecutors were to announce the decision to move forward in Darfur on Monday, and Chief Prosecutor Luis Moreno-Ocampo will brief the U.N. about his plans later this month in New York, the officials said, adding that they could not comment officially until the investigation had been formally announced by the court.
The vast western Sudanese region of Darfur is the scene of one of the world's worst humanitarian crises. An estimated 180,000 people have died _ many from hunger and disease _ and about 2 million others have been displaced since the conflict began in February 2003.
The referral of the Darfur case was made possible when the United States _ which fiercely opposes The Hague-based court _ backed away from exercising its veto powers as a permanent member of the Security Council.
Washington, which says it fears the court will initiate bogus charges against American nationals, has actively undermined it by signing nearly 100 bilateral treaties with countries that have agreed not to surrender U.S. citizens to the court.
Meanwhile, 99 countries have ratified the court's founding treaty, including all of American's major allies in the European Union.
A special U.N. commission of inquiry on Darfur, which spent several months gathering evidence of war crimes, handed the court its findings, including a list of 51 potential suspects.
Darfur's crisis erupted when rebels took up arms against what they saw as years of state neglect and discrimination against Sudanese of African origin. The government is accused of responding with a counterinsurgency campaign in which the ethnic Arab militia known as Janjaweed committed wide-scale abuses against ethnic Africans.
Trials are planned later this year at the International Criminal Court against alleged perpetrators of war crimes in two other violence-wracked African nations, Uganda and Congo.
The court is intended to step in only when countries themselves are unable or unwilling to take action against war crimes, crimes against humanity and genocide committed on their soil.

The International Criminal Court (ICC) in The Hague was expected on Monday to announce the launch of a war crimes probe into atrocities committed in Sudan's western Darfur province, sources here said.
The court's chief prosecutor, Luis Moreno Ocampo, who was expected to make the announcement, was initially unavailable for comment.
UN Secretary General Kofi Annan has given the ICC the names of 51 suspected war criminals, following an international investigation into abuses in Darfur, torn by a conflict that has claimed an estimated 180,000 lives.
The United Nations inquiry in January found that Sudanese government forces and militias had committed abuses including murder, torture, rape and pillage in the suppression of the two-year-old ethnic minority uprising in Darfur.
It established that war crimes and human rights violations had been committed in the province, while falling short of the definition of genocide.
The UN Security Council adopted a resolution in early April calling for the 51 named suspects, including senior officials, to face prosecution before the ICC, overriding strong opposition from Khartoum.
Sudan has vowed to defy the Security Council's demand for international prosecution of the officials, security force and militia commanders accused of violations in Darfur.
Between 180,000 and 300,000 people have been killed and 2.4 million made homeless in Darfur since a rebel uprising in early 2003 prompted Khartoum to unleash militias in a scorched-earth campaign.
Annan, on a visit to the region late last month, warned that time was fast running out to save Darfur.

Prosecutors said in a statement their inquiries will be "impartial and independent, focusing on the individuals who bear the greatest criminal responsibility."
The court has been analyzing the situation in Darfur since the United Nations referred to it allegations of rape, murder and plunder in April, following a U.N. Security Council vote. Dozens of court officials have begun preparing the investigation, the largest and most important yet to be handled by the court since it was established in July 2002.
"The investigation will require sustained cooperation from national and international authorities. It will form part of a collective effort, complementing African Union and other initiatives to end the violence in Darfur and to promote justice," Chief Prosecutor Luis Moreno-Ocampo said in prepared comments.
Moreno-Ocampo will brief the U.N. in New York about his plans to investigate Darfur later this month.
Sudan has indicated it will not cooperate with the Hague-based court, saying it intends to set up its own tribunal to prosecute crimes.

months, rather than years. Once they have gathered evidence and interviewed witnesses, court officials will then consider issuing indictments against individual suspects and seek their extradition to The Hague.

الخرطوم (رويترز) - قال السودان يوم الاثنين إنه لن يرحب بتحقيقات المحكمة الجنائية الدولية التي تهدف لمقاضاة أشخاص مشتبه في ارتكابهم جرائم الحرب في اقليم دارفور بغرب البلاد.
وقال مجذوب الخليفة رئيس وفد الحكومة في محادثات دارفور لرويترز إنه يرحب بارسال المحكمة الجنائية الدولية وغيرها لمراقبين لحضور المحاكمات في المحاكم السودانية. وقال إنه إذا كان ثمة من يريدون مراقبة ما يحدث من المحكمة الجنائية الدولية وغيرها فهم موضع ترحيب أما إذا كانوا يريدون بدء محاكمات للسودانيين فهذا غير مقبول مضيفا أن التحقيق جزء من منظومة المحاكمة.
وبدأت المحكمة الجنائية الدولية في وقت سابق يوم الاثنين تحقيقا رسميا في مزاعم وقوع جرائم حرب في دارفور. وتقول الحكومة السودانية إنها لن ترسل مواطنيها إلى محكمة خارج البلاد.
ولقي عشرات الالاف مصرعهم خلال عامين من التمرد في دارفور واتهمت ميليشيات عربية متحالفة مع الحكومة بشن حملة واسعة النطاق من القتل والاغتصاب والنهب.
وقال مجلس الأمن الدولي إن السودان لم يفعل سوى القليل لتقديم هؤلاء المسؤولين إلى العدالة واصدر أوامره للمحكمة الجنائية الدولية ببدء تحقيق وهذه أول احالة من نوعها إلى المحكمة.
وقال السودان في مارس آذار إنه اعتقل للمرة الاولى 15 من العسكريين وأفراد الامن بتهمة قتل واغتصاب المدنيين واحراق القرى في دارفور. وقال وزير العدل إن المحاكم المحلية في دارفور سوف تحاكمهم.
وقال خليفة إن الحكومة بدأت بالفعل عملية التحقيق والمحاكمة في جرائم دارفور ودعا مراقبين دوليين لمتابعة هذه العملية.
وقال إن الابواب مفتوحة والخبرات مدعوة ليس فقط من المحكمة الجنائية الدولية لكن اي شخص يريد مراقبة النظام القضائي السوداني خاصة في هذه القضية المتعلقة بدارفور.
وقال خليفة الذي يرأس الادارة السياسية للحزب الحاكم الذي يسيطر على الحكومة والبرلمان انه واثق من انهم سوف يشعرون بالرضا ازاء هذا النظام القضائي.
وينص تشريع انشئت بموجبه المحكمة الجنائية الدولية على ان اي مشتبه به في عمل اجرامي يحاكم في محكمة وطنية موثوقة وعادلة لايمثل امام الحكمة الجنائية الدولية التي يوجد مقرها في لاهاي.
ومع ذلك فان لجنة عينتها الامم المتحدة لبحث جرائم الحرب المرتكبة في دارفور قالت انها لا تعتقد أن النظام القضائي السوداني بمقدوره اجراء محاكمات موثوق بها.

| Quote: تابعت قبل قليل برنامج في المواجهة على الفضائية السودانية. البرنامج عكس زيارة السيد عمرو موسى أمين عام الجامعة العربية إلى دارفور في صحبة وزير الداخلية. كانت المناسبة الصلح المفترض مابين قبيلتي المساليت والهبانية. المتحدثون ألقوا ما حدث على كاهل الشيطان. وأتفقوا على أن الله قال أخيرا للصلح كن فكان. وبحث السيد مقدم البرنامج عن دور الحكامات (أي والله). ونصحهم بصورة فجة هنا وهناك على ضرورة التكاتف وهداية أبناءهم الذين يصرون على مايبدو على التمرد. كان يضع ذراعه على أكتافهم وهو يتحدث على طريقته. حتى أني تذكرت حديث احدى ربات البيوت لبرنامج الصباح قبل أيام. حين اتصلت عبر الهاتف من مدني وشكت من كثرة "برامج الكلام" المملة. وقد خصت برنامج طيب الذكر على نحو جعل المذيع الشاب يبتسم ببراءة. |

تعليقاً على إعلان النائب العام للمحكمة الجنائية الدولية عن نيته المباشرة بالتحقيقات في الجرائم ضد الإنسانية وجرائم الحرب التي ارتكبت في دارفور، قالت منظمة العفو الدولية اليوم إن التحقيق الذي ستجريه المحكمة الجنائية الدولية يجب أن ينال الأولوية على أية تحقيقات سودانية، وإنه يتعين على جميع الدول، بما في ذلك حكومة السودان، دعم هذا التحقيق بكل الطريق الممكنة.
وقال كولاوولي أولانيان، مدير برنامج أفريقيا في منظمة العفو الدولية "إن الإعلان يبعث الأمل في العدالة لضحايا أعمال القتل وعمليات التهجير القسري الجماعية والاغتصاب في دارفور، وفي مساءلة مرتكبيها".
"غير أنه ومن أجل أن يكون ذلك ذي مغزى لأهالي دارفور، يتعين أن يكون هناك التزام من جانب الحكومة السودانية بتقديم الدعم الكامل لتحقيق المحكمة الجنائية الدولية"، بما في ذلك حماية الضحايا والشهود، والقبض على الأشخاص الذين ترد أسماؤهم في مذكرات الإحضار التي تصدرها المحكمة الجنائية الدولية وتسليمهم.

ويأتي إعلان المحكمة الجنائية الدولية بناء على التوصية التي رفعتها اللجنة الدولية للتقصي التابعة للأمم المتحدة في تقريرها بإحالة الوضع في دارفور إلى المحكمة الجنائية الدولية في يناير/كانون الثاني 2005، والتي تلاها في مارس/آذار صدور قرار مجلس الأمن الدولي رقم 1593، الذي أحال الوضع في دارفور فعلياً إلى المحكمة.
وأضاف كولاوولي أولانيان قائلاً: "إننا نأمل في أن يقود التحقيق إلى مقاضاة جميع من أصدروا الأوامر بمثل أعمال القتل والاغتصاب والتهجير الجماعي هذه، أو تواطأوا بشأنها أو نفَّذوها، بما في ذلك كبار الشخصيات في الحكومة والقوات المسلحة والمليشيا المسلحة".
وقُتل بصورة غير قانونية أو أعدم خارج نطاق القضاء في دارفور على أيدي القوات الحكومية أو أفراد ميليشيا الجنجويد، وهي ميليشيا سلحتها ومولتها السلطات السودانية، ما يربو على 50,000 شخص. ولا يزال أكثر من 1.8 مليون شخص مهجرين بصورة قسرية. كما اغتصبت آلاف النساء، ولا تزال عمليات الاغتصاب مستمرة. وبالمثل، هاجمت القوات المتمردة أيضاً قوافل نقل المعونات الإنسانية.
لقد اامتنعت الحكومة عن نزع أسلحة ميليشيات الجنجويد أو تقديم المتهمين بارتكاب جرائم إلى العدالة. ويحتاج نظام القضاء الوطني في السودان بشكل مُلح إلى إعادة البناء إذا ما أريد للسودان أن يكون مكمِّلاً لعمل المحكمة الجنائية الدولية عن طريق تقديم المتهمين بارتكاب جرائم إلى محاكمات تفي بمتطلبات المعايير الدولية للنـزاهة.
إن قرار مدعي عام المحكمة الجنائية الدولية فتح التحقيق يعتبر رفضاً نرحب به للضغوط التي تمارس من أجل تأخير التحقيقات بحجة افتراض أنها تعرقل مبادرة الاتحاد الأفريقي للسلام التي باشرها الرئيس الليبي، معمر القذافي. وقد رحبت منظمة العفو الدولية ببيان النائب العام، الذي أشار فيه إلى أنه ينبغي لأساليب المصالحة التقليلدية أن "تكمِّل" جهود تحقيق العدالة للضحايا، لا أن تحل محلها.
واختتم كولاوولي أولانيان بالقول: "ينبغي أن لا يُتظر إلى العدالة على أنها عقبة في طريق السلام، وإنما كجزء من الأساس الضروري لبناء السلم الدائم، وذلك عبر تحديد المسؤولية الفردية "وليس الجماعية" عما ارتكب من جرائم". |

The decision today by the International Criminal Court's prosecutor, Luis Moreno Ocampo, to start an investigation into atrocities in Darfur is a key step toward bringing justice for those crimes, Human Rights Watch said.
On March 31, the United Nations Security Council voted to refer the situation in Darfur to the International Criminal Court by adopting Resolution 1593.
Under the court's statute, the prosecutor's initiation of an investigation reflects his assessment that the Sudanese authorities are "unwilling or unable" to prosecute crimes within the ICC mandate, namely genocide, war crimes, and crimes against humanity. This is consistent with Human Rights Watch's finding that the Sudanese authorities have not taken any meaningful steps to hold those most responsible for serious international crimes to account since the armed conflict began in February 2003.
While the Sudanese government has recently announced its intention to establish a special tribunal in Sudan to try perpetrators of serious crimes in Darfur, such a tribunal would require Khartoum to take enormous and effective efforts to ensure the tribunal's independence and credibility, Human Rights Watch said.
A credible, independent tribunal prosecuting lower-level perpetrators could potentially serve as a useful complementary effort to ICC prosecutions. However, Human Rights Watch believes such a tribunal cannot replace what will be a limited number of prosecutions by the ICC of those most responsible. Other local measures such as compensation for stolen livestock and looted assets are also essential steps for restitution of the many victims in Darfur.
Through the course of its investigation, the ICC must protect its witnesses and conduct an active outreach campaign to explain the court's mandate and purpose, Human Rights Watch said.
"Protecting those who come forward to testify and informing those most at risk in Darfur about the ICC are not luxury accessories to the court's investigation in Darfur," said Dicker. "These measures are necessary for justice to be fully realized."
To move ahead with an effective investigation, the Office of the Prosecutor will also need a sufficiently staffed investigative team and adequate support. Canada has provided a voluntary contribution of $500,000 to assist the investigation, increasing resources available through the court's existing budget. Other states can demonstrate their commitment to achieving justice in Darfur by making voluntary contributions to support the ICC's prosecution of crimes committed there, Human Rights Watch said.
Background on Sudan and the ICC
More than two million people among Darfur's population of six million have been forcefully displaced from their homes since February 2003 as a result of a government-supported campaign of "ethnic cleansing" carried out in the context of an internal armed conflict. Despite overwhelming evidence of the Sudanese government's role in committing atrocities alongside ethnic militia allies known as "Janjaweed," the government continues to deny its role in the abuses and minimize the scale of the crisis.
Almost two million of the displaced persons remain in camps and towns, entirely dependent on humanitarian aid, and cannot return to their homes and farms due to ongoing attacks, rape, #####ng, and assault by the government-backed militias as well as other armed actors. An additional million people require food and other assistance as a result of the collapsed economy and pervasive insecurity.
In the past few months, direct hostilities between government forces and rebel groups have lessened, but attacks on civilians continue due to the proliferation of armed groups, the collapse of law and order, and an ongoing climate of impunity. Given the lack of harvest in recent years, there are fears of a potential food crisis.
Since Sudan is not a party to the Rome Statute of the ICC, the ICC could only investigate and prosecute crimes in Darfur following a referral by the U.N. Security Council.

A step towards justice for thousands of victims in Darfur
Paris, Khartoum, 6 June 2005
The International Federation for Human Rights (FIDH) and its member organisation, the Sudan Organisation against Torture (SOAT), welcomes the launch of a formal investigation by the International Criminal Court into the Darfur situation, in Sudan.
In its 1593 Resolution of March 31st, 2005, the UN Security Council referred to the prosecutor of the International Criminal Court (ICC) the situation of Darfur since July 1st, 2002, when the ICC Statute came into force.
On April 5, the Prosecutor received the report of the UN International Commission of Inquiry together with a list of alleged authors of “mass killings of innocent civilians, systematic rape of girls and women, and the burning of family homes”.[1] These massive and systematic acts were qualified by the Commission as “war crimes and crimes against humanity”.
The preliminary analysis of the Commission's documents and other sources of information authorised the prosecutor Luis Moreno Ocampo to “conclude that the statutory requirements for initiating an investigation were satisfied”.
“The opening of this investigation is a first answer to the Darfur victims. As provided by the ICC Statute, victims will finally be able to testify before an independent tribunal and to participate in the proceedings for justice to be done”, said Sidiki Kaba, President of the FIDH.
FIDH and SOAT recall that the Court must guarantee an effective protection for victims and witnesses and ensure that they are fully informed of their rights to participate at all stages of the proceedings.
If “traditional African mechanisms” are to complement the efforts of the ICC – as mentioned in today's ICC press release[2] – in order to achieve “local reconciliation”, FIDH and SOAT urges that they fully respect international Human Rights standards and do not end in a de facto impunity in Sudan.
FIDH and SOAT urges the Sudanese Government to accept the help of the international community in the fight against impunity for the crimes committed in Darfur, by fully cooperating with the organs of the Court, especially with the investigation teams of the ICC.
FIDH and SOAT denounce once more[3] the Security Council's decision not to support part of the financial cost of the ICC investigations. FIDH and SOAT urge States to cooperate with the organs of the Court and to give them the means to carry out the investigations and proceedings. In that sense, the Assembly of States Parties will have to significantly increase the 2006 budget of the ICC.

The FIDH and SOAT recommend:
To the Sudanese Government
to fully cooperate with the Court in accordance with Security Council resolution 1593.
To the International Community, the Security Council and the African Union
to give financial support to the investigations and other activities of the ICC;
to cooperate fully with the investigations of the ICC’s Prosecutor;
to support the establishment of institutions aimed at rebuilding the country without allowing impunity.
To the States Parties to the Rome Statute
to increase significantly the budget of the ICC so that it can efficiently fulfill its mandate not only in Darfur, but also in other situations under analysis;
to cooperate with all the organs of the Court to ensure the effective implementation of their mandate.
To the International Criminal Court
to the Registry: to inform the civilian population of the Court’s mandate and activities, to inform the victims and witnesses of their specific rights according to the Statute of the Court, and especially the right of victims to participate in proceedings; to establish programmes for the protection of victims and witnesses;
to all the organs of the Court: to refrain from citing budgetary considerations as limiting the number of situations in which the Court can investigate annually and as a pretext for abandoning the current analyses of other situations which have been rightfully submitted to the Court.
A brief summary of the functioning of the ICC
The ICC has jurisdiction over war crimes, crimes against humanity and genocide committed by the citizens or on the territory of a State party to the Rome Statute and committed after the 1st July 2002.
The Prosecutor of the ICC, the Argentinean Luis Moreno Ocampo, can be triggered in three ways:
1. By any State party
2. By the Security Council
3. On the initiative of the Prosecutor on the basis of information received from a third party.
When the Security Council refers a situation to the ICC, the Court’s jurisdiction is truly universal, meaning that it is not necessary for the alleged perpetrator of the crime to be a citizen of a State Party or for the crime to have been committed on the territory of a State Party.
This is the situation with Sudan which is not one of the 99 States Parties to the Rome Statute.
